Correnti, Attorney at Law Serafini, Serafini, Darling & Correnti,LLP 63 Federal Street Salem, MA 01970 RE: Amendment to Decision Issued to Highlander Realty Trust for Petsmart—Traders Way, Salem, MA. A public meeting was held on April 1, 2004 regarding the request of Highlander Realty Trust to amend their Site Plan Review (pursuant to Section 7-18 of the Zoning Ordinance of the City of Salem for the parcel located at 8 Traders Way. The applicant proposed to occupy the former garden area of the Sears Hardware store with a Delivery/Take-out Pizza Hut business. The proposal includes five new parking spaces and the enclosure of the existing structure to match the existing architecture. At the April 1, 2004 public meeting held concerning this amendment request, the Board voted by a vote of seven (7) in favor(Power,Moustakis, Sullivan, Collins, Weiner, Durand, Lombardini), and none (0) opposed, to approve the amendment as complying with the requirements of Site Plan Review with the following conditions: 1. Conformance with the Plan Work shall conform with the plans entitled, "Site Plan," prepared by Mark D McCluggage, AIA, CCS, 125 S. Washington , Wichita, Kansas, 67202, and dated December 18, 2003, including sheets Cl.1, A1.2, A1.3, and A4.1. 2. Original and Amended Decisions All conditions set forth in the original decision for the Site Plan Review dated May 31, 1996, the amended decision dated May 27, 2003 shall remain and be adhered to by the applicant. 3. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty(20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
