N Special Permit v' Wetlands and Flood Hazard District Frank and John Bertini N 284 Canal Street ►r m Salem, MA 01970 = s Re: Kimball Road m On Thursday, April 7, 1988, the Planning Board of the City of Salem held a public hearing regarding the application of Frank and John Bertini for a Special Permit under Section P, Wetlands and Flood Hazard Districts of the Salem Zoning Ordinance, with respect to a proposal to install new storm drainage on Kimball Road, located in a wetland buffer zone. At a regularly scheduled meeting of the Planning Board held on April 21, 1988, the Board voted by a vote of five in favor, none opposed, to approve the application as complying with the requirements for the issuance of the permit with the following conditions: 1. Conformance with Plan Work shall conform to plan entitled, "General Site Development Plan, Loring Plaza Mall", dated October 13, 1987, revised March 10, 1988. 2. Conservation Commission Work shall comply with all requirements of Order of Conditions issued by the Salem Conservation Commission on April 14, 1988. 3. Test Borings Results of test borings shall be submitted to the City Planner for his review and approval. If the developer comes across a soft area, it must be stabilized and approved by the City Engineer. 4. Tree Removal All tress to be removed shall be reviewed and approved by the City Planner. 5. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 7:00 a.m. on weekdays and 8:00 a.m. on Saturdays. No work shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or holidays. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. 5. Violations Any violations of these conditions shall result in revocation of this permit by the Planning Board. This Special Permit shall not take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner's certificate of title.
