Dear Mr. Ferris:
You are hereby notified in your capacity both as individual
owner and as a trustee of the Ferris Trust, that the business
which you operate at 18 Franklin Street is illegally occupying
adjacent land owned by the City of Salem and the City of Salem
Park and Recreation Commission.
A recent survey indicates that you have encroached into an
area of approximately 27, 000 square feet of publicly owned land.
The business which you operate at 18 Franklin Street is using this
public land for the storage of disabled automobiles and parts.
Accordingly, you are hereby notified to remove immediately all
such items from this property and restore the land to its former
state. The City of Salem will hold you responsible for any and
all damage to this land including any expenses necessary for
hazardous waste clean up.
If immediate action is not taken by you in this regard, the
City of Salem shall commence legal action and shall seek all
appropriate damages. You or your attorney should contact this
office with any questions you may have.

Dear Mr. Tremblay:
As we discussed on December 5, 1995, this firm represents
Edward Ferris, the owner of 18 Franklin Street, Salem,
Massachusetts, in his application pursuant to M.G.L. Chapter 91.
As part of his application, Mr. Ferris is required by the
Massachusetts Department of Environmental Protection to obtain a
statement from a municipal clerk or official confirming that the
subject property is not in violation of the applicable local
zoning ordinances.
Back in May of 1993, Mr. Ferris, or his agent, provided your
office with a Schedule D to Mr. Ferris's Chapter 91 application.
In executing that Schedule D, you indicated that the City of
Salem disputed the legality of the present use of the premises (a
copy of the completed form is attached) . This statement has
caused a problem with the DEP as they have interpreted it to mean
that the present use of the subject property is in violation of
the applicable zoning regulations, despite the fact that, as we
discussed, the use of the subject property is a legal, non-
conforming use.
Accordingly, I ask that you revise the previous Schedule D
by stating that Mr. Ferris' use of the property located at 18
Franklin Street, while not in conformance with the current zoning
ordinance, is a legal, non-conforming use which is
"grandfathered" under M.G.L. Chapter 40A, §6. I enclose a check
payable to the City of Salem in the amount of $30. 00 for
processing, along with a self addressed stamped envelope for the
return of the enclosed Schedule D upon your completion of same.

The Waterways Regulation Program (WRP) has received your
application under the waterways amnesty program requesting
authorization to license certain activities in state waterways
pursuant to M:G.L. Chapter 91, Waterways , Licensing. The WRP has
assigned the filing with the referenced application number. IT ,
IS IMPERATIVE THAT YOU REFER TO THIS APPLICATION NUMBER WHENEVER
YOU SUBMIT OR REQUEST INFORMATION FOR THIS FILE . Upon review •.of
the application, the WRP has classified this project as a
Nonwater-dependent Use Proiect , that is a use which does not
require direct access to, or location in, tidal or marine waters .
After review of the application, the Department has determined
that it does not meet the minimum submittal requirements and you
will need to provide the following information before we can
process the application further. The information you must submit
is :
(1) Revised FORM D (copy enclosed) clearly indicating
whether the use (s) of the site for which you seek
authorization is allowed by local zoning. Clarification
is needed because the present FORM D appears to
indicate the use of the site for an auto service
operation is not allowed by zoning. Please note that
the Department can only approve uses and, structures on
the site which are allowed or grandfathered under local

Environmental Affairs . Please note that the amount of
filled tidelands on site for which a waterways license
is sought is greater than one acre . Any use of one
acre or more of filled tidelands for a nonwater-
dependent use categorically requires preparation of an
Environmental Impact Report .
If you obtain zoning and MEPA approval , project modifications
will need to be made to license this existing nonwater-dependent
use of filled tidelands . Ten foot wide public access walkways to
and along the waterfront combined with an appropriate level of
publicly accessible open space will need to be provided. This or
a comparable benefit to the public' s rights in tidelands should
be proposed pursuant to M.G.L. Chapter 91 § 18 to offset the
detriments to the public' s water-related rights which exist on
the site . In addition, any approvals required pursuant to M. G. L.
Chapter 21E and the Massachusetts Contingency Plan (MCP) must be
provided to the Waterways Regulation Program prior to issuance of
the c . 91 license .

