You have requested my opinion whether or not the above lot
of land containing 12, 075 square feet of land should be afforded
the protection of the first sentence of the fourth paragraph of
GLc40A §6 set out as Section VIII (B) ( 1 ) in the City of Salem
Zoning Ordinance .
It appears that the lot in question conforms to all the re-
quirements of the existing zoning ordinance with the exception
of the area requirement. An examination of the records at the
Registry of Deeds indicates that the most recent instrument of
record (deed dated and recorded Jan. 15 , 1965 ) prior to August
27 , 1965 (effective date of the zoning ordinance ) indicates the
lot was separately owned. Further examination indicates that when
the lot was conveyed after August 27 , 1965 (deed dated Dec. 2 ,
1986 and recorded Dec. 29 , 1986 ) it has retained it' s separate
identity.
Accordingly, in my opinion, the parcel s-hou°ld"be=af_forded
the benefit of the "grandfather" provision of GLc40A §6 as enum-

I am in receipt of documentation from Attorney Ledoux „ ,
relative to the legality of certain buildable lots on Frederickg--
Street.
I have reviewed the documentation and it is my opinion that
the lots 25 through 29 on the plan provided me have merged and are
buildable. Since there is over 5, 000 square feet and over 50 feet
of frontage, this collective lot is grandfathered under the
statute.
This opinion does not exempt the owner from complying with
all other necessary requirements.
