In your letter you expressed Ms. Fleming's concerns that her daughter could possibly climb over the guard rail in place and fall out the window because the heating element could be used as a step. Please be advised that we have taken the following steps to resolve her complaints: • In the living room and first bedroom,the inoperable heating units were removed entirely,thus eliminating anything that could be used as a'step. • In the remaining two bedrooms the heating elements are still operable. Per your suggestion,we raised the guard rails an additional 6"to prevent any chance of her child being able to climb over them. Petitioner stated that the proposed equipment, relying on digital technology, requires installation at the height of land. In the City of Salem, the Pequot Apartment site represents one of the highest points above sea level, and would be an appropriate place to install the technology without having to erect additional structures. 3. Installation of the petitioner's antennae would benefit the City of Salem by enabling customers to transmit emergency and commercial messages using the digital technology currently available. 4 . There was no opposition to the proposed variance. On the basis of the above findings of fact, and on the evidence presented at the hearings, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property and not the district in general . 2. (R-3) A hearing on the petition was held on October 18, 1989 with the following Board Members present: James M. Fleming, Chairman; Messrs. , Bencal, Febonio, and Lu-inski. Notice of the hearing was sent to abutters and others, and notices of the hearing were properly published in The Salem Evening News, in accordance with the provisions of Massachusetts General Laws Chapter 40A. The petitioner represented by Attorney Richard S. Novak, is requesting variances to allow for the construction of a cell site at 12 First Street for the purpose of cellular radio broadcast for mobile telephone service. The locus is in an R-3 district. The petitioner previously filed a direct appeal with the Board on April 19, 1989 which appeal asked for variance relief to construct a cell site which included mounting six ten foot antennas on two foot mounts on the penthouse level of the existing structure. The petitioner now asks for variance re- lief to construct a cell site which will include the mounting of six three foot antennas on the roof level of the existing structure which require no mounts. Thus, the proposed antennas will not exceed the height of the existing structure. On September 7, 1989, the Planning Board unanimously voted to grant a determination of substantial change from the previously filed Appeal. Upon a motion duly made and seconded, the Board of Appeal voted 4-0 that the petition was substantially changed. The Variances which have been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building of structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would in- volve substantial hardship, financial or otherwise, to the petitioners; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating frau the intent of the district or the purpose of the Ordianace. The Board of Appeal, after careful consideration of the evidence presented, and after viewing the plans, makes the following findings of fact: 1. The substantial change relative to the height of the antennas will insure that the existing neighborhood will not be impacted. 2. The propsed use will be compatible with the residential uses of the neighborhood. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property but not the district generally. 2. Literal enforcement of the Ordinance would work a substantial hardship on the petitioner. 3. The relief requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner, represented by Attorney Richard S. Novak, is requesting Variances to construct a cell site for the purpose of cellular radio broadcast for mobile phone services at 12 First St. The equipment would be placed in a first floor room, .with six (6) antennae being installed on the roof. The locus is in an R district. The b'ariance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the Purpose of the Ordinance. We have installed this antenna so that the residents of the Hamlet Condomium complex can experience directly what it would be like to have a cellular antenna on top of a building in their neighborhood. The placement of this antenna comes as a result of the neighborhood's concern over our first effort to place an antenna array on this building. The first proposal recommended that we install a series of 15 ft. antennae on top of the penthouse for optimum transmission quality. This proposal was rejected due to the appearance of the antenna extending 35 feet over the roof and obstructing the view of the residents in the surrounding area. In order to demonstrate our second proposal, which significantly differs from our first proposal, both technically and aesthetically, we have installed the temporary antenna at Pequot Highlands. It is only 10 feet above the roof and is not visible from the street, due to the parapet wall, which surrounds the roof. It should also be noted that this antenna will not interfere with the television or radio reception in these residences. ` Page 2 - NYNEX Mobile Communications This Salem site location is of vital importance to the development of our cellular telephone network. Our revised proposal requires NYNEX Mobile Communications Company to re-engineer the total northeast sector of its cellular system in order to accommodate this new configuration. By virtue of its location, Pequot Highlands provides us with the capabilities to provide high quality cellular service to our customers. NYNEX Mobile Communications Company is very aware of the residents' concerns regarding the installation of a mobile antenna on top of Pequot Highlands.
