Dear Sir;.
The trustees who own the land at 12 Franklin St. have
notified us that, on 4 April 1996, you ordered them to
stop using that land for industrial purposes.
Be advised that the East-erly side of that property
has, for decades, been so used (the Westerly half had a
multistory warehouse upon it and is not so "grandfathered" ) .
You are a new city employee and probably have little
knowlege of prior land uses, but you must not, without
research, issue illegal orders or make threats to people .
In the future, first ask owners if nonconforimg uses
are legal under SZO Atricle VIII Sac. 8 . 3 (1 ) & (2) . (3 ) is
invalid, since it violates MGL Ch. 40A. sec . 6 (para. 3) .
Since this property is next to property owned by us,
this Easterly side is handy for our uses and allows the
trustees to have an income from it.
I trust that you will not again intimidate these trustees
nor any others in the city with out cause.
You should .apologise to these good people for what
you have done.

To the best of our knowledge the structure was used in 1965 as a tannery and
would be permitted to continue, eas such under the zoning ordinance, however,
any subsequent change in use or occupancy is not permitted without approval.

Dear Ms. Limon,
I have answered the question regarding the "Grandfathering" of the building located at 13-15
Franklin Street. . "Grandfathering" of a building is not a process that a building owner comes in
and applies for. Mass. State Zoning Law , 40 A, clearly defines that an existing building remains
legal when new zoning is implemented. The owner of 13-15 Franklin street did not have to come
in and apply for anything to continue using the building commercially. As far as the quantity and
type of chemicals being used, that is not a function of the Building Department. Therefore ,I
would not be able to determine what quantities and types of chemicals were used in the past or
are being used today. The State D.E.P keeps records of"small quantity generators" and perhaps
you might want to make an inquiry with the D.E.P. The blocking of a street is never condoned by
the City. For questions relating to the blocking of the street I again refer you to the Salem police
Department, Traffic Division.
