Dear Ms. Carter, Early in September an inspection of the temporary school was
conducted. Present were yourself, Fire Marshall Erin Griffin,Paul L'Heureux,Director of
Building services and myself. The purpose of the inspection was to identify and correct any
safety concerns and code violations. It was expected that problems would be identified and
that these problems would be quickly corrected. A Re-inspection,conducted on 10/13,
revealed that building problems(doors locks, thresholds etc.) were promptly taken care of
by Mr. L'Heureux and his staff. Violations regarding hallways,stairs,access to egress
doors,storage of combustibles materials etc. was virtually unchanged and in some instances
worse.
Therefore, under the authority of the Mass State building code 780 C.M.R, you are
directed to address the following:
1- Exit Stairways section 1020.1—"an exit shall not be used for any purpose that
interferes with its function as a means of egress" The exit stairways can have
no chairs, desks, boxes or any other items at any time.
2- Corridors section 1018-Corridors leading to exits are also not to be used for
any purpose that interferes with the path of egress. Also, Combustible
materials and rolling stock cannot be stored in the hallways.
3- 3-Exit passageways-section 1023. The exit passageways(approach to the exit
doors inside the classrooms) cannot be less than 36". I have asked Mr.
L"Heureux to to place marking tape in the area of the doorways to make sure
there are no loose materials or furniture which can tip easily and reduce or

obstruct the doorways. The area will be one foot back from the edge of the
door and four feet into the room.
4- Interior Finishes-Any plastics,fabrics imitation leather and all foam plastics
that are to be used in the building,must have product labels attached.The
purpose of these labels is to determine the suitability and compliance with Fire
Department Regs, N.F.P.A requirements as well as Building code
requirements for flame spread. Any materials not labeled are assumed not to
meet these regulations and are therefore not permitted. The gasses and rapid
flame spread of many plastics can be deadly. This is a major concern to the
safety of the occupants of the building as well as the First
Responders(Firefighters and Police)
I have heard rumblings about the fact that the educational environment is the priority at
Saltonstall. The priority of my staff, Salem Fire and Mr. L'Heureux is a safe building
for our children and staff. The safety of the children and staff cannot take a" back seat'
to any other concerns.
If you wish to appeal this order, your Appeal is to the Board of Buildings,Regulatiions
and Standards in Boston. If there are any questions please contact me directly.

On April 28 , 1998 at approximately 8 : 05 a .m. , l
received a call from Paul L 'Heureux the Director of
Building Services for our schools , concerning a board that
had come loose and fallen from the brick roof vents at the
Federal Street School . He informed me that he contacted a
contractor and had a lift on the job site so as to
re-secure any further loose items at the roof vents and
felt I should inspect said brick vents while the lift was
site .
At approximately 9 : 15 a .m. I met with Mr . L ' Heaureux ,
Mr . Collins of the Engineering Department and Mr . Plant of
Boston Chimney at the job site . At which time I climbed
aboard the lift and conducted an inspection of all roof
top brick vents .
It is my finding that all of the brick vents are
unsafe and should be removed as soon as possible . But my
greater concern of the moment are the two brick vents
located nearest the Federal St . School front entrance at
the right hand side facing the building should be removed
immediately to a safe height . Speaking to the contractor
on site he estimated that this could be done in
approximately four ( 4 ) days , I recommended this be done
immediately.
The remainder of the roof brick vents should also be
removed as soon as the school year is completed . I do
:eel that the work being done on the existing cables will
secure the brick vents temporarily until the school
closing .
Article 121 . 3 of Chapter #1 of the Massachusetts
State Building Code , (Removal or making structure safe)

Salem Ordinance covering demolition delay.
All safety precautions are being implemented to

Gentlemen/Ladies:
On June 10, 1997, Ronald Michaud and I viewed the five discontinued brick air vents at the Federal
Street School. In December, 1986, our company was contracted by the Archdiocese of Boston to
remove the five brick vents due to public safety concerns. On Jan. 7, 1987, the Salem Historical
Commission issued a notice of denial to the Archdiocese causing the project to be cancelled.
Subsequently on October 16, 1987,the Archdiocese contracted with us to furnish and install
- temporary reinforcing to the five brick air vents. Since that time the cables and planking used to
temporarily reinforce the vents have not been checked or serviced in any way. At our site visit today,
we observed that the planking has shifted due to the slacking of the cables. We also noted that one
plank has fallen from its position creating a safety hazard. The air vent where this has occurred is at
the right rear of the school. This is of great concern since this area is where students, staff members,
and visitors are entering and exiting the building. We recommend that this area be secured
immediately with barricades to prevent the public from being exposed to possible serious injury.
We further recommend that the temporary reinforcing system be serviced as soon as possible. .

