Ms. MacDougall
Our Department received a complaint regarding your property located at
23 Gallows Hill Road. The complaints were investigated on Tuesday, May
27, 2014, present was David Greenbaum of the Salem Health Department.
As discussed with you on site at the inspection date noted above your
property was found to be in violation of the Massachusetts State Building
Code requirements.
The front masonry stairs on the Gallows Hill Road side of the property are in need
of repair as it poses a risk to Public Safety, IMMEDIATE CORRECTIONS ARE
REQUIRED. Additionally the remaining frame work of a stair platform and
stairway on the right side of house is also is in need of repair as it also poses a risk
to Public Safety. This stair is a part or the required second means of egress out or
the dwelling and is a requirement of the Massachusetts State Building Code thus,
IMMEDIATE REPAIR, CORRECTIONS OR REPLACEMENT IS REQUIRED.
You are hereby ordered to begin to obtain the required building permits and rectify these
conditions immediately, and complete these corrections within 21 calendar days. Failure
to do so may result in further actions being brought against you, up to and including the
issuance of Municipal tickets or filing of criminal complaints at District Court.
You have the right to appeal this order to the State Board of Building Regulations at One
Ashburton Place, Boston, Ma.

During our last conversation on or about July 10, 2012 we agreed that due to some emergency family
issues that we would reschedule our Required Inspection to a later date from the original July 13"
Inspection. Our office has again received complaints regarding your property located at 23 Gallows
Hill Road, alleging an illegal basement apartment in violation of the City of Salem Zoning Ordinance
chapter 6-1 for a multi- family residence in a location zoned for(R-1) one family residences. Our
Department's Duty and Liability requires us to reschedule this meeting at this time.
Under the provisions of 780 CMR, Section 104.6—Right ofEntry, of the State Building Code,
access to this property must be granted for the purposes of this inspection. If this property has
rental units,these tenants must be notified in advance of this inspection, so that access to these
spaces may also be accomplished.
This inspection is scheduled for Friday,August 31st at 10:00 a.m.
You are hereby directed to contact this office immediately upon receipt of this letter.
Failure to respond to this notification will be construed as non- compliance, and as such an
Administrative Search Warrant will be sought, so as to allow the lawful inspection of this property. If
you feel you are aggrieved by my zoning interpretation, your Appeal is to the Salem Zoning Board of
Appeals. If you feel you are aggrieved by the Building code sections,your Appeal is to the Board of

During our telephone call on the morning of July 12, 2012, you have requested that we
disclose the names of the complaints regarding our "Required Inspection' letter of
July 10, 2012. Our office does not maintain a list of the complaints that come in to our
Department and even if such information was documented, we would not disclose names
to you or any other resident. We investigate each complaint individually to determine if a
Massachusetts State Building Code or City Zoning Ordinance violation exists.

You have pointed out a problem at#25 regarding the two sheds. The owners of that

From whom did you receive a complaint? The allegation Is false,absurd, and completely unfounded.
This is,and has always been, a single-family residence.
Does your"zoning interpretation"prohibit my two daughters,elderly father, and I to live as a"single
family"? If so,you will be hearing from my attorney and my minister.
• My home has never had a "basement."
• There Is no(and has never boar any) "Illegal basement apartment"at my home.
• There are no(and have never been any) "rental units"at my home.
• The sola occupants of my home are my dagab my elderly fa fth andl
Neighbors know—from seeing me with wheelchairs,visiting nurses, the occasional ambulance, and so
on—that I have been taking care of my elderly parents. Mom recently passed away and Dad is
seriously III. He is hospitalized in Boston and my daughters and I spend most of our time there.
Unlike my neighbors who have Illegally added second sheds or Illegally failed to properly fence or
maintain their/n-ground pools—I legally added wheelchair-accessible space a few years ago for
my elderly parents. Why have you made"allowances"(given preferential treatment)for these neighbors
for the past 20 years, yet continually accept false allegations and question the work that was done—
totally in compliance, legal, and approved and signed-off by the Building Dept—on my property? This
undermines the integrity of the Building Dept and City Hall.
Before any work was started on my home, my contractor, Ray Marquis(Marblehead), and I made sure
that Tom St.PierralBullding Dept approved ALL plans. Ray has done a lot of projects in this area,
knows Tom well, and worked closely with Tom and his staff to ensure complete compliance with the
Building Dept. The Building Dept—Tom St. Pierre and/or his representatives/inspectors—inspected
and signed-off on every step. As assistant building inspector you must already be aware of this.
Similar past malicious complaints were filed--and promptly dismissed by Tom—presumably by
tradesmen (neighbors) Ray chose not to hire. I would expect you and your office to recognize these
complaints for what they are and handle them appropriately, instead of wasting your time and taxpayer
money. Whoever continues this harassment under the anonymity of"complaints"and"allegations"to
your office is manipulating you to act as their agent to harass my family.
The building plans/inspections that we were required to post complete with dates and sign-off
signatures—were clearly posted for a year on the front door facing the street. All work done at my home
has been legal and completely in compliance with the Building Dept.
On Wednesday I left voicemail. I will call again on Thursday, and as you would expect, on Friday we will
be at the hospital at my father's bedside,

Dear Owner,
This Department has received and confirmed a complaint regarding your property. You have had
a Storage Unit(container) in your front yard for at least a year .Salem Zoning Ordinance 7-1
states that a trailer shall not be stored in any front yard.If stored in any side or rear yard,the
trailer shall not be placed any closer than ten feet from any building or within 5 feet of a property
line . Section 7-8 States that no Accessory Building or structure shall be located within any
required front yard or within any side yard of a corner lot.. Whether you want to call this
container a trailer or a shed either way it is violation of City Ordinances and must be removed.
You are directed to remove the container within 30 days of receipt of this notice. If you feel you
are aggrieved by this order or my zoning interpretation, your Appeal is to the Salem Zoning

Ms MacDougall, This letter is in response to your letter of July 2°d. You have recieved a
violation notice on your property. You have requested that we disclose the names of the
neighbors who are complaining. We do not maintain a list of the complaints that come in and
even if we did, we would not disclose names them to you.We go out and observe whether or a
violation exists or not. The violation notice is coming from my Department . and to date, you
have still not complied. If you continue to violate the City Ordinance, You will begin to be fined
daily.
You have pointed out a problem at#25 regarding the two sheds. The owners of that property will
be notified of the violation the same as you have been. You have also continually complained
about why I wont let you have two sheds on your property. I explained to you well over a year
ago that I enforce City Zoning Ordinances. I am not allowed to issue permits for more than one
shed. I also explained to you that the Zoning Board of Appeals would be the only way you could
vary from the Regulations outlined in the Zoning Ordinance.If you wish to file a Request for a
