R-95 SUM OF: $41, 500. 00 Notice is hereby given that by an Order of Taking dated April 1, 1974, certain lands together with easements and rights, trees, buildings and other structures thereon, which include the above- captioned parcel of property, were taken by the Salem Redevelop- ment Authority through the exercise of its power of Eminent Domain for the purpose of carrying out an Urban Renewal Project known as Heritage Plaza-East, Mass. R-95 in accordance with the provisions of Chapter 121B of the Massachusetts General Laws (Ter . Ed. ) as amended. Said order has been recorded in Essex South District Registry of Deeds on April 11, 1974. Plans showing the taking and entitled, "Property Plan Project No. Mass. R-95 Heritage Plaza-East, Salem Redevelopment Authority, Salem, Massachusetts" Scale 1" = 601 , dated March 1970•, Whitman & Howard, Inc. , Engineers and Architects, were recorded in said Registry of Deeds, in Plan Book 117 , Plan 60, and are also on file in the office of the Authority. BOWMAN • NOTICE OF TAKING -2- April 11, 1974 The Salem Redevelopment Authority has awarded the sum of $41, 500. 00 as the total amount of damages sustained by the owner or owners and all other persons, including mortgagees of record, having any and all interest in the above described parcel, whose property has been taken or who is otherwise entitled to damages on account of such taking. The Authority reserves the right to amend the award at any time prior to the payment thereof for good cause shown. Payment of damages to parties of interest will be made at this office within sixty (60) days . You will be further notified . The rights of owners and others damaged by virtue of the above taking are governed by Massachusetts General Laws (Ter. Ed. ) Chapter 79. Sections 14 and 16 of said Chapter 79 provide that a person entitled to an award of damages may petition for the assess- ment of such damages 'co the Superior Court of the County in which the property taken or injured was situated, such petition to be filed within two (2) years after the right of such damages has vested The right to damages vested on April 11, 1974, when the order of ,taking .was recorded in Essex South District Registry of Deeds. Owners and/or occupants and/or persons in possession are hereby given four (4) months from the date of this notice to vacate the premises so taken as provided in section 8B of Chapter 79 of the Massachusetts General Laws. Salem Redevelopment Authority assumes no responsibility for any damages to persons or property while upon the premises taken from any cause whatsoever.
