To -- I etr, Date AFFIDAVIT We, Aaron Weinstein and Patricia Weinstein, both of Marblehead, Massachusetts , Trustees of the Mason Realty Trust u/d/t dated June 22 , 1971 (hereinafter "Trust" ) , the Trust being both the sole owner of certain real property including the improvements located thereon known as 53 Mason Street , Salem, Massachusetts , and the lessor under a lease of said real property to A. S. Burg Company, a Massachusetts corporation, which rPa' property has been or is about to be used to secure the obligations of the Trust to the Beverly Savings Bank (hereinafter the "Bank" ) and which lease has been or is about to assigned by the Trust to the Bank , on oath , hereby certify, in order to induce the Bank to make certain loans to the Trust , and for other good and valuable consideration , that to the best of our knowledge: 1 . The Declaration of Trust filed as Document No . 138092 in Essex south Registry District of the Land Court has not been modified in any respect, except as follows: Resignation of Trustee °Theodore R . Poresky, sa- d r�-s4gnatior being filed a�- Document No. 186956 ; the death of Trustee Elliott Adelman , the death certificate being filed as Document No . 186958 ; and the appointment of Patricia weinstein as a Trustee , ,,,aid appointment being filed as Document No . 186957 ; all the foregoing documents being filed in Essex South Registry of the Land Court . 2 . The Trust is , as of the date hereof, not in default under any note , instrument or agreement . 3 . There are no legal or administrative proceedings pending or threatened against the Trust . 4 . We, as Trustees , are authorized for , by and behalf of the Trust in accordance with the terms and provisions of the trust instrument creating the Trust, and we, as Trustees , have obtained all. necessary authority as iwposeo by the ♦terms and pr-ovisions of the trust instrument or by law, to execute the • following: a . Promissory note or notes evidencing the obligations of the Trust to the Bank . b. First mortgage on 53 Mason Street, Salem, Massachusetts . C. Amendment to Indenture of Lease d.
