This Department has received and confirmed a complaint regarding an unregistered and uninspected vehicle at
your property. City Ordinance 24-21 prohibits the storage of unregistered and uninspected vehicles for more
than 15 days. You are directed to either remove the vehicle or have the vehicle registered and inspected within
15 days of this notice. Additionally,you have removed the section of sidewalk in front of your home and left a
section of pipe sticking up. You are directed to contact the City Engineering Department about your
replacement of the sidewalk. Failure to do so will result in Municipal Code tickets and further enforcement
actions.

Before the court is the plaintiffs motion for judgment by default, as to the defendants
? Dolla Aoude Amine Aoude and Sonya Aoude the"Aoudes" filed Aril 7 2009 and an

Ix agreement for judgment," filed with supporting papers on March 3,2009 by plaintiff's counsel,
E executed by him on behalf of his client,the plaintiff, Bayview Loan Servicing, as servicer for
Wachovia Bank, N.A., successor by merger to First Union National Bank, as Indenture Trustee,
("Bayview"), and by general counsel for the defendant Franklin Credit Management Corp.
("Franklin").
Defendants Dolla Aoude,Amine Aoude, and Sonya Aoude,having failed to answer or
appear or otherwise defend, have been defaulted by the court. They were served with a Notice of
Default pursuant to Mass. R. Civ. P. 55(a)dated November 19, 2008.
Franklin has not answered or appeared in this action(with the exception only of the
"agreement for judgment").' Franklin,having not answered or appeared or otherwise defended,'
is hereby defaulted by the court pursuant to Mass. R. Civ, P. 55 (a).
After review of the papers submitted, and after due proceedings, it is
ORDERED,ADJUDGED and DECLARED that Bayview is a bolder of a mortgage
("Mortgage") dated December 20, 1999,recorded at the Essex County (South District)Registry'
of Deeds("Registry") at Book 16111,Page 64, granted by Amine Aoude and Dolla Aoude and
encumbering property,more particularly described in the Mortgage and known as 47 Gallows
Hill Road, Salem,Massachusetts ("Property"); the Mortgage was assigned of record to First
Union National Bank, Indenture Trustee,by assignment of mortgage dated December 30, 1999,
recorded with the Registry in Book 16671,Page 64. It is further
ORDERED,ADJUDGED and DECLARED that the further Assignment of Mortgage
("Assignment's dated March 6, 2008,recorded at the Registry at Book 27595,Page 15, which
purports to assign the Mortgage to Franklin, was executed and recorded in error, as a result of
mutual mistake of the parties to the Assignment, and is void and of no force or effect. It is
further
ORDERED,ADJUDGED and DECLARED that the instrument entitled"Release"
("Discharge") dated March 6, 2008,recorded at the Registry at Book 27595, Page 16, which
purports to discharge the Mortgage was executed and recorded in error, as a result of mutual
mistake of the parties to the Discharge, and is void and of no force or effect. It is further
ORDERED, ADJUDGED and DECLARED that the court has not adjudicated the
Tight, title, or interest, in and to the Property at issue in this case,of or as to any person or entity
who is not an individually-named party to this proceeding. It is further
ORDERED and ADJUDGED that this Judgment, or a certified copy of it,may,upon
payment of all fees therefor required by law,be recorded with the Registry, and may there be
referenced on the margin of the Mortgage, the Assignment and the Discharge. It is further
ORDERED that within fourteen(14) days of issuance of this Judgment,plaintiff shall
serve an uncertified copy of this Judgment on all parties,by mailing it to them by first class mail
or by causing it to be served on them by sheriff or constable. It is further
ORDERED that within twenty-one(21) days of issuance of this Judgment,plaintiff shall
file with the court a certificate of service certifying compliance with the provisions of the
'The"agreement for judgment"is executed on Franklin's behalf by counsel not a member of the
bar of the Commonwealth. The"agreement for judgment"therefore does not constitute an answer or
appearance on Franklin's bebalf. The court treats this submission as written assent on the part of Franklin
