In May of 2011 ,you were issued a City Ordinance Ticket ,# 1188, which remains unpaid ,for failure to correct the dumpster issue. Enclosed, you will find a citation for $150 for the second offense of Ordinance 24-23. You are further directed to contact this office to address your compliance with City Ordinance. This issue has been the subject of previous letters as late as July of 2009. To date, you have not appealed the zoning violation to the Zoning Board of Appeals,nor have you addressed the car issue. This means that the zoning violation exists. Zoning violations carry a maximum penalty of $1,000 per day The area in question(R-2 Zoning) was an overgrown field that was not used for businesses in the front of the building. Workmen,employed by you,cleared the area and slowly over the last six or seven years has been used increasingly by your tenants.As pointed out in previous letters, expanding a non-conforming use requires a Special Permit from the Zoning Board. The unregistered vehicles as mentioned in all the previous letters, constitute a violation of City Ordinance 24-21. This Department will begin to fine these vehicles 15 days from the date of this notice.. Each vehicle will be ticketed with each day constituting a new violation. Enclosed is a City Ordinance ticket for the zoning violation. These tickets are $50 for the first offense,$150 for the second and $300 for each subsequent offense.. The dumpster,located out back, violates City Ordinance 24-23 No permits have been issued for this dumpster . This dumpster is also in the area that is in question for the zoning violation.You are directed to remove.the dumpster immediately. The City Ordinance tickets can be appealed in District Court. The Zoning Violation, or my interpretation of the Zoning , can only be appealed at the Zoning Board of Appeals. Paint and seal all masonry walls with a quality masonry paint. 2. Paint all ceilings and existing wooden walls with a flat latex paint. 3. Construct non-weight bearing partitions as depicted in the attached floorplan, using 5/8" fire code sheetrock (blue/green board in bathrooms), with insulation to provide the 1 hour burn through critieria required by code. Enclose the existing stairwell in the southeast corner by building a floor flush with existing floor. 4. Run electrical circuits using conduit pipe for wiring running along open walls and standard insulated cable for wiring located in the new partitions.
