Dear Mr. Mario:
Inspection of your fence at 140 Federal Street reveals that portions
of the fence exceed the six (6) foot maximum height permitted in an
R-2 Zone. (Section VI Table I)
You are hereby instructed to take immediate action to correct this
violation. Also under the powers granted to the Inspector of
Buildings, by the State Building Code, you are ordered to remove
the wood strips with exposed nails from the top of the fence. Said
strips would be a hazard to public safety officials (police, fire, etc.)
in the performance of their duties. Your property will be inspected
within five (5) days and it is mandatory that this order be complied
with by that time.
Failure to comply with this order within the allotted time will be
sufficient cause to seek a complaint in the District Court of Essex.

Dear Mr. Mario,
In answer to a complaint regarding the fence recently installed on your
property we made an on site inspection of same on August 6, 1975.
While there is nothing that we can do regarding the style and design of
your fence, other than to see that it conforms with the City Regulations,
we do have the right to assure that it does not present a hazard to the
abutters.
You are therefore ordered to remove the wood strips with the protruding
nails from the top of the fence, to cleat over all protruding nails on the
abutters' sides, and to remove all nails not necessary for the stability
While we cannot insist that you do so, it is hoped that in spirit of the
Bicentennial Year you would see fit to paint at least that portion of
the fence which is visible from Federal Street and abuts the property
of an historic building.

Dear Sir;
I have been in contact with your department previously
regarding a fence which has been erected by one Jerry Mario,
140 Federal Street. The fence faces abutters at 138 Federal
Street and 5 Carpenter Street.
At the time of construction, approximately three weeks
ago, the other abutter and I expressed our concern and
dissatisfaction to your department over the general
appearance of this fence. We were told that there was
nothing that the city could do. An on site visit with
abutters would give you some idea of how distastefully
constructed this fence is, and would demonstrate why we
continue to express concern and feel that action is
warranted.
A recent development has prompted me to again attempt
to elicit assistance from your ddpartment.
Yesterday. the top of the fence was capped with strips
of wood containing a double row of tacks. The tacks occur
about one per inch, and the razor sharp points protrude
about one half inch. These strips, I believe, are normally
used for the installation of carpeting. These strips were
added in addition to the nails which protrude from the rear
of the fence at the rate of about one per foot. This
condition, as it now exists, creates the possibility of
extreme physical harm.
We have forbidden our children to go near this fence,
but, children being what they are, we will now live in
constant fear that they will impale themselves on the tacks,
or that a visiting child may do the same. Also, we fear what
will happen when an animal unknowingly jumps on top of the
fence.
I do not know what has prompted Mr. Mario to construct
such a fence. Yes, he has the right to privacy, but certainly
abutters have the right to safety. There can be no justifi-
cation for our having to live in fear for the sake of his
privacy. We will be deeply appreciative of any assistance