storage all of the decorative cut granite that was removed from three (3) of the ventilation
chianileys at the former St. James School building. The stone was removed by the-Boston
Chimney and Tower Co. of Peabody, Mass. from 'Wednesday 4/29/98 through Friday
5/1/98. The removal was part of an emergency repair and temporary stabilization
project to rectify a hazardous situation that had developed at the site. The project was
necessitated by the failure and loss of one of the wooden planks which had been installed
by the Archdiocese in 1987 to temporarily secure the chimneys in place.
The granite pieces are stored at Salem High School and are available to the archdiocese at
any time for reuse in rebuilding the chimneys or for pickup and disposal.
Kindly advise me at your convenience of the archdiocese's plan for the use of this
material,and their plan to correct the dangerous situation created by these chimneys.

Enclosed for your review is a copy of a letter and a work proposal from Mr. Ronald
Plante regarding the condition of the ventilation chimneys at the Federal Street School.
This letter was unsolicited and is the result of Mr.Plante's observations and assessment
of the present condition of the temporary repair work performed in 1987 by his
company.
I have contacted Mr. Dudley Mulcahy of the real estate office of the Archdiocese of
Boston and have forwarded a copy of Mr. Plante's letter and proposal to correct the
immediate problem. This is a pre-existing condition and should be the responsibility of
the Archdiocese of Boston or St. James Parish and not the school district.
I will contact Mr. Robert Ledoux, the City Solicitor for a legal opinion on our
responsibility in this matter and if we can be required due to the terms of the lease
agreement to make any permanent repairs that may be required. Further investigation by
a qualified person , either a masonry contractor, an architect or an engineer will be
required to determine the structural integrity of the chimneys and the level of repair work
that may be required.
This will be a very time consuming project if we are required to perform this function.
As a precaution, warning barrels and caution tape have been installed on each side of
the building denying passage via these areas. These will remain in place until a
determination of a potential hazard, if any, to the students, staff and public has been
made and until any required immediate remedial action has been completed.
I will keep you advised in this matter, please contact me at your convenience if you have
any questions or concerns.

On Wednesday, September 2, 1998 I conducted a
reinspection of the brick roof vents at the Federal Street
School . Accompanying me were Paul L 'Heureux, the Director
of Building Services, Michael Collins, Assistant City
Engineer and Ronald Michaud of the Boston Chimney and
Tower Company.
Findings :
The inspection conducted confirmed that the brick
vents are unsafe and in a state of considerable disrepair .
The exposed mortar joints are allowing rain to enter and
cause continued deterioration to the structural support of
the brick vents .
It appears that from reviewing past documentation
that the Archdiocese has been aware of the problems with
the vents since 1987 and that they have not made a good
faith effort to repair or remove the unsafe structure.
Order to Make Structures Safe or Remove :

I am hereby ordering Mr . L'Heureux to immediately
have the granite pieces removed from the two ( 2 ) brick
vent stacks on the Bridge Street side and to secure the
five (5 ) vents stacks with a reinforced fencing, planking
to brace the corners and capping the tops with pressure
treated plywood.
I further recommend that you forward a letter to the
Archdiocese requesting that the brick vent stacks be
removed as soon as possible, or that I receive a letter
from a structural engineer stating that the brick vents
stacks are structurally safe .
Kindly advise me at your convenience as to what
further action you wish to take and if the Archdioceses ' s
plans to correct the dangerous situation created by these
chimneys .

