Our office has been informed by the Fire Prevention Department about long-standing violations at the
CubeSmart property located at 38 Swampscott Road.After numerous attempts to contact Mr.Bill
Vecchio,the General Manager,an on-site investigation was conducted with the Fire Marshall on
January 81', 2026. Upon meeting Bill on-site,we were informed that the long-standing violations
previously communicated through a Fire Prevention Inspection Report dated 04/10/2025 were still
unaddressed.An exterior inspection was also conducted that same day,where I observed the
following:
• Cut overhead wires hanging down to the ground between Building A and Building B.
• Numerous Sprinkler Room Doors were in a state of disrepair and were difficult to operate to
gain access to the equipment.
• The Fire Alarm Control Panel was indicating the Sprinkler Systems in Buildings D and B
were in trouble.
• Numerous Sprinkler Room heaters were not functional.
• The Sprinkler System in Building D was shut off.
• The Sprinkler System in Building B was shut off.
• The knox box was missing critical facility keys and Fire Department key access for the vehicle
gate does not work with the Fire Department key.
• The annual Fire Alarm and Fire Sprinkler inspections for the facility are overdue.
• Landscaping trucks were parked in vehicle spaces that were too small,causing the trucks to
block the required access path to the Sprinkler Rooms on multiple buildings.

The observed conditions are in violation of CMR 102.8: Maintenance of Existing Buildings and
Structures of the Massachusetts State Building Code,as well as Sections 3.2.3 Parking and 3.2.6
Commercial Vehicles of the City of Salem Zoning Ordinance. The permitted use for the facility does
not allow the storage or overnight parking of motor vehicles,including trucks,tractors and trailers for
commercial landscaping companies,nor for the storage of boats or other recreational vehicles. After
speaking with Bill regarding the landscaping trucks, it is our understanding that the parking spaces are
being leased to the different companies.
You are hereby directed to remove all vehicles from your property that are currently in violation and to
address the outstanding building violations,as listed above and in the Fire Prevention Inspection
Report dated 04/10/2025 that was previously provided to your organization. Within two weeks of
receipt of this letter,please submit to my office estimates for the corrective work,as well as the
expiration dates for the parking space lease agreements. Failure to comply will result in the issuance of
fines.Please contact the Building Department immediately at(978)619-5649 upon receipt of this
letter to discuss this matter.
If you feel you are aggrieved by this order,your appeal is to the Municipal Hearing Officer at the
Office of the City Solicitor,93 Washington Street, Salem, MA 01970.
