George Atkins Ronan, Segal, and Harrington 59 Federal Street Salem, MA 01970 RE: Crosby's Market Expansion, 111 and 119-125 Canal Street Site Plan Review On Thursday, September 7, 2000, the Planning Board of the City of Salem opened a Public Hearing regarding the application of Crosby's Market, located at 111 and 119-125 Canal Street under Site Plan Review for construction and expansion to the existing Crosby's Market building which is approximately 18,334 square feet. The plan shows a proposed retail expansion of approximately 9,088 square foot building with an additional 2860 square feet for a second floor office space. The proposed expansion will house a new bank, the relocation of an existing liquor store, one additional space for retail and provide office space for Crosby's Market. Parking on the proposed site will consist of 152 parking spaces, most of which are existing spaces including handicap parking and a designated area for employee parking. The Public Hearing was continued to September 21, 2000 and closed on the same date. At the regularly scheduled meeting of the Planning Board held on September 21, 2000, the Board voted unanimously in favor to approve the application as complying with the requirements of Site Plan Review and subject to the following conditions: 1. Conformance with the Plan Work shall conform with the set of plans entitled, "Site Development Permit Plan Crosby's Market, Salem, MA", sheets 1-5, prepared by, Eastern Land Survey Assoc., dated August 8, 2000 and by the plan entitled "Alternative Parking Layout", prepared by Eastern Land Survey Assoc., dated September 20, 2000. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Trees shall be a minimum of.3 %z"caliper. c. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. d. After such landscaping is completed, the developer will add further landscaping if such is requested the City Planner. 4. Signage a. Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 5. Lighting a. No light shall cast a glare onto adjacent parcels or adjacent rights of way. b. A final lighting plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. c. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of a Certificate of Occupancy. 6. Noise a. After the new addition has been opened for a six month period, the City planner shall review the noise generated from the air& heating units to determine whether the decibel level creates a negative impact on the surrounding properties. If any complaints pertaining to noise are received by the Salem Planning Department, the City Planner will review the noise situation at that time. 7. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Work shall not be conducted between the hours of 5:00 PM and 8:00AM the following day on weekdays or at any time on Sundays or Holidays. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. Crosby's Market September 21,2000-3 c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f. All construction vehicles left overnight at the site must be located completely on the site. 8. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 9. Board of Health All Board of Health requirements shall be strictly adhered to upon final decision. 10. Fire Department All work shall comply with the requirements of the Salem Fire Department. 11. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 12. Utilities a. Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. b. Drainage shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 13. Exterior Elevations a. Building elevations shall conform with the set of plans entitled, "Crosby's Market Place, Canal St., Salem, MA—Elevations/Roofplan and Elevations sheets A-1 and A-2, prepared by, E. Berman Architects, dated August 17, 2000 b. Final elevations shall be approved by the City Planner. 14. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. Crosby's Market September 21,2000-4 c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a year two-(2) period. ( Y 15. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. 16. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty(20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title. The owner or applicant, his successors or assigns, shall pay the fee for recording or registering.
