My opinion follows: The information you gave to me included copies of various pages of Polk's Directory stating who the tenants were. In 1949 there were three unrelated tenants on the property and it would appear that this was a three family, non-conforming use at that time. In 1949 the property again shows six people living there and it appears that it was a three family. In 1950 it showed five people living there and it appears to be a three family. In 1952 there were six people living there and it appears to be a three family. In 1953 there were four people living there and it appears to be a two family. In 1954 there were four people living there and it appears to be a two family. The issue of abandonment has been the subject matter of much litigation on whether or not the non-conformity has been abandoned. In order to establish an abandonment of an non-conformity it is necessary to show (1) an intent to abandon and (2) voluntary conduct whether affirmative to negative carrying the implication of abandonment, Cities Service Oil Company vs Board of Appeals of Bedford 338 Mass 719, 724 (1959). Mere non-use due to causes beyond an owner's control do not constitute an abandonment. In order to establish an abandonment of an non-conformity it is necessary to show (1) an intent to abandon and (2) voluntary conduct whether affirmative to negative carrying the implication of abandonment, Cities Service Oil Company vs Board of Appeals of Bedford 338 Mass 719, 724 (1959). Mere non-use due to causes beyond an owner's control do not constitute an abandonment. Once the statutory two year period has elapsed, a municipality has the authority to regulate the abandon/unused.use or structure.
