RE: Trash trucks on Forest Avenue
To Whom It May Concern:
The Salem Board of Health has received numerous complaints regarding your
trash trucks parked on Forest Avenue in Salem, MA.
On Monday, May 19, 2025, David Greenbaum, Health Agent for the Salem Board
of Health conducted an inspection of the area of Forest Avenue and noted one of
your trucks parked on the side of the road with a barrel full of trash and debris
next to it. Additionally, pictures were provided to the Salem Board of Health
depicting the trucks on the same,street full of trash and debris with loose trash all
around the trucks.
These conditions are in violation of City of Salem Code of Ordinances sections,
Sec. 2-706 — Unauthorized collection of solid waste, Sec. 38-7 — Obstructions,
Sec. 38-8— Obstructing sidewalk with articles, and Sec. 38-17 — Spilling of ash or
rubbish containers on sidewalks. Additionally, you have not applied for your
permits to operate as a waste hauler in violation of City of Salem Public Health
Regulation #7 Requirements for Placement, Collection and Disposal of Solid
Waste by Residents,.Mandatory Recycling for Residents and Businesses within
the City of Salem and Solid Waste Disposal/Recycling Haulers Licensing and
Operations Section VI. Solid Waste Disposal/Recycling Haulers Licensing and
Operations
In accordance with Massachusetts General Law c.111, s122 and the
referenced City of Salem ordinances and regulations the Salem Board of
Health determines that these conditions create a public health nuisance.
Therefore, in accordance with Massachusetts General Law c.111, s123, you are
ordered to remove these trucks from Canal Street in Salem and cease and desist
parking these trucks on any street in the City of Salem.
Additionally, you must apply for and receive the required permits to operate as a
waste hauler in the City of Salem.
These violations must be corrected within 24 hours of receipt of this order.
Failure to comply with this order may result in monetary fines being issued and/or
a criminal complaint being sought against you in Salem District Court.
Should you be aggrieved by this Order, you have the right to request a hearing
before the Board of Health. A request for such a hearing must be received in
writing in this office of the Board of Health within seven (7) days of receipt of this
Order. At'said hearing, you will be given the opportunity to be heard and to
present witness and documentary evidence as to why this Order should be
modified or withdrawn. You may be represented by an attorney. Please also be
informed that you have the right to inspect and obtain copies of all relevant
inspection or investigation reports, orders, and other documentary information in
the possession of this Board, and that any adverse party has the right to be
present at the hearing.
