In accordance with Chapter III, Sections 127A and 127B of the Massachusetts General Laws, 105 CMR 400.00; State Sanitary
Code, Chapter 1: General Administrative Procedures and 105 CMR 410.00: State Sanitary Code, Chapter 11: Minimum
Standards of Fitness for Human Habitation, an inspection was conducted of the property 16 Pingree Street#1 by Elizabeth
Gagakis, Senior Sanitarian on April 25, 2024 at 1:00pm.
Notice: if this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's responsibility to
notify tenants of lead related reports and tests, and to ensure that this unit complies fully with 105 CMR 460:000: Regulations for
Lead Poisoning Prevention and Control. For further information or to request an inspection, please contact the Salem Board of
Health at(978)741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection report and to
take all positive action to prevent these violations from occurring again in the future.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a complaint being sought
against you in Trial Court. Time for compliance begins with receipt of this Order.
Should you be aggrieved by this Order, you have the right to request a hearing before the Board of Health. A request for said
hearing must be received in writing in the office of the Board of Health within 7 days of receipt of this Order. At said hearing, you
will be given an opportunity to be heard and to present witness and documentary evidence as to why this Order should be
modified or withdrawn. You may be represented by an attorney. Please also be informed that you have the right to inspect and
obtain copies of all relevant inspection and investigation reports, orders, and other documentary information in the possession of
this Board, and that any adverse party has the right to be present at the hearing.
Please be advised that the conditions noted may enable the occupant(s)to use one or more of the statutory remedies available
to them as outlined in the enclosed inspection report form.

y Based upon a tenant complaint,an inspection was conducted in accordance with Article II of the
State Sanitary Code, 105 CMR 410.000. Upon inspection,the following were noted:
14 days .500 1. Tenants had complaint of mold in the apartment.At the time of inspection,it was noted that
there was what appeared to be some mildew built up in the comer behind the TV in the
living room at the lower baseboards and some slight bubbling of the paint.There is also
some mildew build-up in the comers of window sills in both the primary and second
bedroom.Observations during the inspection noted that the basement has regular flooding
during rain(a cardboard box in the basement was observed to have mushrooms growing on
it),and tenants have a large grow tent in the apartment with a ventilation duct that was not
vented to the exterior at the time of inspection. Mold/mildew on baseboards must be
removed/cleaned and bubbling paint must be scraped and re-painted;owner to assess for
any potential sources of moisture from the outside on this side of the house and ensure
there are no leaks from the exterior. Basement sealing and pumping must continue to be
improved to help prevent basement flooding,and tenant to vent grow tent to the outdoors to
assist in reducing humidity in the apartment.
Owner and tenant to correct this violation within 14 days.
7 days .235 2. Frame of the screen in the kitchen window is bent at the top. Repair screen so it is in good
condition and fits the window properly. Owner to correct this violation within 7 days.
7 days .500 3. There are some holes in the wall next to the outlet on the right side of the stove hood.
Repair wall/seal holes so the wall and outlet are intact and in good condition.Owner to
correct this violation within 7 days.
7 days .235 4 Electrical outlet above the kitchen sink is loose. Repair/secure outlet so it is in safe secure
condition.Owner to correct this violation within 7 days.
24-48 hours .330 5. Smoke detector is missing from the ceiling in the hallway outside the bathroom.Owner to
provide and install working smoke detector in this location and tenants to ensure it stays up:
owner to correct this violation within 24-48 hours.
7 days .235 6. Both window screens in the primary bedroom have rips in them. Repair or replace so
screens are intact and in good condition.Owner to correct this violation within 7 days.
24-48 hours .330 7 Smoke detector is missing from the back hall on the first floor. Provide and install working
smoke detector in this location. Owner to correct this violation within 24-48 hours.
7-days .540 8. Leff:window in the living room is missing a screen. Provide a properly fitted screen for this
window,to be installed between April 1 and October 30 every year.Owner to correct this
violation within 7 days.
24-48 hours .150 9. Hot water was recorded to be 143 degrees F.at the time of inspection. Hot water must be
provided at no less than 110 degrees F and no higher than 130 degrees F.;turn hot water
temperature down to meet these requirements.Owner to correct this violation within 24-48
hours.