Enclosed for your review is a copy of a letter and a work proposal from Mr. Ronald
Plante regarding the condition of the ventilation chimneys at the Federal Street School.
This letter was unsolicited and is the result of Mr. Plante's observations and assessment
of the present condition of the temporary repair work performed in 1987 by his
company.
I have contacted Mr. Dudley Mulcahy of the real estate office of the Archdiocese of
Boston and have forwarded a copy of Mr. Plante's letter and proposal to correct the
immediate problem. This is a pre-existing condition and should be the responsibility of
the Archdiocese of Boston or St. James Parish and not the school district.
I will contact Mr. Robert Ledoux, the City Solicitor for a legal opinion on our
responsibility in this matter and if we can be required due to the terms of the lease
agreement to make any permanent repairs that may be required. Further investigation by
a qualified person , either a masonry contractor, an architect or an engineer will be
required to determine the structural integrity of the chimneys and the level of repair work
that may be required.
This will be a very time consuming project if we are required to perform this function.
As a precaution, warning barrels and caution tape have been installed on each side of
the building denying passage via these areas. These will remain in place until a
determination of a potential hazard, if any, to the students, staff and public has been
made and until any required immediate remedial action has been completed.

any questions or concerns.

Gentlemen/Ladies:
On June 10, 1997, Ronald Michaud and I viewed the five discontinued brick air vents at the Federal
Street School. In December, 1986, our company was contracted by the Archdiocese of Boston to
remove the five brick vents due to public safety concerns. On Jan. 7, 1987,the Salem Historical
Commission issued a notice of denial to the Archdiocese causing the project to be cancelled.
Subsequently on October 16, 1987, the Archdiocese contracted with us to furnish and install
temporary reinforcing to the five brick air vents. Since that time the cables and planking used to
temporarily reinforce the vents have not been checked or serviced in any way. At our site visit today,
we observed that the planking has shifted due to the slacking of the cables. We also noted that one
plank has fallen from its position creating a safety hazard. The air vent where this has occurred is at
the right rear of the school. This is of great concern since this area is where students, staff members,
and visitors are entering and exiting the building. We recommend that this area be secured
immediately with barricades to prevent the public from being exposed to possible serious injury.
We further recommend that the temporary reinforcing system be serviced as soon as possible.

Dear Darleen:
I would like to clarify two items which came up at Monday night's meeting with members of the
school committee:
Chimneys:
Someone made th comment after the meeting that they were relieved that the building was sound
as the chimneys had concerned them. It should be noted for the record that while the main core of
the buiding is in fact structurally sound, the chimneys are not, and their long term safety is
questionable. I recommend a permanent repair or demolition in my report, and it should be stressed
that this should be a high priority.
Front Entry Canopy:
The front entry canopy was not included in my report as it is a free-standing appendage, placed
against the building. It should be noted that this is partly supported on the main school foundation
and partly supported on the site fill outside of the main foundation. Because the outer fill has
settled, the conopy has rotated and leans away from the main building. This is very pronounced at
the roof elevation where the flashing has torn away from the school wall and allows water to enter
in the gap behind it.
This is not an unsafe condition, however the canopy should either be rebuilt, or the flashing should
be replaced with wider pieces to allow for the movement.

was due to the legal deadline for acting on an application
preventing the Commission from continueing the application to the
Commission' s next meeting and the request that the property owner
look into the option of filling in the vents vs . removal .

On January 5;. 1988 an inspection of St. James Church addition was made at
your request and the following has been confirmed.
There has been definate structural movement of the addition. Due to this
fact and the Engineers report that use should be discontinued, it is the
opinion of this office that the doors must be permanently locked until -
proper repairs to the structure have been made.
Any entering or exiting of this stairway is definately hazardous and must
be discontinued. The use of the kitchen should also be discontinued and the
door locked.
After reviewing the possible solutions by Regan Engineers we have concluded
that the fifth option appears to be most logical. Solution IL 's 2,3 and 4 are
at the most temporary and would not solve the problem.
Even though solution Ill would be leasable, there will be hidden costs in–
volving reinforcement of the framing affected by the movement.
Razing the existing structure and rebuilding in our opinion will be most
economical.

