Puleo,Trustee, Puleo Realty Trust, 376 Highland Ave., Salem, MA, for the property located at 370 Highland Avenue. The proposed site plan shows new construction of an approximately 7,200 sq.ft. bank building with 44 parking spaces and construction of a portion of the paper street known as Savona Street to Ravenna Ave.. The Public Hearing was continued to July 13, 2006 and July 20, 2006. The public hearing was closed on July 20, 2006. At a regularly scheduled meeting of the Planning Board held on July 20, 2006, the Planning Board voted by a vote of six (6) in favor(Power, Moustakis, Collins, Kavanagh, Sullivan, Ready), none (0) opposed, two (2) abstaining (Durand, Lombardini) and one (1) recused himself(Puleo) to approve the Site Plan Review application subject to the following conditions: 1. Conformance with the Plan Work shall conform with the plans entitled,"Proposed Commercial Development, 376 Highland Avenue—Route 107 (Tax Map 3 Lot 62), Salem Massachusetts", prepared by McKenzie Engineering Group, Inc., 325 Central Street, Saugus, MA 01906, dated May 25, 2006. 2. Amendments Any modification to the approved plans must receive the prior approval of the Planning Board unless deemed insignificant by the City Planner. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Transfer of Ownership Within five days of transfer of ownership of the site, the Owner shall notify the Board in writing of the new owner's name and address. The terms, conditions, restrictions and/or requirements of this decision shall be binding on the Owner and its successors and/or assigns. 4. Pre-Construction Conference 120 WASHINGTON STREET, SALEM, MASSACHUSETTS 01970 • TEL: 978.745.9595 FAx: 978.740.0404 • WWW.SALEM.COM r Prior to the start of work, a pre-construction conference shall be scheduled with the City Planner, the City Engineer (or his designee), the Building Commissioner, the Health Agent, and any other departments that may be necessary. The Owner shall submit a construction schedule at the time of the pre-construction conference. 5. Specific Mitigation Items a. The applicant shall meet with the owners of 5 Ravenna Avenue to discuss mitigation items and shall report back to the Planning Board at the September 21, 2006 Planning Board meeting as to the progress of these discussions for impact mitigation on the residents of 5 Ravenna Ave. b. The applicant shall install a hedge of suitable height to act as an effective screen along the property line with Puleo's Dairy, running the full distance from Savona Street to the right- of-way for Highland Avenue. This screen shall be sufficient to discourage traffic migration between the sites. c. An escrow account shall be established in the amount of$10,000 for screening along Savona Street and Ravenna Ave. The maintenance of the screening on Ravenna Ave. and Savona Street shall be the responsibility of the owner, his successors or assigns. d. The applicant shall construct Savona Street to the city's standards, including vertical granite curbing, concrete sidewalks, and the necessary width. The applicant shall thereafter be responsible for street maintenance for that portion of Savona Street. The street will not be an accepted public way. e. The proposed hammerhead on Savona Street is to be eliminated as it was deemed unnecessary. The new roadway shall be shown on revised plans to be submitted prior to the issuance of a building permit. f. The applicant shall construct the intersection of Savona Street so that the required sight distances required in the City of Salem's Zoning Ordinance are adhered to. 6. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Trees shall be a minimum diameter of 3 '/2" dbh (diameter breast height). c. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. d. Any street trees removed as a result of construction shall be replaced. The location of the trees shall be approved by the City Planner prior to replanting. e. Final completed landscaping shall be subject to approval by the City Planner prior to the issuance of a Certificate of Occupancy. 7. Blasting The applicant shall distribute the flyers entitled, "Facts for Massachusetts Property Owners About Blasting" to all abutters within three hundred (300) feet of the blasting area. 2 l 8. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Exterior construction work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. Any interior work conducted during these times will not involve heavy machinery which could generate disturbing noises. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f. All construction vehicles left overnight at the site, must be located completely on the site. g. A Construction Management Plan and Construction Schedule shall be submitted by the applicant prior to the issuance of a building permit. Included in this plan, but not limited to, shall be information regarding how the construction equipment will be stored, a description of the construction staging area and its location in relation to the site, and where the construction employees will park their vehicles. The plan and schedule shall be submitted and approved by the City Planner prior to the issuance of a Building Permit. h. The Owner shall clean construction vehicles before they exit the construction site, and clean and sweep all streets affected by their construction truck traffic as necessary. i. Any roadways, driveways, or sidewalks damaged during construction shall be restored to their original condition by the Owner. j. All construction will occur on site;no construction will occur or be staged within City right of ways. Any deviation from this shall be approved by the Department of Planting& Community Development prior to construction. 9. Clerk of the Works The services of a consultant to serve as a Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 3 r ' 10. Office of the City Engine: The applicant, his successors or assigns shall comply with all requirements of the City Engineer 11. Board of Health (BOH) All work shall comply with the Board of Health decision and conditions. 12.Health Department All work shall comply with the general requirements of the Salem Health Department. 13. Fire Department All work shall comply with the requiremenzs of the Salem Fire Department. 14. Office of the Building Commissioner All work shall comply with the requirements of the office of the Salem Building Commissioner. 15.Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 16. Utilities Utility installation shall be reviewed and approved by the City Engineer prior to the issuance o a Building Permit. 17.As-built Plans & Street Acceptance Plans As-built plans and Street Acceptance Plans, stamped by a Registered ent and Department Engineer,rofessional s Public all be submitted to the Department of Planning and Community p Services prior to the issuance of the final Certificate of Occupancy and/or the acceptance of any street. The As-Built plans shall be submitted to the City Engineer in electronic file format suitable for the City's use and approved by the City Engineer, prior to the issuance of the final Certificate of Occupancy and/or the acceptance of any street. A completed tie card,a blank copy (available at the Engineering Department) and a certification signed and stamped by the design engineer, stating that the work was completed in substantial t be submitted to the City Engineer prior to the issuance of compliance with the design drawing mus the final Certificate of Occupancy and/or the acceptance of any street;as well as, any subsequent requirements by the City Engineer. 18.Violations Violations of any condition contained herein shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Board. The decision shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied,is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record or is recorded on the Owners Certificate of Title if Registered 4 r Land. The Public Hearing was closed on December 7, 2006. At a regularly scheduled meeting of the Planning Board held on December 7, 2006, the Planning Board voted by a vote of eight (8) in favor (Power, Moustakis, Collins, Kavanagh, Hanscom, L.ombardini, Sullivan, Ready), and none (0) opposed to approve the Drive Through Facilities Special Permit, subject to the following conditions: 1.
