DECISION ON THE PETTTTON OF_CHARLES BRETT FOR VARIANCES FOR =1 , 13, 15, GREENLA'r1N AVENUE a/k/a LOTS 46-52 GREENLAWN AVE. ( R-1 ) A hearing on this oetition was held June 19, 1991 with the following Board Members present: Richard Bencal, Chairman; Richard Febonio, Edward Luzinski, Bary Jane Stirgwolt and Associate Member Ronald Plante. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting Variances to divide existing three lots into four lots. Property is located in an R-1 district. The Variances whic^ have been requested may be granted upon a finding of the Board that: a. Special conditions and circumstances exist .which especially affect the land, building and structure involved and which are not generally affecting other lands, buildings or structures in the same district. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1 . Councillor Leonard O'Leary spoke in favor of this petition. 2. Mrs. Waish, and abutter who had concerns about water run--cf.` on her property, was informed by the Chairman that the petitioner was at this time only asking to divide his lots and not to build ant at a future time if the petition is granted and at the start of any construction, she would be notified by the proper City Dept. and she could voice her concerns at that time. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property but not the district in general. 2. Literal enforcement of the provisions of the Ordinance would involve substantial hardship to the petitioner. 3. The relief requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. l DECISION ON THE PETITION OF CHARLES BEETT FOR VARIANCES AT 11 , 12, 15 CREENLAWN AVE. , A/K/A LOTS Q-52 GREENLAWN AVE. . CALEL page two Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the Variances requested, subject to the following conditions: 1 . That the petitioner shall have a pre-blast survey in accordance with City Ordinance. 2. Property street numbering be obtained from the City of Salem Assessor.
