Obligations and Conditions. The following obligations and/or conditions are necessary and shall be undertaken and/or maintained at the Portion of the Property to maintain a Permanent Solution and a condition of No Significant Risk: (i) The removal of soil from the Property must be conducted under the oversight of a Licensed Site Professional; (ii) Utility-related Abatement Measures implemented in accordance with 310 CMR 40.0460 must be overseen by a Licensed Site Professional; (iii) Release Abatement Measures implemented in accordance with 310 CMR 40.0440 must be overseen by a Licensed Site Professional; (iv) Repair and/or replace, bituminous concrete pavement or concrete floor slab, with a similar impermeable surface, within 15 days of the completion of any activity which involves the removal or disturbance of existing bituminous pavement or concrete; (v) A Soil Management Plan must be prepared and implemented prior to the commencement of any activity(except emergence utility work)which is likely to disturb subsurface soil within the AUL AREA subject to this Notice.The Soil Management Plan must be prepared by a Licensed Site 4 Professional in accordance with the provisions of the MCP (310 CMR 40.000) and should describe appropriate soil management, characterization, storage, transport and/or disposal procedures. The implementation of the Soil Management Plan is to be under the supervision of a Licensed Site Professional. The Soil Management Plan must include a description of the dust control and other engineering controls, as appropriate, to limit exposure of workers to contaminated soil via dermal, contact,inhalation and/or ingestion; (vi) A Health and Safety Plan must be prepared by a Certified Industrial Hygienist or other qualified individual sufficiently trained in worker health and safety requirements pursuant to 310 CMR 40.0018 and CFR 1910.120, as appropriate, and implemented prior to the commencement of any activity (except emergence utility work) which involves the removal, disturbance, and/or direct contact with subsurface soil within the AUL AREA.The Health and Safety Plan should clearly describe the location of the soil containing site contaminants and specifically identify the types of personal protective equipment, monitoring devices and engineering controls to ensure that workers are not exposed to impacted soil without appropriate safeguards; and, (vii) The Owner shall be responsible for inspecting and documenting the integrity of the asphalt pavement,concrete pavement and concrete floor slabs annually.Inspection reports shall be maintained by the Owner until such time that this Notice is terminated. 4. Proposed Changes in Activities and Uses. Any proposed changes in activities and uses at the Portion of the Property which may result in higher levels of exposure to oil and/or hazardous material than currently exist shall be evaluated by a Licensed Site Professional who shall render an Opinion, in accordance with 310 CMR 40.1080,as to whether the proposed changes are inconsistent with maintaining a Permanent Solution and a condition of No Significant Risk. Any and all requirements set forth in the Opinion to meet the objective of this Notice shall be satisfied before any such activity or use is commenced. 5. Violation of a Permanent or Temporary Solution. The activities, uses and/or exposures upon which this Notice is based shall not change at any time to cause a significant risk of harm to health, safety,public welfare,or the environment or to create substantial hazards due to exposure to oil and/or hazardous material without the prior evaluation by a Licensed Site Professional in accordance with 310 CMR 40.1080,and without additional response actions, if necessary, to maintain a condition of No Significant Risk. 5 If the activities, uses, and/or exposures upon which this Notice is based change without the prior evaluation and additional response actions determined to be necessary by a Licensed Site Professional in accordance with 310 CMR 40.1080,the owner or operator of the Portion of the Property subject to this Notice at the time that the activities, uses and/or exposures change,shall comply with the requirements set forth in 310 CMR 40.0020. 6. " Releases of metals igpiuding;arsenic,lead and chromium occurred from the former tanner 'operation.'The-shallow soil was reworked during the demolition of the former buildings and.. = ' construction of the existing building..There is evidence that elevated metal concentrations exist fiom beneath the one foot thick asphalt and processed gravel road base to 12 feet below grade over1he entire developed portion ofthe Property.The•rema!mng portion of the Property.is mostly bedrock and'has never been developed. Petroleum•hydrocarbons were also•.released from the former service station located on the corner of Pope Street and Boston Street and froni.the tannery•operations at the corner of Boston Street and Proctor Street.L•ow grade residual petroleum hydrocarbon contamination persists in site.soil,but they are not the risk drivers. The releases minimally impact ground water.There are no surface water features.on site..Low grade . concentrations of C5=C8 aliphatic hydrocarbons have been detected beneath the-floor slab at concentrations well below the Commercial Sub-slab Screening Values.C5-C8 Aliphatic hydrocarbons have also been detected m indoor-air but significantly below the Commercial Threshold Value'. , Risk Characterization Process and Reasons for an AUL The conclusion of the 2026 Method 3 Risk Characterization presented in the PSw.0 report was that a•Condition of No Significant Risk"(NSR)did not exist on the developed Portion-of the Property.