Additionally ,State Law considers the rooming and boarding of four or more individuals a rooming house. . Per the Mass State Building Code 780 C.M.R section 104.6 . an inspection is required of the premises.The inspection is scheduled for November 2 at 10:00 A.M, . All areas including the tenant spaces will need to be available for this inspection. If you feel you are aggrieved by this order,your appeal is to the Board of Buildings„Regulations and- Standards in Boston. Archambault : On July 31 , 1997 , I was contacted by the Health Department and asked if I would accompany one of their inspectors to the property located at 149 Federal Street to conduct an inspection of a basement apartment . I did so and my findings are as follows : #1 . The basement apartment is an illegal dwelling, my records indicate that 149 Federal St . is a legal two family dwelling. #2 . The basement apartment does not comply to State Building Codes . #3 . If you wish to legalize said apartment you must file for a Special Permit requesting an additional dwelling with the City of Salem Board of Appeals . #4 . I am aware that the unit will vacated on August 1st 1997 . You may not rent this unit without approval from the Board of Appeals . #5 . You can and may utilize said basement for laundry use , family room, playroom etc . but you may not have a kitchen and or bedrooms in the basement without meeting proper state building Codes . Please notify this department within fifteen ( 15 ) days upon receipt of this letter, to inform us as to what course of action you will take to rectify these violations .