1. Jakiel mentioned problems with obstructions and excess grouting.
Obstructions encountered exterior piles #8. #10, and #17. Inside
piles #23. #25, and #26. Jakiel says one to two hour delays at
obstructions. Spent four hours on one obstruction and have not gone
through #17. The are trying to get through the obstructions using a
air rotary drill . He says obstructions are bricks and mortar and
reinforced concrete fill . Architect and Engineer contend that
borings indicate brick and block fill in the area of the footings
and should have been anticipated by the Contractor.
Engineer recommends heavier drilling equipment be brought to the
site to remove the obstructions. The Contractor said he will do this
next week.
2. Fourteen (14) piles are in. five (5) are waiting for obstruction
removal , and seven (7) remain to be done. Jakiel said two (2) piles
can be installed per day if no problems.
3. Jakiel said two (2) piles. #6 and #12. had excess grout placed
(twenty (20) bags) 1 '-0" below the bottom of the footing. They
placed the grout under pressure to within i '-O" of the bottom of the
footing. Then the additional grout was required. Weidner expressed
concern that the pile core be filled solid with concrete and not be
contaminated with soil or voids. Jakiel said this could not happen
since the casing was never removed and a head of grout was
maintained until the grout extended to the top of the pile. The
testing lab will monitor the grout placement and note the quantities
used in their reports.
4. Mr. Lamarre believes pile #17 is hitting the church granite
foundation. Pile #17 to be moved 1 '-0" to right to see if it clears
the obstruction.
5. Architect and Engineer have not seen centralizers used on bars in
piles #6 and #11. Jakiel says his superintendent said they were
installed. This is to be resolved later.
6. Contractor is working 10hrs/day. 4 days/wk. Jakiel was not aware of
this. He will resolve. To step up the schedule a recommendation to
use another crew was made. Jakiel says another crew would not help
the schedule.
7. The costs for inspection. scheduling, and scope were discussed.
Custodian believes Supt. Lynch does not communicate well with the
inspectors. The inspector shows up when not needed and does not show
up when piles grouted. This problem must be corrected. Terra
Drilling Company to help coordinate with the testing lab.
8. Architect says testing lab has overcharged on latest invoice dated
April 7. 1989. He has a meeting with UTS Testing Lab. Mr. William
Crabtree, to resolve the payment issue.
9. The Owner has the following comments:
a. The entry hall at boiler room is cluttered with hoses. Hoses
block the door and interfere with the alarm system
b. The hose from the sidewalk hydrant has no warning signs placed
over the hose. A 92 year-old-lady tripped over the hose and was
injured the first week in April .
C. The casings are being cleared inside the building causing
excess water in the boiler room and drains. Request Terra clean
tubes outside.
d. Cement dust has caused problems in Bingo Hall and the boiler
controls. Install dust barriors in areas being worked.
10. Terra would not give an estimated completion date. Jakiel said its
contingent on removing the obstructions.
11. Piles in place and problem piles were observed during site visit.
The outside piles with obstructions will have heavier equipment used
to attempt to dislodge the obstructions. Jakiel asked if the saw cut
in the stair wall has to extend below grade. Weidner stated the saw
cut extends from top of wall to bottom of footing. Some settlemen".
of the wall and stairs may occur later. but it was decided not to
underpin the stair wall to save the cost of the piles. Future
repairs to this wall may be required.

R06ERT JAKIEL DATED MARCH 31 , 1999.
HE IS REQUESTING INSPECTION BY THE TESTING LABORATORY TO
MONITOR THEIR PROBING, DRILLING AND CORING OPERATION. THE
REASON FOR THIS REQUEST IS NOT CLEAR. . THE PILE CAPACITY WAS
DESIGNED AND CERTIFIED WITH A PROFESSIONAL_ ENGINEERING STAMP
BY. THEM. WE ARE RELYING ON THEIR EXPERTISE AND SETTLEMENT
GUARENTEES TO PROPERLY INSTALL THE PILES.
THE TESTING LAB WILL INSPECT THE REINFORCING INSTALLATION AND
GROUTING OPERATION. THEY WILL CHECK THE LENGTH OF THE PILE
AND REINFORCING RODS, CENTRALIZER LOCATIONS , CASING REMOVAL
AND QUANTITIES OF GROUT PLACED UNDER PRESSURE . THEY WILL
ALSO MAKE CYLINDERS FOR COMPRESSION TESTING OF THE GROUT.
WE EXPECTED SOIL VOIDS, RUBBLE, BLOCKS, ETC. , BELOW THE
FOOTINGS AS NOTED IN THE BORINGS. THIS IS ONE OF THE REASONS
FOR THE SETTLEMENT OF THE STRUCTURE. WITH PROPER EQUIPMENT,
POWER OPERATED, THE CONTRACTOR SHOULD BE ABLE TO REMOVE ALL
OBSTRUCTIONS TO COMPLETE THE PILE INSTALLATIONS.
GROUT MUST BE INSTALLED UNDER PRESSURE THE FULL LENGTH OF THE
PILE TO COMPACT THE SOIL ADJACENT TO THE PILE AND FILL ANY
VOIDS IN THE SOIL. THE AMOUNT OF GROUT USED TO DO THIS WORK
IS A FUNCTION OF THE SOIL CONDITIONS ENCOUNTERED. IF ANY
QUESTIONS ARISE AS TO THE GROUT SHAFT BEING CONTAMINATED WITH
SOIL, SMALL DIAMETER CORES WILL BE TAKEN TO ENSURE A
HOMOGENEOUS MASS OF CONCRETE FORMS THE SHAFT AND COVERS THE