(AUL AREA).due,to potential future exposure to-contaminants in soil.The report concluded that no current exposure pathways existed and that an AUL would be required to prohibit direct contact with soil during future site uses. A Method 3 Risk Characterization was presented in the'PSwC.The building is currently vacant but was used as retail space between 2000 and 2025.Future use of the Property could include redevelopment-for industrial;commercial,office,_and retail uses and/or residential uses which. have centralized management through a trust,an unincorporated association,management company,condominium association or similar group,and activities associated therewith, including;but'not limited to,pedestrian and/or vehicular traffic and parking for any purposes (e.g.commercials,industrial,or residential),landscaping and routine maintenance of landscaped areas where the commercial,office,retail uses and/or residential uses are consistent with the provisions.of the AUL. The reason for this AUL is to control future access to the soil between.I and 12 feet below grade in the AUL AREA. 1. .Activities and Uses Consistent with Maintaining No Significant Risk Conditions. :The following Activities and Uses are consistent with maintaining a Permanent Solution and a. Condition of No Significant Risk and,as such,may occur on the Portion of the Property pursuant t6.3:10-CMR 40.0000: (i) Commercial and-industrial uses and activities that do not involve the destruction• and/or altering of the bituminous concrete pavement'and/or concrete floor slabs and/or' the.direct contact with,disturbance of,or relocation.of subsurface soil within.the AUL - - 'AREA,except as described herein;• (ii)- Ancillary activities including, but•not limited to, pedestrian and/or vehicular traffic ..and parking for any purposes, landscaping and routine maintenance of landscaped areas and equipment storage-where the industrial and commercial uses-are consistent with the provisions of Paragraphs 2 and 3 below;. (iii) Excavation.associated with underground utility and/or construction which is likely to . disturb impacted soil below the.asphalt pavement and/or concrete floor slab provided r .that(a)it is conducted in accordance with a Soil Management Plan and-a Health and Safety Plan prepared and•implemented prior to the commencement of such activity in accordance with the Obligations.and Conditions of Paragraph 3 of this Notice; (iv) Emergency repair of and/or maintenance of existing underground utilities provided soil is placed and backfilled in the original excavation and the work area is restored to• pre-existing conditions within•15 days of the completion of the project. Should- excavated soil within the AUL AREA require management off-site, it must be done in accordance with the Obligations and Conditions of Paragraph 3 of this Notice; (v) Utility work or construction conducted in accordance with 3.10' CMR 40.0460 - - Utility-related' Abatement Measures subject to the provisions listed below in Paragraphs 2 and 3; (vi) Subsurface excavation conducted in accordance with 310 CMR 40.0440 Release Abatement Measures subject to-the provisions listed below in Paragraphs 2.and 3; (vii)' Such other activities or-uses which, in the Opinion of'a Licensed Site Professional, shall present 'no greater risk of harm to health, •safety, public 'welfare.or the. environmebt-than the activities and uses set forth in this Paragraph 1;and. (viii)- Such other activities and uses not identified in Paragraph 2 below as being Activities. and Uses Inconsistent with maintaining-No Significant Risk Conditions: 2. 'Activities,and Uses Inconsistent with Maintaining No Significant Risk Conditions. The following Activities and Uses'are inconsistent with maintaining a Permanent Solution and a Condition of No'Significant Risk pursuant to 310 CMR 40.0000,and,as such,may not occur on the.Portion of the Property: (i) . •The use'of the Property for unrestricted residential uses,such as single family homes . or apartments.which do:not have centralized management through a-management ' company;, condominium•'association or- similar group, where the •individual - homeowners of occupants are responsible for upholding restrictions and conditions in' this Notice; - (ii) Use of the Property for agricultural purposes,where existing soil is used for growing fruits or vegetables intended for consumption for gardening, playground, daycare, school,nursery,recreational area such as a park or athletic.field,and/or residence;and. •(i i) '.Any activity including, but not-limited to, excavation or utility installation and/or repair which is likely to result in direct contact with,disturbance.or,and/or relocation of soil between 1 and 12 feet below grade'in the AUL AREA described in Exhibit A- 1,unless under the supervision of a Licensed Site Professional who has reviewed the disposal site file for RTN'3-13814 arid.who renders'an Opinion which states that such 'activity.poses no greater .risk-of harm to health, safety, public welfare or'the environment and ensures the condition of"No Significant Risk" is maintained in . aeeordance.with'applicable regulations and policies that maybe in effect. -3. Obligationkand Conditions. The following obligations iuWor conditions are necessary -and shall 'be undertaken and/or maintained at the Portion of the Property to maintain'a Permanent Solution and a condition of No Significant Risk: (i) The removal of.soil from the Property must be conducted under the oversight of a .Licensed Site Professional; (H) Utility-related Abatement Measures implemented in accordance with 310 CMR 40.0460 inust be overseen.by a Licensed Site Professional; (iii) . Release•Abatement Measures implemented in accordance with 3'10.CMR 40.0440 must.be overseen by a Licensed Site Professional; (iv) Repair and/or replace, bituminous concrete pavement or concrete floor slab, with a similar impermeable surface,within 15 days of the completion of any activity which involves the removal or disturbance of existing bituminous pavement or concrete; (v) --A'.Soil Management Plan must be prepared and implemented. prior to the commencement of any activity (except-emergence utility work) which is likely to disturb subsurface soil-within the AULAREA subject'to this Notice. The Soil- Management Plan must be prepared by a-Licensed Site Professional in accordance- with the provisions of the MCP (310 CMR 40.000) and should describe appropriate soil management,characterization,storage,transport and/or disposal procedures.The `implementation of the Soil Management Plan is to be under the. supervision of a Licensed Site Professional.-The Soil Management Plan must include a description of the dust control and other engineering controls, as-appropriate, to limit exposure of workers to contaminated soil via dermal,contact,inhalation-and/or ingestion; (vi) A Health and Safety Plan must be prepared by a Certified Industrial Hygienist or other qualified individual.sufficieutly trained in worker health and safety requirements pursuant to 310 CMR 40.001.8 and CFR 1910.120,as appropriate,-and implemented prior to the commencement of any activity (except emergence utility work) which involves the removal,.disturbance, and/or direct contact with subsurface soil within the AUL AREA.
