And all you have to do is: 1) Sign the attached petition. 2) Show how you feel by attending the Board of Appeals meeting next Wednesday, July 25th. For those of you unable to attend the July 2nd meeting called by our Ward Counselor , Leonard O' Leary, this letter and attachments are a result of that hearing . We 'd like to see the Bowditch School developed with minimum impact on neighborhood traffic patterns and with landscaping which enhances odr neighborhood and respects the privacy of these closest to the school . The general consensus of those attending the July 2nd meeting was that the best way to accomplish this is to stick to the agreement reached by the , neighborhood , the Historic Commission, the Board of Appeals and Croninshield ( the developer ) nearly two years ago. That agreement represented many hours of discussion and consideration by all concerned . The only reason the issue has been reopened is that Croninshield will no longer be eligible for investment tax credits if the gym is taken down. Mr . Singleton of Croninshield has indicated that it is not financially feasible to develop the school without these tax credits. We know he will make less profit than anticipated, but we think he will still make money -- no sound development proposal should depend on tax credits for its entire profitability. Since Croninshield ' s contract has technically expired , Mr. Singleton will be. appearing before the Board of Appeals on Wednesday , July 25th at 7 : 30 pm. We want the Board to know what we think and that we feel strongly enough to sign a petition and show up in person. It has been suggested that we specifically list our concerns ; the attached is a list of conditions for the granting of a variance from the Board of Appeals. (This is basically the same as the . original agreement, but in more detail. ) r - 2 - We hope you will take a few minutes to read this over and give us your support. One of your neighbors will be stopping by over the weekend to answer any questions you may have and to pick up your petition. We also hope you will make every effort to attend the Board of Appeals meeting , as attendance by local residents can make a big difference. Please come and bring your friends! � US cic� C I T Y IV\0 F S A L E M In City Council , Ordered: That the Bowditch School is hereby declared excess property; AND BE IT .FURTHER ORDERED: A. That the Mayor be authorized to sell the property for minimum of $205 , 800. 00 subject to the following conditions which shall be included in the purchase and sale agreement: 1. There shall be no more than 28 units. 2. A minimum of 1� parking spaces on site per unit. 3. The Bowditch name shall be included in any development. 4 . The gymnasium shall be demolished. 5. The alleyway behind the building must be maintained by developer or successor in interest. 6 . No ingress or egress to Fowler Street from the site except for emergency vehicles. 7 . The City will not replace existing sidewalks. 8a. The building design must meet the design element of the McIntire Historic District Ordinance.. Additionally, all - exterior improvements must be submitted to the Planning Department for review and comments; such improvements include but are not necessarily limited to fencing, parking plan, grade changes adjacent to abutting properties and lighting. General approval by the Historic Commission shall be obtained prior to commencement of construction. 8b. In addition, the Historic Commission shall have jurisdiction and rights of approval of all landscaping, driveways, walkways , storm and screen windows, air conditioning units , heat pumps and all exterior utility attachments and fixtures. The Historic Commission shall have jurisdiction relative to the resolution of the drainage problem at 33 Flint Street. The developer shall meet periodically with the Historic Commission, which shall represent the neighborhood. CITY OF SALEM - 2 - 9a. A ten (10) foot landscaped buffer zone along the Federal Street boundary shall be created, subject to the review and comments of the Planning Department; said buffer zone shall be maintained in a healthy and thriving condition by the developer or his successor9in interest. 9b. Snow shall be trucked off site at the expense of the developer or his successors in interest within 24 hours of the cessation of snowfall. Trash shall be removed at the expense of the developer or his successors in interest and shall not be stored exterior t4 the building unless in violation of city health codes. Any exterior trash receptacles and siting shall be subject to the review and comments of the Planning Department and to the approval of the Historic Commission. 10. The developer shall make every effort not to exacerbate parking conditions on Fowler Street nor shall construction equipment use Fowler Street for ingress or egress without prior notifi- cation. 11. Substantial construction shall have commenced by October 1 , 1984 , including but not limited to razing of the gymnasium and clearing of debris from the site. The building shall be ready for occupancy by June 1, 1985. 12 . It is intended that this Order be incorporated as a condition of the variance to be afforded the developer. Non-compliance with any of the above terms shall be enforceable by the Building Inspector or the City of Salem, including appropriate fines and/ or terms for specific enforcement, as dictated by state and local zoning codes. The undersigned agrees with the attached Order and asks that this be incorporated as a condition of any variance being granted to the developer of the Bowditch School. (Name) (Date)
