Committee hot line, I conducted an inspection of the above mentioned property
and found the following violations:
1. Downspouts are loose and missing at front and left hand side of
building.
2. Repair, replace and secure all downspouts and gutters.
3. Brick chimney is missing brick and needs re-pointing. Cracks in
brickwork at chimney must be reviewed by structural engineer and
written report forwarded to this department stating it's in safe
condition.
Please notify this department within fifteen (15) days upon receipt of
this letter as to your course of action to rectify these violations. Failure
to do so will result in legal action being taken against you.

I have received the letter from Ocmulgee Associates ,
Inc. Consulting Structural Engineering Company.
He clearly states in his letter that the court yard
area should be closed off to ensure that no one is injured
from falling bricks . (This must be done at once to ensure
the safety of everyone using this area ) .
He also states in his letter that remedial repairs
are required, but must wait until weather permits such
repairs , and at which time he will complete his evaluation
of this structure .
Demolishing this structure is a possibility per our
conversation on the telephone, but again I must emphasize
that the building is in the Historic District and all
repairs and or demolishing must be approved by the
Historic Commission .

Dear Bob:
I visited 35 Flint Street this morning to observe the condition of the chimney. The weather was clear,
sunny, windy and about 101 F. 1 walked around and viewed all four sides with binoculars.
This chimney is about six feet square and 30 or 40 feet high and is located at the back of the original
'school" building fronting on Flint Street. The upper half of the chimney appears to have been added
to an earlier lower chimney, perhaps when subsequent additions were built on to the school. As viewed
14vm the growul, I did ,col one ady significant displacements of individual bricks nor any out of plane
bowing or bulging. The chimney is generally intact overall.
However, there are many missing mortar joints in the upper courses and several bricks have fallen out
of one corner of the uppermost corbel. These are also a number of vertical cracks in the upper section
of the chimney and some step-cracks at the corners of the lower section. None of these cracks present
a structural danger at present. However, all of these cracks and empty joints permit water to infiltrate
and freeze between brick wythes. As stated above, overall conditions have not deteriorated yet, but
eventually the unattended masonry will start to separate as mortar is di%%dved and washed away and as
trapped. freezing water wedges corners and wythes apart.
At present, maintenance would consist of cleaning, pointing and replacing cracked bricks. Postponed
much longer, maintenance could involve partial demolition and reconstruction in order to restore the
integrity of the brickwork.
For this winter, however, the courtyard should be closed off to ensure that no one is injured from an
occasional brick dropping out of the one corner; it was not clear from my vantage points whether the
missing bricks have fallen onto the roof or go directly to the ground.

warm weather to confirm that the wythes are still well bonded or connected with headers. This could
be done from a bucket or from the contractor's scaffolding just prior to starting repairs.

A hearing on this Petition was held on June 8, 1982 with the following Board
Members present: Douglas Hopper, Chairman; Messrs. Piemonte and Feeherry,
and Associate Member Luzinski. Notices of the hearing were sent to abutters
and others and notices of the hearing were properly published in the Salem
Evening News in accordance with Massachusetts General Laws Chapter 40A.
The Petitioner has requested a variance for the property at 35 Flint Street
to convert the structure at the site (formerly the Bowditch School) to 28
condominium units. A variance is required because the building is in a
R-2 district where the proposed use is prohibited without a variance.
The Board of Appeal, after consideration of the evidence presented at the
public hearing and after viewing the property, makes the following findings
of fact:
1. The building in question is unique because of its previous use
as a school.
2. The manner in which this property is to be developed is of
special significance to the City because of its proximity
to a number of historic sites.
On the basis of the above findings of fact and the evidence presented at
the public hearing, the Board of Appeal concluded as follows:
1. The property in question is unique because of its prior use.
2. The condition described above especially affects the structure
in question but does not generally affect the zoning district
in which the property is located.
3. The conditions described above which affect the land in question,
but not the zoning district generally cause special hardship
because if the requested variance is not granted, the property
cannot be developed in a manner which is consistent with the
City of Salem's Master Plan.
4. The desired variance may be granted without substantial detri-
ment to the public good because the proposed development will
enhance the appearance of the area and provide much-needed
