SS CLERK'S OFFICE DECISION SITE PLAN REVIEW SPECIAL PERMIT OLDE VILLAGE MALL REALTY TRUST 400 HIGHLAND AVENUE SALEM, MA 01970 RE: 400 HIGHLAND AVENUE On Thursday, September 1 , 1994, the Planning Board of the City of Salem held a public hearing regarding the application of Olde Village Mall Realty Trust, for a Special Permit under Section 7-18, Site Plan Review and 7-17, Business Park Development, of the City of Salem Zoning Ordinance with respect to the construction of a 45,000 square foot retail development and associated work to property located at 400 Highland Avenue within an Entrance Corridor Overlay District . At a regularly scheduled meeting of the Planning Board held on Thursday, October 6, 1994, the Board voted by a vote of seven ( 7) in favor , none (0) opposed, to approve the application qa complying with the requirements of the Special Permits, subject to the following conditions : 1 . CONFORMANCE WITH PLAN Work shall conform with set of plans entitled "Special Permit Site Plan for property located at 400 Highland Avenue - Salem, Massachusetts, sheets 1-6, dated June 30, 1994 , revised through 9/29/94, prepared by Scott Patrowicz. 2 . AMENDMENTS Any amendments to the site plan or waiver of condition contained within shall require the approval of the Planning Board. 3 . LANDSCAPING a . Trees required under Section 7-19 (c) ( 4) (a) of the Zoning Ordinance shall be a minimum of 3 1/2" caliper . b. After all project landscaping is completed, and prior to the issuance of a Certificate of Occupancy, the developer will be required to add further landscaping if such is required by the City Planner . c. Maintenance of all landscaping shall be . the responsibility of the developer , his successors or assigns . 4 . UTILITIES a.'utility installation shall be review and approved by the Director of Public Services . t . Drainage shall be reviewed and approved by the Director of Public Services prior to the commencement of construction. C. The exfiltration system shall be maintained by the developer in perpetuity to ensure the system is functioning properly. 5 . BOARD OF APPEAL DECISION All Board of Appeal requirements issued in a Decision time stamped from the City Clerk on August 16, 1994 shall be adhered to. 6 . FIRE INSPECTOR COMMENTS The Fire Inspector requirements dated September 15, 1994 shall be adhered to. 7 , ENTRANCE CORRIDOR OVERLAY DISTRICT Work shall conform with the City of Salem' s Zoning Ordinance, Section 7-19, Entrance Corridor Overlay District. $ , BOARD OF HEALTH The Board of Health recommendations shall be adhesed to. 9 . SIGNAGE Signa eg shall be subject to review and approval of the City Planner and the Entrance Corridor Overlay District Committee prior to the issuance of a Certificate of Occupancy. 10 HIGHLAND AVENUE CURBCUT The developer shall obtain the approval from the Massachusetts Department of Public Works for access and egress from Highland Avenue as indicated on the plans. 11 . DUMPSTER a . No individual dumpsters shall be allowed. The central dumpster location shown on the plan shall service the entire development . Requirements that each tenant utilize the central dumpster shall be included in all leases . b. Dumpster enclosure design and material shall be subject to the review and written approval of the City Planner prior to the issuance of a Certificate of Occupancy. N 12 . DECIBEL LEVELS a. Air conditioning units shall not be utilized during non-business hours . Business hours are defined by the City of Salem Code of Ordinances . b. Developer shall agree to meet all Board of Health regulations for State and Local Noise control Ordinances. The Developer shall measure the decibel level by performing a decibel level test at the nearest condominium and monitoring the levels at the peak hour of usage of all equipment at the lowest ambient noise level. C. No roof-top equipment is allowed. 11. DELIVERY SCHEDULES Deliveries shall be allowed only during business hours . Business hours are as defined by the City of Salem Code of Ordinances. 14 . HANDICAP SPACES a. The handicap spaces shall be in accordance with the approved plans. b. Handicap access ramps shall be in accordance with the approved plans. C. Handicap spaces shall be striped. 15. BUILDING MATERIALS Elevation drawings of the building shall be provided which indicate the building materials which will be used. The elevation drawing shall be approved in writing -Jy the City Planner prior to the commencement of construction. 16. OLDS VILLAGE DRIVE a. The inbound and outbound sections of Olde Village Drive shall each be striped for two lane traffic. b. It is intended that Olde Village Drive shall be utilized as additional access and egress to the mall. c. Entrance across Olde Village Drive median strip shall be adequate for truck traffic. ,i. No signage shall be erected to discourage traffic to enter the shopping center from entrance onto Olde Village FSri.ve . 17 . DECELERATION AND ACCELERATION LANES A deceleration and acceleration lane of a minimum width of eleven (11) feet and a length as indicated on the attached plan shall be included on Highland Avenue on either side of the new entrance to the shopping plaza. Such lane shall gain the approval of the Massachusetts Highway Department . 18 . LIGHTING All exterior lighting shall be installed and maintained in such a way so as not to reflect or cause glare on abutting or facing residential premised, or which adversely affect safe vision of operators of vehicles moving on nearby streets . 19. MAINTENANCE a. The developer shall employ an acceptable method or means for the holding and disposal of trash ( rubbish) after site development with a copy of this method sent to the Planning Department and Health Department in writing for their approval . b. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. C. Winter snow and ice maintenance process shall be approved by the City Engineer . d. Winter snow in excess of the snow storage area on site shall be removed off site. 20. CLERK OF THE WORKS A clerk of the works shall be provided at the expense of the developer as is deemed necessary by the City Planner. 21 . CONSTRUCTION PRACTICES All construction shall be carried out in accordance with the following conditions : a. No work shall commence before 8 : 00 a.m. on weekdays and Saturdays. No work shall continue beyond 5 : 00 p.m. There shall be no work conducted on Sundays and holidays. Inside work of a quiet nature may be permitted at other times . b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. Notification shall also be submitted to the Planning Department . C . All construction shall be performed in accordance wic.th the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. 22 . e-S-BUILT PLANS As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and Engineering Department prior to the issuance of a Certificate of Occupancy. 23 . VIOLATIONS Viol—a ions of any condition shall result in revocation of this permit by the Planning Board. I hereby certify that a copy of this decision and plans have been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty ( 20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed under the name of the owner of record or is recorded on the owner ' s Certificate of Title.
