This Department previously(March 09,2011) issued a letter regarding the dumpster location and
lack of a dumpster pen-nit (City Ordiance 24-23) for your property located at 9 Franklin
Street in Salem. In May of 2011 ,you were issued a City Ordinance Ticket ,# 1188, which
remains unpaid ,for failure to correct the dumpster issue. Enclosed, you will find a citation for
$150 for the second offense of Ordinance 24-23. You are further directed to contact this office to
address your compliance with City Ordinance. Failure to address this issue will result in
additional tickets of$300 per day. Failure to pay the tickets will result in a complaint being filed
in Salem District Court. Please contact me directly to address this issue.

Dear Owners,
This Department has received and investigated a complaint regarding a dumpster and once
again the number of registered and unregistered vehicles to the rear of 9 Franklin Street. This
issue has been the subject of previous letters as late as July of 2009. To date, you have not
appealed the zoning violation to the Zoning Board of Appeals,nor have you addressed the car
issue. This means that the zoning violation exists. Zoning violations carry a maximum penalty of
$1,000 per day The area in question(R-2 Zoning) was an overgrown field that was not used for
businesses in the front of the building. Workmen,employed by you,cleared the area and slowly
over the last six or seven years has been used increasingly by your tenants.As pointed out in
previous letters, expanding a non-conforming use requires a Special Permit from the Zoning
Board. The unregistered vehicles as mentioned in all the previous letters, constitute a violation of
City Ordinance 24-21. This Department will begin to fine these vehicles 15 days from the date of
this notice.. Each vehicle will be ticketed with each day constituting a new violation. Enclosed is
a City Ordinance ticket for the zoning violation. These tickets are $50 for the first offense,$150
for the second and $300 for each subsequent offense..
The dumpster,located out back, violates City Ordinance 24-23 No permits
have been issued for this dumpster . This dumpster is also in the area that is in question for the
zoning violation.You are directed to remove.the dumpster immediately.
The City Ordinance tickets can be appealed in District Court. The Zoning Violation, or my
interpretation of the Zoning , can only be appealed at the Zoning Board of Appeals.

A hearing on this petition was held August 11, 1993 with the following
Board Members present: Stephen Touchette, Acting Chairman; Edward
Luzinski, Stephen O'Grady and Associate Member Arthur Labrecque. Notice of
the hearing was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner is requesting a Special Permit to allow portion of the existing
building to be used for auto repair and for a variance from Article VII,
Section 7.2, Supplementary Regulations Automobile Service Station regarding
density regulations which may be applicable to this request. Property is
located in a mixed zone (B-1/R-2)
The provision of the Salem Zoning Ordinance which is applicable to this
request for a Special Permit is section 5-3(j ) , which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the
Board of Appeal may, in accordance with the procedure and conditions set
forth in Section 8-6 and 9-4, grant Special Permits for alterations and
reconstruction of nonconforming structures, and for changes, enlargement,
extension or expansion of nonconforming lots, land, structures, and uses,
provided, however, that such change, extension, enlargement or expansion
shall not be substantially more detrimental than the existing nonconforming
use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit
requests, guided by the rule that a Special Permit request may be granted
upon a finding by the Board that the grant of the Special Permit will
promote the public health, safety, convenience and welfare of the City's
inhabitants.
The Variances which have been requested may be granted upon a finding of
the Board that:
A. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other lands, buildings or structures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.

C. Desirable relief may be granted without substantial detriment to the

The Board of Appeal, after careful consideration of the evidence presented,
and after viewing the plans, makes the following findings of fact:
1. The building has been used for commercial purposes for many years.
2. The building has been vacant for two ( 2) or three (3) years.
3. There are other automotive related business in the area. _;' cu
4. There was opposition to the petition on the basis that it is
inconsistent with the City's Master Plan for the area.
5 . The building is located in a B-1/R-1 zone and automotive repaia: sh:Eos

b. There are other structures on the property and ample parking.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject property
but not the district in general.
2. Literal enforcement of the provisions of the Ordinance would involve
substantial hardship on the petitioner.
3. The relief requested can be granted without substantial detriment to
the public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the ordinance.
4. The Special Permit granted can be granted in harmony with the
neighborhood and will promote the public health, safety, convenience and
welfare of the city's inhabitants.
Therefore, the Zoning Board of Appeal voted unanimously, 4-0, to grant the
relief requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statutes, codes
ordinances and regulations.
2. All construction shall be done per the plans and dimensions submitted.
3. Petitioner shall obtain a legal building permit for ail work done.
4 . All requirements of the Salem Fire Dept, relative to smoke and fire
safety shall be strictly adhered to.