Dear Mr . Kelley:
I am in receipt of your memo requesting that the Conservation
Commission research the files for past Order of Conditions and or
Certificates of Compliance for 14 and 18 Franklin Street ; Craig
Burnham and Edward Ferris respectively.
In investigating the files , the Conservation Administrator was
able to obtain a copy of an Order of Conditions regarding proposed
work located at 14 Franklin Street . The Order of Conditions which
was ascertained was to the applicant , Silent Ships, not to Mr .
Craig Burnham ( see enclosed Order of Conditions) .
On December 2 , 1980 , the Order of Conditions were amended to
the following:
1 ) . This Order of Conditions supersedes the Order of
Conditions issued May 22 , 1980 , File #64-66
2 ) . All work shall be done in accordance with plan. . .
3 ) . All work shall be completed prior to June 30, 1981
and shall be subject to an on-site inspection be the
Conservation Commission.
On June 24, 1982, the applicant came before the Commission
stating that Special Condition 2 and 3 have been completed to the
Commissions ' satisfaction but they needed a letter stating that
fact . In addition, the applicant was seeking an extension permit
for one year to obtain the necessary permits from state and federal
governments . Once all the permits were in place the work could be
completed within one year .
Although there is an Order of Conditions for 14 Franklin
Street to applicant Silent Ships , t:here is no Certificate of
Compliance.

The person seeking this Chapter 91 Amnesty License is not
Silent Ships but recent proprietor Craig Burnham, 14 Franklin
Street .
The second address, 18 Franklin Street has never received
either an Order of Conditions, thus no Certificate of Compliance
was issued.
The Conservation Commissions ' records indicate that in August
of 1985 Mr . Ferris filed for a Request for a Determination of
Applicability. In September 1985, the Conservation Commission
issued a positive determination indicating that a Notice of Intent
would have to be filed.
Mr . Ferris appealed this decision to, then, the Department of
Quality Engineering (DEQE) . The DEQE responded to Mr . Ferris '
appeal with a superseding Positive Determination stating that the
applicant would have to file a Notice of Intent with the Salem
Conservation Commission.
Mr . Ferris never filed a Notice of Intent nor did DEQE follow
up on this issue.
In summary, 14 Franklin Street received an Order of Conditions
under the applicant Silent Ships, not Mr . Craig Burnham, but no
Certificate of Compliance was ever issued .
Mr . Ferris of 18 Frankl-in Street never received an Order of
Conditions, thus no Certificate of Compliance was issued.

Enclosed please find a certified land survey by a Mr. Michael
D. Bovio, professional survey stamp # 34609 , of the property
located next to Franklin Street Park. There is currently 25 , 857
square feet of city owned park land that has been encroached upon
by Mr. Edward Ferris .
I would respectfully ask that you move on this issue
immediately to have Mr. Ferris cease and desist his activity on
this city owned park land. Once that has occurred the city can
determine what steps need to be taken to test the soil of this
land and to retrieve it back for the city.

The City of Salem hired a professional surveyor to
survey and stake out the land that it owns at 20 Franklin
Street . The survey shows that you are encroaching on City
owned property on the playground side of your lot by
25 , 857 square feet . This office is requesting that you
cease & desist illegal occupancy of City owned property at
once , and that you remove all vehicles and debris from
City owned property, and that you have the Department of
Environmental Protection give a clear release of said
property from your continued spillage of gas , oil and
grease from the storing of motor vehicles over the past
years .
Please notify this department within fifteen ( 15 )
days upon receipt of this letter, to inform us as to what
course of action you will take to rectify this situation .
Failure to do so will result in legal action being taken
against you .
Thank you in advance for your anticipated cooperation
in this matter.

Street . The survey shows that you are encroaching on City
owned property on the playground side of your lot by
25 , 857 square feet . This office is requesting that you
cease & desist illegal occupancy of City owned property at
once , and that you remove all vehicles and debris from
City owned property, and that you have the Department of
Environmental Protection give a clear release of said
property from your continued spillage of ' gas , oil and
grease from the storing of motor vehicles over the past
years .
Please notify this department within fifteen ( 15 )
days upon receipt of this letter , to inform us as to what
course of action you will take to rectify this situation .
Failure to do so will result in legal action being taken
against you .

Dear Mr . Ferris :
The City of Salem hired a professional surveyor to
survey and stake out the land that it owns at 20 Franklin
Street . The survey shows that you are encroaching on City
owned property on the playground side of your lot by
25 , 857 square feet . This office is requesting that you
cease & desist illegal occupancy of City owned property at
once , and that you remove all vehicles and debris from
City owned property, and that you have the Department of
Environmental Protection give a clear release of said
property from your continued spillage of gas , oil and
grease from the storing of motor vehicles over the past
years .
Please notify this department within fifteen ( 15 )
days upon receipt of this letter, to inform us as to what
course of action you will take to rectify this situation .
Failure to do so will result in legal action being taken
against you .
Thank you in advance for your anticipated cooperation
in this matter .

D . Bovio, professional survey stamp # 34609 , of the property
located next to Franklin Street Park . There is currently 25 , 857
square feet of city owned park land that has been encroached upon
by Mr. Edward Ferris .
I would respectfully ask that you move on this issue
immediately to have Mr . Ferris cease and desist his activity on
this city owned park land . Once that has occurred the city can
determine what steps need to be taken to test the soil of this
land and to retrieve it back for the city.
