The discussion was continued to October 21, 2010. On October 21, 2010, the Board, by a vote of nine (9) in favor (PUleO, Moustakis, George, Clarke, Kavanaugh, Ready, Sullivan, Sides and Hanscom) and none opposed, voted to approve the request to eliminate the guardrail. Based on correspondence from the Massachusetts Department of Transportation, the Salem City Engineer, and an independent contractor contacted by Mr. Tiro, the Board found that installation of the guardrail as originally planned would be difficult, if not impossible, to install, and that it would be unsafe if installed, since there is apparently no safe method of securing the guardrail to the bedrock that exists alongside the road. Tiro, his successors and assigns (hereinafter"Owner"), owner of the property which is the subject of this Memorandum of Understanding, and which is ftirther described in Land Court Certificate Number 78478, filed with the land registration office of the Essex South District Registry of Deeds. The parties agree as follows: 1. This Memorandum of Understanding replaces a Memorandum of Understanding by and between the City and Nondas Lagonakis, dated June 24, 2003,that was made a part of the settlement agreement of Superior Court Civil Action No. ESCV2000-10674-D. The Owner is successor in title to the property described above. 2. The Owner, at his expense and with prior written permission of the property owners, shall connect the properties located at 2 Thomas Circle and 310 Highland Avenue to the new water main that will be installed (replacing the existing "spider lines"). The Owner shall make the connections to the gate valves, also identified as the water shut off valves (WSO)on the Utilities Plan drawn by Patrowicz Engineering dated February 7, 2000 and revised June 27, 2006. However, if the water shut off valves are not able to be located,then the Owner shall bring the new water lines to the property lines of 2 Thomas Circle and 310 Highland Avenue and install new water shut off valves. The City shall waive the permit connection fee for this work. The Owner shall also install said water line up to 5 Thomas Circle so that owner of this lot may tie into the water line at that landowner's expense. The Owner shall take all necessary steps to minimize the disruption of water service to the existing homes. Also, the Owner will construct a sewer line across the Owner's property to the easternmost property line of the owner as shown on the Patrowicz plan solely at the Owner's cost. 3. I do not understand why you are asking for an estimate of the entire water line since it was never the intent of this Department to participate in the construction of this water line. Further, I do not believe that the MOU requires this Department to do so. I believe it would be the responsibility of the Developer to provide this estimate through the design consultant since they are the designer of record. We could have our water system design consultants review the estimate if you so desire. However, it does appear that the intent of the MOU is to have this Department assist in some limited capacity. Since I have assumed the Director's position, it has been the practice of this Department to assist in such situations to assure that the City receives a viable addition to the water supply system that will effective service current and future users and will do so using sound water works practices. An example would be to provide advice,oversight,and limited materials when a new extension can be looped to another section of the water system. This will only be done if, in my opinion when reviewing the final project documents, it will improve the City's water supply system, is in the best interest of the users of the system, and when this Department will be maintaining and operating the addition to the system. Speaking with the former City Solicitor,John Keenan, it is his understanding that a number not to exceed $6,000 was discussed in meetings but the previous Director has left no documentation that 1 can find on this discussion. It is a reasonable assertion that $6,000 is adequate to created the connection specified in the MOU. This project would provide a much needed upgrade to the water resources for the resident of Thomas Cr. that the City would be unable to complete for many years to come. The first amendment would retain the existing rock wall and eliminate the proposed guardrail. If not approved the second amendment would move the guardrail inwards. As indicated in my previous letter dated August 13, 2008 to the Department of Planning and Community Development, the two guardrail companies (Budget Fence and Cleveland Fence) indicated pre-existing issues in which the proposed guardrail cannot be installed without creating safety concerns. Since then I met with two other fence companies, one being De Luca Fence. They would not even price out a guardrail system at this location due to the safety concerns. I then met with Bob Lima the owner of Total Highway Services (THS) who went to the site on three separate occasions. The first time to mark where he believes the guardrail posts should go, the second time to hammer in steel pins to see if the posts would penetrate the surface of Thomas Circle and the third time to meet with the City Engineer, David H. Knowlton. Bob Lima (THS) explained to Mr. Knowlton verbally and since then via email the reasons why the guardrail, as proposed, would not work. The primary reason is that the plan asks for a "Mass Highway Wooden Guard Rail, steel posts securely bolted into ledge". Bob explained that the H- Beam would have to be replaced with a round post placed into a drilled hole and then cemented in place. This would severely affect the integrity of the guardrail system making it unsafe. Bob also stated at that meeting and via email that the width of the road would narrow. I also confirmed Bob's findings with the Massachusetts Highway Department. I spoke with Mr. David Phaneuf. He confirmed that the proposed guardrail shown on the plan does not and cannot meet Massachusetts Highway specifications. There is no such specification to secure guardrails bolted into ledge. Simply put, the guardrail proposed on this plan cannot safely be installed and does not meet Massachusetts Highway Specifications. In the business of sub-division planning and construction, it's very rare (if ever) that a plan proceeds without changes for various reasons. The reason here for my request for this change is that there was no exploratory excavation in the location where the guardrail was to be installed and there was no research into the Massachusetts Highway Specifications manual prior to approving the original plan by the previous owner and his engineers. If these procedures were followed then this guardrail plan would never have been proposed. Every guardrail company I spoke with stated that the safety of the guard rail, as proposed, would be severely compromised if at all possible to construct per current plan. My amendment would be to move the guardrails inward so that the H Posts can be placed into suitable fill; therefore, not compromising safety. I am willing to proceed with this proposal with the approval of the Planning Board. The alternative would be to amend the plan and leave the current condition as is.
