In that regard your letter dated January 24, 1995, has been directed to me for appropriate response. Initially, it should be noted that the September 29 , 1994 agreement/contract with Tony's General Contracting, executed by Mr. Garro and Mr. Pizzo as contractors, and by your clients, Mr. and Mrs. William Chigas, contains not only a face sheet, but a significant addendum detailing the exact nature of the extensive renovation work to be performed at the Chigas home. Mr. Pizzo advises me that Mr. Tony Garro, with whom he was associated on this job, has all pertinent copies of the contract and the particular addendum referenced herein. Mr. Pizzo does not have any copies of same, and advises that Mr. Chigas may indeed have a duplicate copy. I am thus able to respond to the twenty-five (25) individual items which you have set forth on your letter, which you allege that my client has failed to perform in a workmanlike fashion. I suggest that you forward same to me, so that I may review these with my client for a more detailed response. In general, however, my client would respond to the issues set forth in your letter as follows. Although, we do acknowledge that $32 , 500 . 00 has been paid by Mr. and Mrs. Chigas for the work, please be advised that my client received $6, 800. 00 from Mr. Garro on November 4 , 1994 , and after Mr. Garro had abandoned the work site, an additional $6, 500 . 00 from Mr. Chigas on December 9, 1994 . The payments were made directly to Garro. J Attorney Anthony Kline February 9, 1995 Page Two At that time, Mr. Chigas and Mr. Pizzo, who maintained a cordial relationship throughout the work, entered into a second contract for performance on this job. Accordingly, Mr. Pizzo does not have a copy of that contract, which may indeed set forth the terms and conditions of Mr. Pizzo's continued engagement by Mr. and Mrs. Chigas, and may indeed vitiate the terms of the initial contract. Would you kindly provide a copy of that contract, which Mr. Pizzo advises Mr. Chigas has. With regard to the present work completed on the property, Mr. Pizzo would note the following. He has completed three-quarters of insulation of the backside of the roof, installed the full front side of the roof, including cutting and gutting the existing roof, and installed insulation of the 2x10 roof and rafters. In addition Mr. Pizzo gutted and replaced walls and installed new flooring and strengthening the support beams in the floor with new 2x6 boards. Further inside petitions (wall dividers) were installed to provide greater access for roof support, along with 5 windows. Mr. Pizzo worked on the Chigas home from approximately September 30, 1994 to mid-January, 1995, whereupon Mr. Chigas advised him to cease and desist from all further work. rMr. Pizzo denies and rejects any claim that the work he performed was defective or conducted in an improper manner. Mr. 1 Pizzo has been a building contractor for over 15 years, and maintains an impeccable reputation in the North Shore community for • his work. In addition Mr. Pizzo's work was performed in full 'reference to, and in compliance with, the Contractor's Field Guide, 1991 Edition, Paul I. Thomas, Editor, and he has addressed issues ,with regard to- his installation of materials, in conformance with •the Contractor's Field.. Guide, with the Salem Building Inspector as ,well as your client, to advise of his satisfactory completion in •accordance with same. Mr. Pizzo would note that Mr. Chigas was kept fully advised as to all work conditions, progress, and issues regarding Mr. Garro's failure to perform his obligations under the contract during the time that Mr. Pizzo worked at the Chigas home. Mr. Pizzo advises that he informed Mr. Chigas on several occasions to cease and desist in making any further payments directly to Mr. Garro, due to the fact that Mr. Garro would fail to perform as he has on this job. With respect to your references regarding inappropriate behavior on Mr. Pizzo' s part, Mr. Pizzo denies the allegations as set forth by the Chigas' . Mr. Pizzo's use of Mr. Chigas' telephone, was occasioned only due to necessary calls , and Attorney Anthony Kline February 9, 1995 Page Two approved by Mr. and Mrs. Chigas. Mr. Pizzo has further advised that he would gladly pay for any and all long distance telephone charges incurred by the Chigas' in this regard, but Mr. Chigas has never presented any request for any reimbursement. The improper use of the pick-up truck alleged in your letter, was offered by Mr. Chigas, thus we are somewhat chagrined that after his offering Mr. Pizzo the use of his vehicle, he would set forth any complaint regarding same. Finally, Mr. Pizzo advises that the dumpster that was left on the property was removed two days after Mr. Pizzo was instructed by Mr. Chigas to vacate the job site and that Mr. Pizzo had no part in the removal of any fence from the property, but instead that was an issue arranged between Mr. Garro and Mr. Chigas. You should know that Mr. Pizzo currently has over $15, 00 . 00 in unreimbursed labor invested in this job, as well as significant funds for out of pocket expenses which remain unreimbursed. Mr. Pizzo estimates, and has fully advised Mr. Chigas, that due to Mr. Garro's failure to perform on the job, it will take approximately $24, 000. 00 to complete same. It is also an interesting to note that during the period of Mr. Pizzo's working on the house, Mr. Chigas used PMCS Training Manuals for off shore drilling, which were provided by Mr. Pizzo at no charge or cost to Mr. Chigas. Because many issues remain unresolved in this case, which may be able to be addressed if copies of the contract were provided, I would ask that you forward same to me, so that I would have the time and the opportunity to address these matters with Mr. Pizzo. Mr. Pizzo is however, in the interim, reluctant to return to the job site given his significant out of pocket costs, and unreimbursed and uncompensated time, which financial damage he refuses to exacerbate. He informed me that none of the work we wanted accomplished had been started. So apparently our inspection with Mr. Pizzo fell on deaf ears. The following is a list of unacceptable work on the project. 1. Ridge needs additional nailing. 2. Replace all hangers on roof rafters. 3. Head off rafters at skylight area. 4 . Plywood flooring on second floor must be removed to enable inspection of frame work below plywood. 5. Rafters on south elevation were insufficient in size for span. Partition underside must be made structural to carry rafters. 6. Siding needs to be made water tight. The owners are the acting agent on this project and should have contacted us to perform inspections of the project. This office was never contacted for any inspections to be performed, until Mr. Chigas started having problems financially. This office is also going to revoke Mr. Pizzo's, City of Salem Building license for not performing adequate work and requirements per building codes. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting a Variance from front setback to allow construcation of a dormer at 4 Friend Street. This property is located in a (R-2) district. The Variances which have been requested may be granted upon a finding by this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. 3. The proposed change will allow the petitioner a better and fuller use of the property. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Zoning Board of Appeal concludes as follows: 1. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioners. 2. Desirable relief can be granted without substantial detriment of the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance.
