Our office,received a complaint,regarding the current condition of the in ground pool at your property located at 21 Gallows Hill Road. On Tuesday,May 17,2016,your property was inspected and your property was found to be in violation of the Massachusetts Building Code, (see below). A subsequent review of our records revealed that a notice of violation was previously sent to you on June 3,2014,thus immediate action is required on the in ground pool immediately. Please find the attached Violation Ticket#2129 enclosed for previous non-compliance The pool located in the rear of your property is in disrepair and as it poses a risk to Public Safety, IMMEDIATE CORRECTIONS ARE REQUIRED. The pool presently is empty of water and appears unmaintained and in neglect for some time.Under the provisions of Massachusetts State Building Code (780 CMR Section 116, 780 CMR Section 107.6.2 and Massachusetts General Law's Chapter 143) Immediate corrections are required. (Options); - Install a jour(4'-0") continuous fence around the unfilled pool apron with one(1)—access gate to protect the Public from falling into the pool opening. This option would be only accepted as a temporary fix to the violation with a permanent solution to be presented in written form to this Department with in seven days from issuance of this letter. On Friday, September 7, 2012 your property was found to be in violation of the City of Salem Zoning Ordinance, (see below) Pools are also required to be enclosed by a fence at least 48"high with a self-latching gate at least 36"wide. Rail fences are not sufficient to meet this requirement. Salem City Ordinance requires the fence even if the above ground pool has a barrier mounted on the top of the pool. The aforementioned non-compliance,missing fencing panels disrupting required fence enclosure, is in conflict with City of Salem zoning ordinances. Specifcally, two sections of stockade fence are missing. This presents a serious safety concern for children in the area. The Mass. State Building Code 780 C.M.R section 421.10 requires a fence or barrier at least 48" enclosing the pool area.This violation must be addressed immediately. A temporary fence may be installed, but the permanent fence is to be in olace within 30 days of receipt of this notice. Also, while looking at the pool situation, I couldn,t help but see that the raer porch and stairs have been torn out and the replacement has not been finished. This egress has been like this for some time based on the weathering of the framing members and supplies. A building permit is to be obtained and the stairs completed within 30 days.
