Be it ordained by the City Council of the City of Salem, as follows:
,erHana 1. The City of Salem Zoning Map, dated August 27, 1965, as amended
shall be further amended by changing the following described area of real
property situated at 319 Highland Avenue currently zoned Business Park
Development and adjacent to the B-2, Business Highway District.
That the B-2 District be extended to include the real property situated at 319
Highland Avenue, bounded and described and consisting of approximately
1.76+/- acres, of a corner lot located at the intersection of Highland Avenue and
Swampscott Road.
Section 2. This Ordinance shall take effect as provided by City Charter.

PETITION TO SALEM CITY COUNCIL
Under Massachusetts General Laws Chapter 40A
To Rezone Land Shown on Attached Exhibit A

Councillors:
In accordance with the requirements of Massachusetts General
Laws Chapter 40A, Section 5, the Petitioner, Loyal Order of Moose,
Inc. , is the owner of the real property situated at 319 Highland
Avenue (the "Property") , bounded and described and consisting of
approximately 1.76+/- acres, as shown on the attached Exhibit A.
The Property, which is currently zoned Business Park Development
(BPD) , is adjacent to the B-2, Business Highway District, as
illustrated on Exhibit B attached hereto. The Petitioner
respectfully requests, for the reasons cited below, that the
adjacent B-2 District be extended to include the Property as shown
on the attached Exhibit B.
The Property is a corner lot located at the intersection of
Highland Avenue and Swampscott Road. It has housed the Moose Lodge
and Tony Lena Is Sandwich Shop for the past several years. The
location is appropriate for business highway uses, which are
allowed to the north and south and directly across the street from
the Property. The proposed extension of this Business Highway
District is compatible with the character of the area. The
Property is currently zoned BPD, Business Park Development, which
is not in accord with the B-2 Highway Business Zone which makes up
the great majority of the Highland Avenue area nearest the highway.
This change would bring it into conformance with the intent of the
B-2 zone on Highland Avenue. The remainder of the BPD zone,
including the parcels along Technology way, would remain unchanged.
The Property is under agreement with The Richmond Company,
Inc. ("Richmond") . Richmond intends to develop the Property by
constructing a single building containing a convenience store and a
bank branch, together with a gasoline filling station, on the site.
A preliminary site plan is attached for illustrative purposes
(Exhibit A) . The existing buildings on the site would be
demolished to allow for this proposed development.
We would request that the City of Salem take the necessary
steps to extend the B-2 zone on Highland Avenue, so as to include
the Property, as shown and described on Exhibits A and B herewith.
