struction phasing.

Sirs :
Preliminary subdivision plans have been received from Carter &
Towers Engineering Corp . , on March 21 , 1983 , for our review . These
plans are dated Sept . 27 , 1982 .
As a result of my review of said plans the following items shall be
noted :
1 . It shall be noted that hydrant locations as shown on the plan ,
dated Sept . 27 , 1982 ; have not been approved by the Salem
Fire Department .
2 . This plan was apparently drawn without any prior consultation
with this office . Hydrant locations are to be placed on the
plan as per the following listed locations . Ref : Mass . State
Bldg . Code Section 1200 . 1 . 1 ( 1 ) & (2) .
3 • It shall also be noted that hydrants located at ends of water
mains , on cul -de-sacs ; while ideal for use as blow offs , are
not considered of value for fire fighting purposes . These
hydrants , while useable , are beyond the structures to be protected ,
and are not considered for normal use under normal firefighting
tactics . This does not preclude the use of hydrants at these
locations for compliance with the engineering requirements for
blow off purposes .
4 . Approval of hydrants will require installation at locations
as follows :
a . Barcelona Ave . at Lot lines of lots #27 and #28 . (This location
has been used because of the long distance from the last
existing hydrant on Barcelona Ave .
b . On Barcelona Ave . at B Street , on curb line of Lot #38 and
no more than ten feet from the corner point .
c . On Barcelona Ave . at C Street , on curb line of Lot #44 ,
and no more than ten feet from corner point .
d . Hydrant at Barcelona Ave . and A Street , at curb line of
of Lot # 63 , is satisfactory .

( Placement at lot lines eleminates any possible problems with
driveway construction . )

more than ten feet Southwesterly from cornor point .
5 • Additional gate valves are recommended on the water mains at
the following points : (Subject to approval of Dir . of Pub . Services)
a . On Barcelona Ave . near Lot #27 , where connection is made to
existing water main .
b . On A Street , from Barcelona Ave . , adjacent to Lot #46 .
6 . It is also recommended that the use of letter designations for
street names be eleminated . These designations are usually unaccept-i,
able to residents and a request for a name changei .is usually
presented by the residents shortly after purchase of real estate .
These names should be presented for approval now , as prior
street designations have been submitted which were duplicates ,
and this creates havoc for the public safety forces .
7 . Two locations should be determined for City connected street
fire alarm boxes.. These locations shall be stipulated and shown
on the plan prior to our approval . Locations for these fire
alarm boxes , shall be obtained from the Salem City Electrician
Mr . John Condon .
Plans as submitted are therefore DIS-APPROVED.. , as of this date ,
by the Salem Fire Department .

Ladies and Gentlemen:
Preliminary subdivision plans for Country Club Estates have been reviewed and
comments are as follows:
A. Gate valve required at start of water line connection (Lot #27) .
B. Gate valve required on "A" Street, opposite lot 146.
C. All cul-de-sacs must have hydrant for blow off and cleaning purposes.
These installations do not necessarily meet with Fire Department requirements.
Location and number of hydrants for safety reasons must be approved by Fire
Marshall .
D. Drop manholes will be required in two (2) locations, for sewer service.
Consultation with Engineering office is required.
E. All other features of the plan meet with approval .
Resubmission, with corrections, are required.

Section 7-14, Cluster Residential Development of the City's Zoning Ordinance allows a
Special Permit to be granted excepting a plan from lot area and frontage requirements in the R-1,
R-2, R-3 and R-C zones if certain criteria are met. The Cluster Subdivision allows for the more
efficient use of land in harmony with its natural features and with the general intent of the Zoning
Ordinance.
I have reviewed the Preliminary Plan for the proposed Marlborough Road Cluste N �S
Subdivision. The proposed subdivision is a 9.18 acre tract of land which lies with o
districts, R-1 and R-C. Approximately 40% of the total tract of land is�✓etlan d/or, in 1 d
that is proposed to be deeded to the Homeowners Association. As statedIn4lid City's Zo g
Ordinance, water cannot be used in the calculation of available land to build on. For discussion
purposes, I have estimated the water areas as approximately 3.75 acres of the proposed
development.
There are seventeen (17) lots proposed in the Cluster Subdivision. Five of the lots are
entirely in the R-C zone and three lots are located partially within the R-C zone. The proposed
lots range in size from 7,600 to 9,500 s.f. and have varying frontage from 80 feet to 200 feet.
Five lots are located in the R-C zone which would require 400,000 s.f. or 9.18 acres. The
remaining twelve lots are located in the R-1 zone which would require 180,000 s.f. or 4.13
acres. The total acreage required for the development would be 13.3 acres.
There are also two roads proposed for the development which are 40 feet wide and
approximately 300 feet long. The 40 foot layout allows for the construction of curbing, grass
strips and sidewalks on each side of the street. Approximately 1/2 acre of land would be utilized
for the road construction.
I have prepared a chart indicating the number of units allowed by-right in the R-C and
R-1 zones. I have also calculated the number of units allowed without the inclusion of water in
the total land available to build on.

