To whom it may concern:
On behalf of The Newark Group, Inc., Ramboll Americas Engineering Solutions, Inc. (Ramboll) has
prepared this letter to notify you, in accordance with 310 CMR 40.1074(1)(d) of the Massachusetts
Contingency Plan (MCP), of the filing of a Notice of Activity and Use Limitation (AUL) for the property
located at 53 Jefferson Ave, Salem, MA (the Site). You are receiving this notification as a local official in
the community in which the property subject to the AUL is located.
Investigations at the Site have identified impacts to soil of oil and/or hazardous materials (OHM), as
defined in the MCP. Investigations by Ramboll indicate that the impacts to soil most likely resulted from
fill materials that were placed at the Site prior to development in the early 1900s. Due to the impacted
soil, an AUL is required to maintain a condition of No Significant Risk, as defined in the MCP, for future
Site uses. Allowed activities and uses, disallowed activities and uses, and obligations/conditions are
specified in the AUL. Specifically, attached to this letter are final copies of the following documents that
have been filed as components of the ALL and which outline all pertinent information about the Site.
- Form IL075: This form is the primary instrument of the AUL that describes the area affected, the
parties involved, and the future uses of the Site that are and are not consistent with maintaining a
condition of No Significant Risk.
- Exhibit B: A sketch plan depicting the area subject to the AUL.
- Exhibit C: Narrative Description of the Site, history, and the AUL
