377 ESSEX STREET UNIT B REMAINING VIOLATIONS LETTER 4-28-2026 1. CITY OF SALEM, MASSACHUSE TTS BOARD OF HEALTH 98 WASHINGTON STREET,3R'FLOOR TEL. (978) 741-1800 PrsvenL Promote.Protect. DOMINICK PANGALLO h99th 7salem com MAYOR DAVID GREENBAUM,RS HEALTH AGENT April 30, 2026 Deegan Partners, LLC 62 Marmion Way Rockport, MA 01966 Dear Sir/Madam: In accordance with Chapter II of the State Sanitary Code, 105 CMR 410.000, Minimum Standards of Fitness for Human Habitation, a recent re-inspection was conducted of your property located at 377 Essex Street Unit B, conducted by Jeffrey Barosy, Sanitarian of the Salem Board of Health on April 15, 2026. At that time the following items were still outstanding: Hallway-Common: The property owners blocked the common hallway vents with their built in self- closing mechanisms along with aluminum foil and rubber seals. The inspector consulted with the Regional Trainer for Housing, the City of Salem's Plumbing Inspector, and the City of Salem's Fire Department about the property owners' methods. The inspector received feedback from the Regional Trainer for Housing and the City of Salem's Plumbing Inspector. The following was shared: o Despite the efforts made by the property owners, the heat from the furnace will still be pulled into the ducts leading into the common hallway. o There is a possibility that the aluminum foil and rubber seals on the vents in the common hallway may create a fire hazard. The inspector is still awaiting feedback from the City of Salem's Fire Department. o According to the City of Salem's Plumbing Inspector, another solution would be to remove the duct leading to the common hallway and cap it. Please be aware, with a written letting agreement, agreed to and signed by the occupant, that states the occupant would be responsible for paying to heat common areas, the property owners would be in compliance with the 105 CMR 410.000. Please find another solution(s)to correct the gas cross-metering and report the solution(s) back to the inspector within seven days of receipt of this letter. All other violations noted in the inspection report of March 31, 2026, have been corrected. Thank you for your cooperation in this matter.