Units per Acre: 1.8 Units per Acre: 2.9
Total Acres: 4.59 Total Acres: 4.59
Total # of Units Allowed: 8.26 Total # of Units Allowed: 13.3
Total # of Units w/o Water: 0 Total # of Units w/o Water: 13.3
As indicated by the chart, the density as proposed is greater than the allowed density
when subtracting the water area from the tract of land.
Section 7-14, Cluster Residential Development of the Salem Zoning Ordinance also states
that, "When the open land is added to the building lots, the total area required by this ordinance
or by-law for the total number of units contemplated in the development for the zoning district."
The Ordinance also requires that "at least twenty (20) percent of the total tract area (of
which at least fifty (50) percent shall not be wetlands.or slopelands, nor shall it include streets,
ways and parking areas) shall be set aside as common land and shall consist of usable open
space."
The proposed Cluster Subdivision includes 3.75 acres of land set aside as common land.
This land represents 40% of the total tract of land. Of this 3.75 acres, approximately 50% is
wetland. Therefore, the subdivision as proposed does satisfy the criteria of common land
established by the Zoning Ordinance.
I have also reviewed the City's Wetlands Maps for this parcel. The maps indicate that
there is a large resource area located in the center of the parcel. If more than 5,000 square feet
of the resource area is filled, this area must be replicated within the same resource area. This
condition would decrease the amount of land available to build on.
The Cluster Subdivision as proposed is an excellent concept for this particular parcel.
However, the density as proposed is too great for the available land. I think we could work with
the owners to reduce the density to a more acceptable one which would allow for slightly larger
lots. Joe Carter has asked if he should come before the Planning Board with this Preliminary
Plan. I would like to meet with him to discuss our concerns prior to having the Board review the
plans. What do you think?

On January 20, 1994, the Salem Planning Board reviewed a Preliminary Cluster
Subdivision plan for your proposed development located off of Marlborough Road. The Planning
Board approved of the concept of the proposal and hopes that a filing for a Cluster Special
Permit will be submitted.
As discussed at the meeting of January 20, 1994, the Board had some questions including
the total number of lots which would be requested, whether the width of the access roadways was
adequate, and whether sidewalks and curbing will be needed within the proposed development.
These issues seem very manageable and can be addressed once a Definitive Plan is filed with the
Planning Board.

site plan, the revisions include depicting the 50' Right of Way layout
and the 30' paved way. We have also posted the streets on the
Opposite side of Marlborough Road. The other revision is the widening
of Marlborough Road for acceleration and deceleration lanes and the
increased paving radius,T on Terry Way. The Locus Plan has also been
revised to exclude the developed lots .
We have a developer very interested, however, it' s impossible to
negotiate without a conditional commitment from the planning board.
Is it possible to perform your review of this plan and schedule us for
the next planning board meeting, possibly last on the agenda, to
hopefully obtain a conditional preliminary approval .

