Dear Mr. Bimbo:
Acting on a complaint from the City of Salem Board of Health, this office
inspected the above referenced property for possible ::opining violations.
Upon inspection, I found you to be in violation of the City of Salem
Zoning Ordinance, Section V, Paragraph A.2. (allowed uses in an R-2 district) ,
and Section VIII, Paragraph J (swimming pools) . Running a lobster business
is not allowed in an R-2 district, and we have no record of you obtaining a
pool permit.
You are also in violation of the Massachusetts State Building Code,
Section 113. (permits) . There is no record of a permit for the deck on the
house, or the deck next to the pool.
Violations of the City of Salem Zoning Ordinance:
Violations of any of the provisions of this Ordinance shall
constitute a misdemeanor. Any person who violates this
Ordinance shall, upon conviction thereof, be fined not more
than one hundred dollars per violation, and in addition shall
pay all costs and expenses involved in the case. Each day
such violation continues shall be considered a separate
offense. Nothing hamin contained shall prevent the City from
taking such other lawful action as is necessary to prevent or
remedy any violation.
Violation of the Massachusetts State Building Code:
Violation penalties: Anyone who shall violate a provision of
this code shall be punishable by a fine of not more than one
thousand dollars ($1,000) or by imprisonment for not more
than one year, or both, for each violation. Each day during
which any portion of a violation continues shall constitute
a separate offense.
To correct these violations, you shall remove them or apply to this
office for permits, or you may apply to the Board of Appeals to allow them
to remain.
Failure to contact this office within seven(7) days of this letter will
result in this office taking legal action against you.
