Gentlemen:
Please be advised I have researched the title to the above
ti
real estate pursuant to a request from your office. Apparently
there has been some confusion over ownership because of a deed
dated July 14 , 1978 recorded in the Essex South District Reg- ,
istry of Deeds on August 11, 1978 in Book 6504 , Page 54 .
My research indicates that William E. Grauer and Mary E.
Grauer acquired title to the property as tenants by the en-
tirety by deed dated October 16 , 1940 and recorded in Book
3234 Page 580. The records in the Registry of Probate indi-
cate that William E. Grauer died on February 6 , 1966 . An
Administration filed ( #287524 ) indicates that his only heirs
were his wife, Mary E. Grauer, and his daughter, Rita Grauer.
The inventory of the estate indicates the real estate was in-
cluded as part of his estate. The subsequent deed noted in
the first paragraph attempts to convey the real estate to
Rita Grauer. However, this did not convey title because the
real estate vested in Mary E. Grauer upon the death of her
husband and it did not pass through William E. Grauer ' s es-
tate.
My research also shows that no probate has been taken
out on Mary E. Grauer ' s estate. Until a probate is taken out
on Mary' s estate, you should list the owner as "Estate of
Mary E. Grauer" .
