Dear Mr.Mazzotta,
It has come to the Building Department's attention that the Building Permit issued on May 18,2026
for Building Permit number B-26-355,was issued to a use and scope of work that appears to have
considerably changed.Accordingly, and including for the reasons set forth herein,Building Permit
number B-26-255 is hereby revoked. This Building Permit was issued based upon an application and
plan review for a tenant interior fit-out of an existing tenant suite,Unit 2120,located in Building 2 of
Shetland Park.
The initial scope of work submitted and reviewed in the application documents identified a project
of the following caliber:
Work Description: "The project consists of the tenant interior build-out of an existing suite for
use by an IT Services Company, including installation of equipment and associated
mechanical, electrical, and plumbing systems.Interior work includes renovation of office and
staff areas,including offices,restroom, security,and kitchenette.Exterior work includes
installation of a generator and rooftop mechanical equipment."
In addition to the initial submitted Work Description, the submitted Construction Documents dated
March 16'b,2026 identified the following project scope highlights:
• An interior tenant fit-out for a tenant suite 8,691 square feet in total size, where 1,861 square
feet is dedicated to the IT digital infrastructure(ie."Racks")floor area.
• The Floor Plan identified 4,645 square feet of"Future Tenant Space"that is located within the
tenant suite but was not included under the proposed fit-out scope of work.
• The existing accessible parking spaces and ramp leading up to the existing"Common
Vestibule"found on plan north was to remain as is and was identified as being outside the
Limit of Work.

• The(1)proposed generator was identified to be placed on an existing concrete pad housing
existing mechanical equipment for other tenant suites located in the same building.
• The(1)proposed generator was identified to be capable of producing 1,000 Kilowatts of
power supply to the IT Services Company.
• No major alterations were proposed for the basement nor to the structure of the first floor
assembly.
After the Building Permit's issuance on May 181,2026,the Site Superintendent contacted the
Building Department to request an on-site Pre-Construction Walk-Through meeting to introduce the
project to the Building Inspectors. The Pre-Construction Walk-Through meeting was held June 231,
2026 at 9:30 am.During the meeting, the Site Superintendent informed the Building Inspectors that
the project will be for an Artificial Intelligence Data Center company and will have some
modifications from what was initially approved with the issuance of the Building Permit. He
confirmed a revised version of the Construction Documents would be submitted under the initial
Building Permit application for review.
The revised Construction Documents dated April 271,2026,prior to issuance of the Building Permit,
were submitted on June 291,2026 and identify the following project scope changes:
• The interior tenant fit-out for the tenant suite increased to 12,690 square feet in total size,
where 4,014 square feet is dedicated to the IT digital infrastructure(ie."Racks")floor area.
• The area identified on the original Floor Plan as being 4,645 square feet of"Future Tenant
Space"is now included in the proposed fit-out project, and that space is programmed as a
larger"Racks"room and a"Pump Room".
• The existing accessible parking spaces and ramp leading up to the existing"Common
Vestibule"found on plan north is now proposed to be demolished and rebuilt shifted plan
west, which could encroach upon any required turning radii for vehicles using the loading
ramp leading down into the building's basement.Note:No information was provided on this
potential issue in the revised Construction Documents.
• The(1)proposed generator that was identified to be placed on an existing concrete pad has
changed to become(2)proposed generators ihat are much larger in size.Due to the increased
footprint of the equipment, the existing concrete pad is also proposed to be expanded, thus
requiring the rebuilding of the adjacent accessible parking spaces and ramp.
• An additional(1)proposed generator is now identified to be placed on the plan south side of
the building in a location that does not currently have an equipment pad. This additional(1)
proposed generator is also large in size.
• The(3)proposed generators in total are identified to be capable of producing 6-Megawatts of
power supply to the IT Services Company.
• There are now(2)new proposed 3,000 gallon Chilled Water Thermal Energy Storage Tanks to
be located in the basement of the building, and many structural steel beam, column and
footing modifications to the existing first floor assembly to support the increased weight of the
expanded IT digital infrastructure(ie."Racks")floor area.

These changes, as found on the revised Construction Documents, are considered significant as
compared to the initially permitted scope of work and would typically require the submission of a new
Building Permit application to capture the"new"version of a project from an"older"proposed
version. The new Building Permit application could then undergo a new plan review to ensure the
submitted changes are compliant with the 2021 780 CMR Building Code.
That said,in addition to the reasons detailed above, the Building Permit is being revoked because the
project as now proposed is a data center use which is not a permitted use of the property in the
Industrial or Waterfront Industrial Overlay District under the City's Zoning Ordinance. Section 3.1 of
the City's Zoning Ordinance provides that"except as provided by law or in this Ordinance in each
district,no building or structure shall be constructed, used or occupied, nor shall land be used or
occupied, except for the purposes permitted as set forth in the accompanying Table of Principal and
Accessory Use Regulations.". As originally permitted, the proposed"IT Services Company",was
considered a"Business or Professional Office"use, which is an allowed use of the Property. A data
center, however, is different type of use, with different resource demands and impacts, and is not a
permitted use of the Property. This Building Permit would not have been issued if the original
permitting documents had accurately shown the now proposed use.
It is because of these newly identified Building Code issues and Zoning Ordinance violation that the
Building Permit issued on May 181,2026,under Building Permit application B-26-355,is revoked.
Under the provisions,of 780 CMR Section 105.6:Permits-Suspension or Revocation,it is my opinion
the Building Permit was issued on the basis of incorrect, inaccurate, and incomplete information that
did not accurately reflect the proposed project. As of July 1st,2026,no construction work on this
project shall begin under Building Permit B-26-355.
If you have any questions regarding the information contained in this letter, please contact the
Building Department at(978) 619-5641.
If you feel you are aggrieved by this order, your appeal is to the Building Code Appeals Board in
Boston and to the Zoning Board of Appeals in the City of Salem.
Respectfully,
Gail Kubik
Local Building Inspector
