I rang the front door bell to see if anyone was home and a woman living on the first floor opened the door. At which time I identified myself as the Assistant Building Inspector and handed her a business card. The woman introduced herself as Elizabeth Mix , the tenant in apartment # 1. 1 asked if the owner lived there and she stated no. I then ask if she knew were I could get in touch with him. Ms. Mix then stated she was glad to see someone from the inspectors office because of a number of hazards that existed in the home and was not sure of who she should have contacted. Ms. Mix then invited me in to show me the hazards that she was talking about. At this time I enter the home and found the following violations. Douglas MacDonald who requested that I respond to your letter dated October 24, 1989, advising' him of a Stop Work order posted at the above address. The reason for your Stop work Order appears to be extensive work performed beyond the scope of a permit that your office had issued to Mr. MacDonald. Mr . MacDonald does not dispute that, but has asked me to explain that he has not performed any of the additional work. Mr. MacDonald explained to me that he had contracted with Mr . Wallace to perform certain renovation work at 174 Federal Street. According to Mr. MacDonald this was limited to the removal of some portion of the roof and the installation of a, dormer . Apparently with his contract in mind Mr . MacDonald went to your office and received a building permit which encompassed this scope of work. After obtaining the permit, Mr . MacDonald proceeded to remove and replace the portion of the roof, frame' ) and sheath the dormer, but then stopped working on the project) because the owner was unable to provide the siding that was required for the next step. A considerable time later the owner, obtained the siding, but Mr . MacDonald had entered into other' obligations and could not return to the job quickly enough to. satisfy the owner. The result was that Mr . MacDonald has not been on the job since the above-described work was completed. In fact he has not completed the scope of work allowed in the. original permit for reasons which were out of Mr . MacDonalds' control . As a consequence of being removed from the job, Mr . MacDonald has requested that I assure you that he is not now, and did not, exceed the scope of the permit he obtained. He will of course observe your Stop Work Order, but would have done so in any case because the owner had removed him from the job substantially before your order was issued. A second electric meter has been installed to the outside of the house. We have received no notification that this single family dwelling was being converted into a two family dwelling. We have heard an extensive amount of work being done on the inside of the house seemingly beyond what his permit states. As you may recall he had no permit for that work to be done until your office was notified. Having a two family dwelling will probably be much more preferable than the numbers of tennants he ' s had residing there over the years. But I ascertain that a necessary proceddre needs to be followed in order to make such a transition. We request that your office be in touch with our neighbor Don Wallace( no relation) and that he adhere to the proper pro- cedures. We are also currently in communication with the Historic District Commission regarding work that he has done on his house,again without proper permit, under the commission ' s juris- diction. Enclosed is a copy of the letter being sent to them as the follow up to a phone call. We would prefer that our neighbor follow the guidelines for home ownership in Salem and that we not have to be placed in the position of watch guard to protect our property' s value. Since this is not the first time work has been done without permit we are especially concerned that this practice will continue and the purpose of home ownership in an historic district is being nullified. Skylights were put in the roof a few weeks ago and we made inquiry with the commission as we never received notice of a hearing. We would find one skylight acceptable within commission appropriateness but find the amount presently installed unacceptable. We especially are displeased that we had no knowledge of this work to be done until hearing the actual installation by the workmen. Don Wallace received a certificate of hardship in Sept. 1986 for a window installed under similar circumstances. He went before the board about staining his house but he also used another color not mentioned. We have no problem with the added color as such but do have a problem with not abiding by the' terms of the certificate. Enclosed are copies of letters regarding said certificate. Also enclosed is a letter from the office of the building inspector regarding concerns that neighbors had about the number of people at such residence. Mention is also made of a deck. A deck was being built without permission and with disregard to, zoning requirements that it be a certain distance from abutter ' s property line.The building inspectors had the work cease but the deck was never dismantled until we recontacted the inspector 's office after two or three years of waiting. We are presently in touch with the building inspector ' s office because a second electic meter has been installed and we have not received notification of this single family house becoming a two family dwelling. We had expected that Don Wallace,owning a painting company, would be aware of the need for permits since he employs workers to do construction work also. We are extremely frustrated with his disregard for the guidelines of home ownership within this historic district and with the fact that we are thus appearing to be the bad guys with our justified concerns. He seemingly does what he can get away with and does nothing until we complain( in the past we 've communicated our concerns to him first to allow rectification of the problem without having to notify anyone else but that approach proved unsuccessful) . Your asssistance in this matter is appreciated.
