Notices were sent to abutters and others and duly published in the Salem Evening News on Juney. and June 13,1979 in accordance with Mass. General Laws, Chapter 808. At the hearing on June 20, 1979 the Board requested that the petitioner submit additional plans and drawings. On July 13, 1979 the hearing was continued. . Mr. Womack represented himself before the Board. The petitioner is requesting a variance to reduce the side yard to 516" in order to build a 20'x2416" garage with room above attached to his house. The room above the garage includes a bathroom and will be used by the petitioner's mother. Mrs. Adlee Hodges, 51 Gallows Hill Rd., the abutter on the side the addition would be put, appeared and spoke in favor. She stated that there will be no blockage of the sunlight to her house and the addition would prevent the neighborhood children from playing ball in this space, which would be better for the neighborhood. There was no opposition. The Board voted unanimously to grant the variance requested. The Board found that the distance between the garage addition and structure located on adjacent property to be sufficient room for Fire Department trucks. The Board also found that due to the topography of the land, any other location for the garage to be impractical and that it could grant the variance requested without substantial, detriment to the neighborhood and without derogating from the intent of the Salem Zoning By-law. . A visual site inspection of the property and review of our records confirms this allegation so for these reasons it requested that you contact this immediately upon receipt of this letter, and file for all requiredpermit applications,permit fees, and a Debris Disposal Aff davit form. Homeowners License Exemption form or Worker's Compensation Affidavit are also required to be submitted during the filing. During said site visit a resident at the home was not compliant on a request to come to the door to speak to an official of our office, thus you are hereby directed to contact this office immediately upon receipt of this violation. Additionally,you are in violation of City and Building Department requirements on fence enclosure around the pool as stated in the Salem Ordinance: Pools are also required to be enclosed by a fence at least 48"high with a self-latching gate at least 36"wide. Rail fences are not sufficient to meet this requirement. Salem City Ordinance requires the fence even if the above ground pool has a barrier mounted on the top of the pool. Under the provisions of 780 CMR, Section 116.3, of the Massachusetts State Building Code, access to this property must be granted for the purposes of an inspection after the proper permits have been issued to assure compliance with the City of Salem's Pool Regulations (see below). If this property has rental units, these tenants must be notified in advance of this inspection, so that access to these spaces may also be accomplished. This Required Inspection is Scheduled for September 4, 2012 at 11:30 ; failure to respond to this notification will be construed as non-compliance, and as such an Administrative Search Warrant will be sought, so as to allow the lawful inspection of this property. Pools are allowed in only side or rear yards if located at least 5'from the side and rear lot lines. A permit is required from the Building Department and when the permit is issued, a licensed electrician must obtain a permit from the City Electrical Department if there is any electrical work to be done. For above ground pools, a mortgage plot plan will suffice. Pools are also required to be enclosed by a fence at least 48"high with a self-latching gate at least 36"wide.Rail fences are not sufficient to meet this requirement. Salem City Ordinance requires the fence even if the aboveground pool has a barrier mounted on the top of the pool. You are hereby ordered to begin to rectify these conditions immediately upon receipt of this notice. Failure to do so may result in further actions being brought against you, including Municipal tickets and up to and including the filing of criminal complaints at District Court.