concerning the potential for migration of contaminants from the
Site to your property.
Your primary concern seemed to be the potential impact of the site
on the wetlands draining into Strongwater Brook, which eventually
flows through your property. This letter will attempt to address
these concerns . As we discussed on the phone, the data that was
summarized in the Department' s letter to Ms . Bouchard (enclosed)
concerning the impacts of the Site contaminants to properties off
of Marlborough Road, are also applicable to your property.
The majority of the sampling of the groundwater, wetlands, and
streams on the Salem Acres site occurred during the Remedial
Investigation and Feasibility Study (RI/FS) that was completed in
May of 1992 . Surface water and sediment samples, and tissue
samples from aquatic organisms, were taken from Strongwater Brook
downstream of the waste areas . The results indicate that the
wastes have not migrated significantly into the groundwater, the
brook, or its sediments . In summary, the results were they
following:
- No organic contaminants were detected in the brook:
Metals were detected at levels below ~EPA' s Proposed,
Ambient Water Quality, Criteria (AWQC) for 'the protection t
of freshwater aquatic life (Federal Register, -N(5vember
19, 1991, Volume 56 , No. 223 , pp . 58420-58478) ;

Poly-aromatic y omatic hydrocarbons (PAHs) were found in wetland
sediments, but in typically low concentrations (ppb to
very low ppm range) .
Low levels of contaminants were found in the tissue
samples, but all were common in tissues of organisms in
urban and industrialized areas and cannot be traced
specifically to the site.
Groundwater monitoring wells were sampled seasonally on
four separate occasions over a one-year period. No
organics or metals were detected above their Maximum
Contaminant Levels (MCL) .
No further sampling has been conducted on site since the remedy was
selected in March of 1993 (marked by the Record of Decision, the
document that records the selected cleanup measures for the site) .
Further monitoring of the groundwater and the wetlands on site will
occur during the remedy, and for a period of time following the
cleanup to ensure that these resources are not impacted.
As the Bouchard letter states, sampling revealed that no
significant contaminant migration to and through the groundwater,
air, and wetland/surface waters has occurred, and therefore the
site poses a public health risk only through direct contact with
the wastes .

Dear Ms . Bouchard:
In response to your conversation with Jay Naparstek of this
office and your request, this letter is to clarify the extent of
contamination associated with the Salem Acres Federal Superfund
site . As you know, the site is located in an undeveloped area
between Marlborough Road and the end of Barcelona Avenue . (See
attached site maps . )
Over the last several years remedial investigations were
conducted at the direction of the Federal Environmental
Protection Agency (EPA) and the Massachusetts Department of
Environmental Protection (DEP) . The purpose of these studies was
to identify the types and extent of contamination at the site and
to determine the risks posed to public health by the site .
Subsequently, EPA and DEP developed a cleanup plan for the site
that will result in either removal of all wastes from the site or
covering of the wastes in place such that no exposure to the
public may occur. The specific design plans for the cleanup will
be developed over ,the next year .
The remedial investigations indicate that the wastes
disposed of at the site are limited to discrete areas on the site
and have not migrated significantly from the point of original
deposition. More specifically, the waste areas include lagoons
where sewage sludge was disposed .(presently fenced) , an area
where fly ash was disposed, and an area described as a landfill
where unauthorized disposal of other types of waste occurred,
including municipal solid waste and construction debris . There
is no evidence or reason to believe that disposal occurred near
any residential areas .
In addition to delineating the waste disposal areas, the
remedial investigations also included sampling of groundwater,
wetlands, and streams leaving the site. These are the typical
routes through which contamination would migrate . Results of
these analyses indicate that the wastes are not migrating and no
remedial actions for those environmental media are warranted.

The results of the remedial investigation were used to
conduct a risk assessment to determine the present and potential
future risks posed by the site to public health and the
environment if the wastes were left as they are . Because there
was no significant contaminant migration to and through the
groundwater, air, and wetland/surface waters, it was determined
that the site posed a public health risk only through direct
contact with the wastes . There is no risk to the residents in
the area unless they are to enter the site and directly contact
the wastes . Therefore the decision was made to protect the
public health by eliminating the potential for that type of
exposure, either by removing the wastes completely or by , covering
the wastes with an impermeable synthetic liner and approximately
three feet of clean soil and vegetation. The latter remedy ,would
require long term monitoring and land use controls .
In summary I would reiterate that the Agencies believe the
Salem Acres site, in it' s present condition, poses a risk to the
public only through the potential for contact with wastes on the
site. The site poses no off-site risk to public health. As the
remedy proceeds, the potential for on-site contact will be
reduced because of tighter security measures . Upon completion of
the remedy, the potential risk through direct contact will be
eliminated because the wastes will be removed or capped.
