The petitioner proposes:to install a 240 square foot paint spray booth inside and existing auto repair shop. 4. 111e petitioner proposes to a spray paint booth for light auto body work and plastic bumper painting, 5. The entire shop is approximately 1,956 square feet and located in an industrial zoning district. 6. The requested relief,if brranted,would allow the petitioner to change the use from a motor vehicle light service e garage to-a motor vehiclebody repair shop. 7. At the public hearing,no (0)member of the public spoke in support and four (4)members spoke inoppositiou to the petition. 8. The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing,and after thorough review of the petition,including the application narrative,makes the following findings: Findings for Special Permit: 1: Social, economic, or community needs served by the proposal- have negative impacts on the community with particular concern for health and welfare of the Cherry Street neighborhood regarding the effects of fumes from pamt and lacquers used in the spray paint booth on the neighborhood, e 2. There are negative impacts of traffic flow and safety,including parking and loading pertaining to the proposal: 3. Adequacy of utilities and other public services will not be affected. 4. The hearing was closed on November 7, 2012 with the following Zoning Board of Appeals members present: Rebecca Curran (Chair), Annie Harris, Michael Duffy,Jamie Metsch, Richard Dionne, and Jimmy Tsitsinos (alternate). In a petition date-stamped September 13, 2012, petitioner requested a Special Permit to expand the nonconforming use of the property by allowing bottling on the premises. 2. Eric Glass represented himself at the hearing. 3. At the hearing and in his application, Mr. Glass explained that his intent was to import, warehouse, wholesale, distribute and bottle alcohol spirits on the premises. He further explained that no distillation or pressurization would take place on the premises. 4. Exterior changes are not part of the proposal. 5. The Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the plans and petition submitted, makes the following findings: 1. Desirable relief may be granted without detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance, since the proposed business would be Icss detrimental to the neighborhood than other types of businesses allowed there by right, including those that generate significant truck traffic. Piemonte, Hacker, LaBrecque and Feeherry. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. . The Petitioner has requested a Special Permit to extend the non-conforming use of this property by leveling a portion of the existing building at this site and constructing a new building. The property is in both an R-2 and .B-4 zoning district. The property has for many years been used for commercial purposes which is a non-conforming use. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section V B 10, which provides as follows: "Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeals may, in accordance with the procedure and conditions set forth in Section VIII F and I% D, grant Special Permits for alterations and reconstruction of non-conforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood." In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the health, safety convenience and welfare of the City's inhabitants. The Board, after considering the evidence at the hearing on this matter, makes the following findings of fact: DECISION - JUNE 24, 1981 - SAUL. TANZER REALTY TRUST - PAGE TWO 1) The proposed use of this property will upgrade the neighborhood by demolishing the existing structure on the .site and replacing it with a more attractive structure. 2) The proposed renovation of this property will also upgrade existing exhaust systems at this property and thus reduce the discharge of exhaust fumes in the area. On the basis of the above findings of fact and on the evidence presented at the public hearing, the Board of Appeals finds (i) that the proposed use of the property will not be substantially more detrimental than the existing use to the neighborhood, (ii) that the proposed use of the property will promote the health, safety, convenience, and welfare of the City's inhabitants, and (iii) that the proposed use of the property is in harmony with the Salem Zoning Ordinance. Accordingly, the Board unanimously approves the granting of a Special Permit to the Petitioner.
