At the Board of Health meeting held on Tuesday, October 10, 1989, a motion was
made and passed to conditionally approve the Definitive Plan for the Middle Street
Extension, Lot 47, Parlee Street in the City of Salem, MA 01970, with the following
conditions:
1 . Prior to site start-up and also during site construction, employ a
licensed Pest Control Firm for site evaluation and service, with a
copy of the service program sent to the Health and Planning Departments.
2. Measures taken to assure that air pollution due to odors and noise
does not occur during and after site construction.
3. Employ an acceptable method for dust and street cleaning control
during site construction and submit a copy of the method utilized
to the Health and Planning Departments in writing.
4. Employ an acceptable method for containment and removal of all
vegetation waste, and any unacceptable excavation material (waste)
from site during and completion of construction.
5. All backfilling be done in accordance with good engineering practices
to prevent future damage to all underground utilities.

Dear Ms. Morin and Ms. Smith:
The Salem Planning Board voted on October 5, 1989, to approve the proposed subdivision
plan entitled "Plan of Land, Middle Street Extension", dated September 15, 1989, revised
September 19, 1989, subject to the following conditions:
1. Conformance with Plan
Work shall conform to plan entitled "Plan of Land, Middle Street Extension" dated
September 15, 1989, revised September 19, 1989.
Z. Utilities
Utility installation shall be reviewed and approved by the City Engineer.
3. Board of Health '
Board of Health requirements set forth in a letter dated September 27, 1989, shall be
strictly adhered to.
4. Clerk of the Works
A Clerk of the Works shall be provided at the expense of the developer as is deemed
necessary by the City Planner.
5. Construction Practices
All construction shall be carried out in accordance with the following conditions:
a. No work shall commence before 8:00 a.m. on weekdays and Saturdays. No work shall
continue beyond 5:00 p.m. There shall be no work conducted on Sundays or holidays.
Inside work of a quiet nature may be permitted at other times.
F b. All reasonable action shall be taken to minimize the negative effects of construction on
abutters. Advance notice shall be provided to all abutters in writing at least 72 hours
prior to commencement of construction.
c.Drilling and hoe ramming shall be limited to Monday - Friday between 8:00 a.m. and 5:00
p.m. There shall be no drilling or hoe ramming on Saturdays, Sundays or holidays.
d. All construction vehicles shall be cleaned prior to leaving the site so that they do not
leave dirt and/or debris on roadways as they leave the site.
e. All construction shall be carried out in accordance with the Rules and Regulations of the
Plnnnino RoArd.

b. As-Built Plans
As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be
submitted to the Planning Department and Engineering Department prior to issuance of
Certificates of Occupancy.
7. Land sca in
A 3 " caliper deciduous tree shall be planted in the center of the planting strip.
8. Violations
Violations of any conditions shall result in revocation of this permit by the Planning Board.
This endorsement shall not take effect until a copy of this decision bearing the certification
of the City Clerk that twenty (20) days have elapsed and no appeal has been filed, or that if
such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County
Registry of Deeds and is indexed under the name of the owner of record or is recorded and
noted on the owner's Certificate of Title. The fee for recording or registering shall be paid by
the owner or applicant.

Dear Mr. Munroe:
I have received in inquiry whether or not the above
entitled parcel of land containing 7 , 171 square feet of land
with an excess of 50 feet of frontage on Parlee Street is
afforded the protection of the fourth paragraph of G.L.c40A
§6 .
The "grandfather" provision of the aforementioned statute
exempts certain lots for single and two-family use from area
and frontage requirements provided the lot in question has
a minimum of 5, 000 square feet of area and 50 feet of frontage.
In order to qualify for the protection, such a lot must not
have been held in common ownership with adjoining land at
the time of recording the most recent instrument of record
prior to the effective date of the restrictive zoning change
pertaining to the lot.
An examination of the record title indicates that the
record title meets the criteria to be "grandfathered" under
the provisions of G.L.c40A §6 even though the lot does not
conform to the current 15,000 square feet area requirement

and 100 foot frontage requirement of the ordinance. However,
it is further my opinion that any structure built on the
lot must comply with the ' set back, lot coverage and height
requirements of the same ordinance as well as any other
applicable requirements relative to roads and the like.

B. Definitive Plan

1. General
Any person who submits a Definitive Plan of a subdivision to
the Planning Board for approval shall file with the Board the
following:
a. An original drawing of the Definitive Plan and three
contact prints thereof, dark line on white background. The
original drawing will be returned after approval or disapproval .
b. A properly executed application Form C (see Appendix).
c. The applicant shall pay the cost of all advertisements,
notices and signs.
The applicant shall file by delivery or registered mail a notice
with the' City Clerk stating the date of submission for such approval
and accompanied by two copies of the completed application (Form C).1

2. Contents
The Definitive Plan shall be prepared by a registered land

Dear Ms. Morin and Ms. Smith:
The Salem Planning Board voted on October 5, 1989, to approve the proposed subdivision
plan entitled "Plan of Land, Middle Street Extension', dated September 15, 1989, revised
September 19, 1989, subject to the following conditions:
1. Conformance with Plan
Work shall conform to plan entitled "Plan of Land, Middle Street Extension" dated
September 15, 1989, revised September 19, 1989.
Z. Utilities
Utility installation shall be reviewed and approved by the City Engineer.
3. Board of Health
Board of Health requirements set forth in a letter dated September 27, 1989, shall be
strictly adhered to.
4. Clerk of the Works
A Clerk of the Works shall be provided at the expense of the developer as is deemed
necessary by the City Planner.
5. Construction Practices
All construction shall be carried out in accordance with the following conditions:
a. No work shall commence before 8:00 a.m. on weekdays and Saturdays. No work shall
continue beyond 5:00 p.m. There shall be no work conducted on Sundays or holidays.
Inside work of a quiet nature may be permitted at other times.
b. All reasonable action shall be taken to minimize the negative effects of construction on
abutters. Advance notice shall be provided to all abutters in writing at least 72 hours
prior to commencement of construction.
c. Drilling and hoe ramming shall be limited to Monday - Friday between 8:00 a.m. and 5:00
p.m. There shall be no drilling or hoe ramming on Saturdays, Sundays or holidays.
d.All construction vehicles shall be cleaned prior to leaving the site so that they do not
leave dirt and/or debris on roadways as they leave the site.
e. All construction shall be carried out in accordance with the Rules and Regulations of the

6. As-Built Plans
As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be
submitted to the Planning Department and Engineering Department prior to issuance of
Certificates of Occupancy.
7. Lands ca u
A 3 " caliper deciduous tree shall be planted in the center of the planting strip.
8. Violations
Violations of any conditions shall result in revocation of this permit by the Planning Board.
This endorsement shall not take effect until a copy of this decision bearing the certification
of the City Clerk that twenty (20) days have elapsed and no appeal has been filed, or that if
such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County
Registry of Deeds and is indexed under the name of the owner of record or is recorded and
noted on the owner's Certificate of Title. The fee for recording or registering shall be paid by
the owner or applicant.

copy is on file with the Planning Board.