Dear Mr. Tremblay:
Enclosed, in response to your request for approval of an engineer regarding the ventilation system
for the proposed renovations at 11 Franklin Street, Salem, MA., is a letter from an engineer(with official
stamp) indicating that the minimum ventilation provided by the heating/air circulation system alone is
sufficient for an occupancy of 30 persons. Again, the engineer based his calculations on the new
heating/air circulation system specified by the landlord and his contractor(s) and does not account for the
ventilation fans that SHODOKAN has planned for in its drawings previously submitted to your office.
We estimate that the ventilation fans, once installed, will raise the outside ventilation air to 460-500 cfm,
which would allow sufficient ventilation for an additional 3-5 persons.
Since the operational hours for the 11 Franklin Street address will provide for several hours (4-6)
during the day and at least 10 hours every night where the facility is not being used, we believe that the
ventilation is sufficient for our proposed purposes.
SHODOKAN has reviewed its attendance records to determine that the intended operation will
not require more than the estimated 460-500 cfm provided by the heating/air circulation system plus the
ventilation fans. The attendance averages for the last six months are as follows:

Even with expansion of programs planned for the new facility, there will be no conflict with the

After an investigation, I concur with your design that 400 cfm of
outside ventilation air is sufficient.
This is based on a total building occupancy of 30 persons. The
usage of the subject spaces is karate, which is similar to any
activity on a gymnasium floor whereas the players start and stop
exercising, running, etc.
The Boca National Mechanical Code 1993 Chapter 16, Ventilation
Air, Table M-1604. 3 requires 20 cfm per person on a gymnasium
playing floor.
My client has informed me that not all 30 persons will be in
class simultaneously; therefore, I assumed two-thirds of the
total persons, or 20 persons, will be in class at one time. The
outside air requirement is then 20 persons at 20 cfm per person,
or 400 cfm.

SHODOKAN, Inc. is applying for a building permit for renovations to a newly leased space for
its operations located at 11 Franklin St., Salem. We noted that as part of the permit application a form
requesting Workmen's Compensation Insurance be in effect for employees. We are asking for a waiver
of this requirement for the following reasons:
1. Like Habitat For Humanity, SHODOKAN is a not-for-profit organization that will be
using an all volunteer labor force for the planned renovations and move to the new
location;
2. Also, like Habitat For Humanity's volunteer labor force, volunteers are informed that
they will be required to cover any injuries or medical issues arising from their
volunteerism through their own insurance or expense;
3. SHODOKAN,Inc. is currently covered by an insurance policy for liability in the amount
of$500,000 per incident, $1,000,000 aggregate, as required by our lease agreement;
4. Our insurance broker has assured us that the insurance policy covers our renovation and
moving process;
5. As a not-for-profit corporation formed under M.G.L. 180, we are exempt from most
major liabilities and subject to limits of other liabilities by statute for any and all activity
that is undertaken to effect our overall mission, including renovating facilities (see
M.G.L. 231 et seq.).

DESCRIPTION OF WORK TO BE DONE AT 11 FRANKLIN STREET, SALEM, MA
1. Paint and seal all masonry walls with a quality masonry paint.
2. Paint all ceilings and existing wooden walls with a flat latex paint.
3. Construct non-weight bearing partitions as depicted in the attached floorplan, using 5/8"
fire code sheetrock (blue/green board in bathrooms), with insulation to provide the 1
hour burn through critieria required by code. Enclose the existing stairwell in the
southeast corner by building a floor flush with existing floor.
4. Run electrical circuits using conduit pipe for wiring running along open walls and
standard insulated cable for wiring located in the new partitions. All receptacles will be
grounded three-prong outlets, with GFI circuits running in the bathrooms/dressing rooms,
as well as along the exterior walls of same. Flourescent and incandescent lighting will
be run as depcited by the enclosed electrical floor plan. Halogen lighting will be run to
the outside for external stairways and decking.
5. Install two handicap accessible toilets and lavatories in the dressing rooms as so indicated
on the enclosed floor plans. Waste water pipes will be set up for future installation of
showers at a later date.
6. Finish and paint all new walls with a flat latex paint.
7. Install 3 steel external doors as indicated by attached floor plans.
9. Build a deck with stairs and handicap access ramp at main entrance as inidcated by
attached floor plans.
10. Remove decrepid cinder block structure at the external northeast corner of the building
and build an access stair as an emergency exit only.
11. Install hardwired burgular alarm system, smoke detectors, carbon monoxide detectors,
and emergency lighting system.
12. Relocate existing basement stairwell to the rear of the premises as indicated by attached
floor plans.
13. Install ventilation fans as indicated on the attached floor plans.

2, Upon inspection it has been determined that an old boiler and
fuel oil burner (Delco Unit) were located on the premises,
no peru:it on file for same, This unit is apparently being
d.i.sconti.nued . If so, it shall be disconnected and this office {
notified , to remove this complaint. All piping shall be removed
and outlets capped. t
3. Upon inspection i.t has been determined that a. new boiler and )
fuel. oil burner has been installed without first obtaini.n- a
permit for said installation. This is in violation of' FPR Y3,
Rule '/8, You shall notify this office in writing of the name
and address o` the installer of said new 'Na.yne Unit, and the
date of said installation. A hermit shall be requ red- for same.
Failure to provide the above information shall be cause for

for said construction shall be approved by this office and
a permit obtained from the Building Inspector and the Electrical
Inspector for said construction. Upon completion a n_ ermi.t for
the storage of the Class A product will be issued, Failure
to complete said storage area within the sixty days allowed by
this order will be cause for legal action to be initiated.
7. It has been determined that insufficient first aid fire appli-
ances (Fire Extinguishers) exist at this location. Tt is
hereby ordered that one 104 Tri-Class ABC fire extinguisher be
placed at or within ten feet of each egress, including the office
area.
