As you know, there was a fire in the camping trailer parked in your Yard. You have knowingly allowed an individual to use the trailer as his residence. Fortunately, no one was hurt in this incident. Allowing someone to reside at your boatyard violates numerous building, health, plumbing and electrical codes. It is also a violation of the Salem Zoning Ordinance. On 11/16/2003 at about 7:28AM, I was notified by shift OIC. Lt. Lemelin of a trailer fire at Fred's Boat Yard on Franklin Street in Salem which the Fire Department was orde•ring, a cause and origin investigation. At about 7:47AM, same date, I arrived at the police department to retrieve equipment to assist in the investigation. At about 7:52AM, same date, I arrived at 10 Franklin Street in Salem, MA, the business of Fred's Boat yard. Upon a•rrivale there I was briefed by Salem Officer John Doyle, who was also maintaining the scene fo•r investigation. Salem Fire Lt. Clifford Lewis was also present and provided me with information concerning the incident. Lt. Lewis •related that firefighters arrived on scene to find the trailer involved in flames. The door was locked and had to be forced by firefighters to gain access. No one was inside the trailer. Two firefighters received minor electrical shocks while en•te•ring the! trailer attributed to current from an electrical extension cord that supplied electricity to the trailer from a wench house about 40 feet away. Two large snakes were in tanks inside the trailer and were alive. Several rats in cages did not survive the incident. Lt. Lewis advised me F. I. D. investiga•to•rs would be responding to investigate the fire. At this point I photographed the exterior of the trailer and the electrical cord at the wench house. Several observations were made at this time. The trailer door was observed to have the deadbolt in the locked position (photographed) ; there were numerous propane tanks at the front of the trailer to include ones attached to regulators leading inside the trailer; the trailer and the surrounding area were cluttered with debris, bicycle and other mechanical parts, trash, clothing, fu•r•nitu•r•e and personal items. A chair was smoldering and in two pieces. Lt. Lewis related the chair was found inside the traile•r•, to the left as you entered through the door•. F•/F Silva took additional photographs of the scene and of other items of evidence and investigation. Officer Doyle took possession of three prescription bottles in the name of Mark Dobrosielski. The trailer is a "Trave1master" and it was determined to be owned by Fred Kozlowski, the owner of the boat- yard. Because of the noted health, electrical and code violations observed by investigators, the Board of Health, City Electrician and Building Inspector's Office were notified and requested to respond. At about 9:07AM, City Electrician Mark Rochan arrived. At about 9:30AM Building Inspector Thomas St.Pier•re arrived and at about/ 9:45AM Health Inspector David Greenbaum arrived. Business owner Fred Kozlowski was summonsed to the scene. Mr. Kozlowski was interviewed (notes maintained by F/F Flynn) and related in part that Dobrosielski had been storing boats in his yard, having moved several of them onto his property. Kozlowski charged him $415 per month. At some point Kozlowski allowed Dobrosielski to use a trailer he (Kozlowski) owned in the boat yard as along as he didn' t cause any trouble or use buckets to go the the bathroom. Kozlowski related he has told Dobrosielski he had to leave the property and has had him served with No Trespass orders from the Salem Police but he (Kozlowski) is in fear of Dobrosielski. Note here that this detective was unable to locate and trespass order against Dobrosielski for that address. Kozlowski further related he knew Dobrosielski was using the stove to heat the trailer (gas stove) as the electric heater did not work. He also said that he usually shuts off any electrical power going out to the yard from inside his building to prevent people from using his electricity. He did state that he was last at his yard on Thursday (11/13/2003) but left the circuit to the yard on. A radio broadcast was made for an attempt to locate Dobrosielski. Officer Bedard was sent to his last master name address of 10 Porter. Street in Salem and advised no one at that address had ever heard of him. Dobrosielsk.i' s 10 Franklin Street, Salem address was confirmed by the Salem Police Department Sex Offender Registry showing him living there as well as mail addressed to him there, post marked on Novemeber 91 2003. ( /I Flynn was of tae opinion- the fire started in the area of the gas stove inside the trailer. There is the possibility the fire was accidental or -unintentional, caused by- the gas stove being left on. One knob on the stove indicated it was in an open position. No final determination has been made as to the cause and origin. At the time of this report Dobrosielski has not been located for an interview. A roll call police info has been posted requesting he be located. The investigation remains open and ongoing. On November 18, 2003 I was in contact with Investigator Flynn concerning the status. He advised me Mr. Dobrosielski had been located on 11/17/2003 as part of the follow-up investigation and interviewed as to the 'Fire. Investigator Flynn related Dobrosielski gave a statement that, in part, cooberated Koxlowski' s account as to the condition of the t'railer' s heating system. Dobrosielski further stated he left- the trailer in the late afternoon the day before the incident and left the stove on for heat for his animals. Investigator Flynn further related he was of the opinion the cause of the faire was accident and unintentional and the origin being heat and ignition source of the gas stove.