Dear Gary ,
As mentioned in our letter of 3/31/89 obstructions have
been encountered on three of the first five holes we have
drilled, locations 17 , 10 and 8 . Having spoken to Walter
Widener yesterday he had mentioned that obstructions should be
expected. I tend to disagree. An obstruction was only
encountered on one boring (No . 2 ) , was not of the same nature
and was away from the building . The presence of obstructions
below the footings could not have been encountered unless
borings had been taken through the footing.
As we grouted two of the holes that obstructions had been
encountered on, 20 bags of grout had to be pumped just below
the footing at each hole in order to get the grout to come up
through the footing. The possibility of hitting this grout on
adjacent holes further complicates the matter of installing
the piles.
Let me stress the fact that these obstructions are manmade.
Some seem to be large boulders, while reinforced concrete has
been encountered on one occasion. While we can and will try to
get thruogh the obstructions that we can, our drilling method
for the piles does not enable to get through impenetrable
obstructions. This was covered at our meeting of 1/20/89 when
we reviewed our recent proposal versus our earlier one and
other cost impacts.

AN EQUAL OPPORTUNITY EMPLOYER
Since the above obstructions were encountered we have moved
to other pile locations, and have driven the piles with no
problem. So at the least the problem is localized and should
not present an extensive problem. However , if the obstructions
are found to be present throughout the foundation our costs
and time delays would not be covered under our present
contract. The cost impact would be twofold : our additional
costs for drilling through obstructions and grouting of voids
and costs related to time extensions ( ie . inspection
services ) .
In order that we can resolve this issue I suggest that a
meeting be held to discuss a time extension and cost
implications to our contract prior to proceeding with any
obstructed pile locations . As of now we are discontinuing any
hole that a obstruction is encountered, which our drilling
methods will not allow us to penetrate in a reasonable amount
of time.
The week of April 10th -19th I will be on vacation but
would consider meeting prior or after that time.

Dear Gary,
We have begun drilling and grouting of the piles as of
3/29/89. The core drilling was done ahead of us so as to
prevent conflicts of operations. Seven holes remain to be core
drilled. The inspection at the site has been cancelled a
number of times, however it appears that the inspection agency
has reported to be on site for some of these cancelled days .
It was agreed that they should only be there only for the
drilling and grouting and not the coring. Since the drilling
and grouting for the piles has begun they have been on site
but seem to be only taking grout samples. They should also be
monitoring our drilling operation. There seems to be a lack of
inspection to verify our drilling conditions. Thus the reason
for this letter.
As of this date we have attempted drilling at five
locations. Of the five we have encountered obstructions on
three of the piles approximately 2-3 feet below the bottom of
the concrete footing . The obstructions seems to be a
combination of granite rubble and reinforced concrete . Please
advise as to how to proceed in this matter . An alternate
drilling method may be necessary in order to get through the
obstruction.

The concrete-masonry wall of the stairhall is essentially a very
deep beam with no bending and minimal tensile stress. The wall will
arch between piles. The piles will support the vertical loads as
long as they are installed as designed.

This inspector reported to the above job site to perform a pile insPec-
_ tion. The following was observed : `
Reported to Mr. Tom Lynch at 7:30 a. m. on the job. There was a three
man crew with one man working the compressor and mixing the grout, while
the other two men were drilling. They finished drilling pile 47 by
1W00 (they began drilling pile #7 on 4/ 10/891 . At 10:30 a. m. they
siarUed to grout pile #7 ; the pile was 31 1/2' and they usew 13 bags
of grout. Next , they started to grout pile #4 (pile V4 was drilled on
4/ 10/89) . They pile was 31 ` and they used 12 bags of grout . They
finisieo D'outiny pile #4 at 3:30. At 4 :00 they started to drill
caissons in pile 421 .

(Both piles were drilled on 4/5/89) . For the remainder of the day the
J mer set up plastic areung the inside walls to protect them from from
moisture.
