Power, III, Chairman; William Cullen; John Moustakis; Gene Collins; Chuck Puleo and Carter Vinson. Notice of this meeting was sent to abutters and notice of the hearing was properly published in the Salem Evening News. Petitioner, owner of the property, is requesting a waiver from frontage requirements from the Subdivision Regulations and under MGL Chapter 41, Section 81R, to allow the property located at 3 and 7 Winter Street to be combined into two lots. This section states that "A Planning Board may in any particular case, where such action is in the public interest and not inconsistent with the intent and purpose of the subdivision control law, waive strict compliance with its rules and regulations, and with frontage or access requirements specified in the law...." The waiver from frontage is being granted for the property located at 3 and 7 Winter Street upon the findings by the Board that: 1. Special circumstances exist which are especially affect the land and structures involved and which are not generally affecting other land and structures involved; 2. Literal enforcement of the provisions of the Regulations would involve substantial hardship, financial or otherwise, to the petitioner; 3. Petitioner shall comply with all conditions of the Board of Appeals Decision granted on November 17, 1999: and Therefore,the Planning Board voted by a vote of six (6) in favor, none opposed, to grant the waiver from frontage requirements for 3 and 7 Winter Street. This endorsement shall not take effect until a copy of the decision bearing certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed that it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded 3 and 7 Winter Street Decision January 27,2000-2 1 and noted on the owner's certificate of title. Notice of the hearing was sent to abutters and others and _.. notices of the hearing were properly published in the Salem Evening News in accace with Massachusetts General Laws Chapter 40A. The petitioner is requesting a dimensional Variances for lot area, lot area per dwelling, lot area per dwelling, lot width, front yard, side yard and height for resubdivided land for the property located at 3 Winter Street and 7 Winter Street. The Variances which have been requested may be granted upon a finding by this Board that: 1.Special conditions and circumstances exist which especially affect the land, building or structures involved and which are not generally affecting other lands, buildings and structures involve. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. The petitioner was represented by Attorney George Atkins of 59 Federal Street, Salem, Ma. 2. The petitioner lives in the neighborhood and has maintained both properties in excellent conditions. 3. There were 6 letters in favor of the petitioner's request for the proposed variances. 4. There were no objections to the proposed plans. All requirements of the Salem Fire Department relative to smoke-and fire safety shall-, be hall- be strictly adhered to.. 3. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to, the Planning Board. 4: No construction vehicles or equipment may be stored at either property.
