Petitioner requests a Variances from side setbacks to allow e�@ABEryIrSof
existing deck for property located at 24 Grove Street.
The Variance which has been requested may be granted upon a finding of this
Board that:
1 . Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other land, buildings, or structures in the same district.
2 . Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogation from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful considerations the evidence presented at
the hearing, makes the following findings of fact:
1 . The petition was presented by Manual Raymond.
2 . The petition was to enclose an existing deck not to exceed the existing
roof line .
3 . Plans were submitted that were 10 years old which were not accepted, but
Mr. Goggin made the comment that without plans there would be no
approval by the building department.
4 . There was no opposition to this petition.
On the basis of the above findings of fact, and on the evidence presented
at the hearings, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
and not the district in general.
2 . Literal enforcement of the provisions of the Zoning Ordinance would
involve substation hardship to the petitioner.
3 . Desirable relief can be granted without substantial detriment to
public good and without nullifying and substantially derogating from
the intent of the district or purpose of the Ordinance.

On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Zoning Board of Appeal voted unanimously, 5-0 to grant
the variance requested, subject to the following conditions:
1 . Petitioner shall comply with all city and state statures, ordinances,
codes and regulations.
2. All construction shall be done as per the plans and dimensions
submitted.
3. All requirements of the Salem Fire Department relative to smoke and
safety shall be strictly adhered to.
4 . A Certificate of Occupancy is to be obtained.
5. Petitioner shall obtain a building permit prior to beginning any
construction.
6 . Petitioner is to obtain approval from any City Board of Commission
having jurisdiction including, but not limited to, the Planning Board.
i . Exterior finished of the new construction shall be in harmony with
the existing structure.
8. Proper plans to be submitted to the Building Inspectors Office.

Dear Ms. Haight,
On Tuesday, July 23, 1991 a site visit was made at the above referenced
property regarding the construction of a deck at the rear of the building.
Upon inspection it was noted that the deck in its present condition would
not meet the requirements of the Mass State Building Code, fourth edition.
Belga is a list of recomnendations to follow.
1. Post anchors should be installed at each post for attachement to the
concrete foundations.
2. Right angle gusset plates are recommended at the top of the 4X6 posts
that attach,:to the bottom side of deck.
3. Any curved or warped posts shall be replaced.
4. Intermediate diagonal braces be installed in both directions.
5. Joist hangers to be nailed off with 8d galvanized nails into main
timbers and teco joist-hanger nails in floor joists

A hearing on this petition was held August 9, 1989 with the following
Board Members present: Richard Bencal, Vice Chairman, John Nutting,
Secretary, Messrs. Richard Febonio, Edward Luzinski and Peter Dore.
Notice of the hearing was sent to abutters and others and notices of
the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Special Permit to
allow construction of an addition and deck located in an R-1 district.
The provision of the Salem Zoning Ordinance which is applicable to this
request for a Special Permit is Section V B, 10, which provides as
follows:
Notwithstanding anything to the contrary appearing in this Ordinance,
the Board of Appeal may, in accordance with the procedure and conditions
set forth in Section VIII F and IX D, grant Special Permits for alterations
and reconstruction of nonconforming structures, and for changes, enlargement,
extension or expansion of nonconforming lots, land, structures, and uses,
provided, however, that such change, extension, enlargement or expansion
shall not be substantially more detrimental than the existing nonconforming
use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the special permit will promote the public health, safety,
convenience and welfare of the City's habitants.
The Board of Appeal, after careful consideration of the evidence presented,
and after viewing the plans, makes the following findings of fact:
1. There was no opposition.
2. Neighbors and abutters spoke in favor.
3. The proposed changes would allow the petitioner a fuller use of their
property.
On the basis of the above findings of fact, and on the evidence presented,
the Board of Appeal concludes as follows:
1. The granting of the requested Special Permit will promote the public
health, safety, convenience and welfare of the City's inhabitants and
will be in harmony with the neighborhood.

2. The relief requested can be granted without substantial detriment to

deck, subject to the following conditions:

and fire safety be adhered to.
2. All construction be done with a legal building permit and as per
all City and State Building codes.
3. All construction be as per plans and dimensions submitted.
4.. Exterior finishes of the proposed addition be in harmony with
the existing building.

Please be advised I have examined affidavits, voting
lists and utility records relative to the above entitled
real estate and it is my opinion that it was a lawful two-
family prior to adoption of the Zoning Ordinance on August
27, 1965 . In addition, the records of the Assessor ' s Office
indicate it is currently assessed as a two-family. Accordingly,
it is my opinion it should be afforded the protection of
Section VIII (E. ) of the aforementioned ordinance relative
to nonfoncorming uses and, thus, it' s current use as a
two-family is permissible.
