RE: OPINION OF THE SALEM ZONING BOARD OF APPEALS
ON PROPERTY LOCATED AT 11 GRAFTON STREET, SALEM
Dear Ms . Dumas:
I am in receipt of a copy of your letter dated December 12,
1995 to the City of Salem Board of Appeals . This letter purports
to appeal the decision as above-noted.
In reviewing all the circumstances surrounding this matter it
appears that you filed the Notice of Appeal with the Building
Department on December 12 , 1995 at 3:59 p.m. This does not comply
with Massachusetts General Laws Chapter 40A, §11 and 15 which
indicate that the appeal must be taken within 20 days of the
hearing and filed with the City Clerk. Inasmuch as the City Clerk
did not receive this Notice until the following day it is my
opinion that the . appeal is invalid and I have instructed the
Building Inspector to issue a building permit.
