Dear Mr. Scire,
As per our several conversations concerning this matter this is a formal letter of
notification that you have encroached upon my property at 16 Freeman Rd., Salem, MA.
When looking at the properties corner markers it is clearly visible to the naked eye that
you are over your property line. I ask that you remove what is yours from my property
(stones, rocks, boulders, etc). I also ask that you back fill with soil all ruts and holes on
my property made by your equipment during the clearing process. I hope this issue can
be resolved without the help of land court. Should you leave me no other alternative I
will seek reimbursement for all legal, court and surveying expenses incurred during the
process.
I do have one other concern I wish to address in this letter. That is the height of
your driveway. In the past I have not experienced any water retention problems in that
area of my property. I expect that you have thought out and engineered everything
properly to avoid this from happening. I can only hope your elevated driveway will not
cause run off on to my property creating a small pond. Only time will tell, when the
heavy rains come as to what lies ahead.
Your timely attention into this matter would be greatly appreciated. I have
enclosed a map of my property. I am also sending a copy of this letter to the Building
Inspector's Office and the Conservation Department.

On Thursday, March 3, 1994, the Planning Board of the City of
Salem held a public hearing regarding the application of Daniel
Archibald for a Special Permit under Section 7-16, Wetlands and
Flood Hazard Districts of the Salem Zoning Ordinance, for the
construction of a single family home and associated site work
within a Resource Area at 18 Freeman Road.
At a regularly scheduled meeting of the Planning Board held on
Thursday, March 17, 1994, the Board voted by a vote of six (6) in
favor , none (0) opposed, to approve the application as complying
with the requirements of a Special Permit, subject to conditions:
1 . Conformance with Plan
Work shall conform to plan entitled "Definitive
Subdivision Plan of Land Located in Salem, Mass. " two
sheets; Sheet One dated March 13, 1992 with final
revision dated February 1, 1994 and Sheet Two dated
October 5, 1993, prepared by Eastern Land Survey
Associates, Inc.
2 . Conservation Commission
Work shall conform with all= requirements of Order of
Conditions issued by the Salem Conservation Commission on
December 10, 1992 - DEP File #64-211.
3 . Board of Health
Board of Health requirements set forth in a letter dated
September 13, 1993, (from subdivision comment sheet) ,
shall be strictly adhered to.
4 . Construction Practices
All construction shall be carried out in accordance with
the following conditions:
a. No work shall commence before 8:00 a.m. o w kdays

There shall be no work conducted on Sundays or holidays.

appeal has been filed, and it has been dismissed or denied, is
recorded in the Essex County Registry of Deeds and is indexed in
the grantor index under the name of the owner of record or is
recorded and noted on the owner 's certificate of title. The fee
for recording or registering shall be paid by the owner or
applicant.

The Planning Board voted on Thursday, December 2 , 1993 , to
approve the proposed subdivision plans entitled "Definitive
Subdivision Plan of Land located in Salem, Mass, " two sheets ;
Sheet One dated March 13, 1992 with final revision dated December
2 , 1993 and Sheet Two dated October 5 , 1993, subject to the
following conditions:
1 CONFORMANCE WITH PLAN
Work shall conform to plan entitled "Definitive
Subdivision Plan of Land Located in Salem, Mass. " two
sheets; Sheet One dated March 13, 1992 with final
revision dated December 2, 1993 and Sheet Two dated
October 5, 1993 , prepared by Eastern Land Survey

2 . UTILITIES
a. Utility installation shall be reviewed and approved
by the City Engineer .
b. Developer will be required to extend the water line
from City water main terminus.
C. Abutters shall be allowed to connect to the newly
constructed water line at their own expense.
4 . If any damage occurs to the abutters water line
during construction of the main water line, the developer
will be responsible to fix abutters water line.
3 . BOARD OF HEALTH
Board of Health requirements set forth in a letter dated
September 14, 1993 , shall be strictly adhered to.
4 . CLERK OF THE WORKS
The City of Salem Clerk of the Works shall be provided at
the expense of the developer as is deemed necessary by
the City Planner .
5 . CONSTRUCTION PRACTICES
All construction shall be carried out in accordance with
the following conditions:
a . No work shall commence before 8: 00 a.m. on weekdays
and 8 :00 a.m. on Saturdays. No work shall continue
beyond 5: 00 p.m. There shall be no work conducted on
Sundays or holidays . Inside work of a quiet nature may
be permitted at other times .
b. All reasonable action shall be taken to minimize the
negative effects of construction on abutters. Advance
notice shall be provided to al abutters in writing at
least 72 hours prior to the commencement of construction.
C. During construction appropriate measures will be
taken to ensure that the sheeting run-off will be
directed onto applicants property.
d. Drilling and blasting and hoe-ramming shall be
limited to Monday-Friday between 8 : 00 a.m. and 5 :00 p.m.
There shall be no drilling and blasting on Saturdays,
Sundays or holidays.
e. All construction vehicles shall be cleaned prior to
leaving the site so that they do not leave dirt and/or
debris on roadways as they leave the site.
f . All construction shall be carried out in accordance
with the Rules and Regulations of the Planning Board.
6 . STREET LIGHTING
Street lighting shall be reviewed and approved by the
City Electrician.
7 . AS-BUILT PLANS
As-Built plans, stamped by a Registered Professional
Engineer or land surveyor, shall be submitted to the
Planning Department and Engineering Department prior to
issuance of a Certificate of Occupancy.
8 . VIOLATIONS
