DECISION ON THE PETITION OF MARGARET TWOOHEY & DARROW LEBOVICI
FOR A VARIANCE AT-122 FEDERAL ST. (R-2) .
A hearing on this petition was held July 15, 1987 with the following Board Members
present: James Fleming, Vice Chairman; Richard Bencal, Secretary; Messrs. , Luzinski,
Strout and Associate Member LaBrecque. Notice of the hearing was .sent to abutters
and others and notices of the hearing were properly published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A.
Petitioners, owners of the property, are requesting a Variance from setbacks to
allow construction of a porch in this R-2 zone.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise,to the petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after hearing the evidence presented at the hearing, makes
the following findings of fact:
1 . Subject property is unique due to lot configuration;
2. Proposed addition would add to the aesthetics of the building;
3. Approval of the design was given by the Salem Historical Commission
in the form of a Certificate of Appropriateness;
4. No opposition was presented to the plan.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
w 1 . Special conditions exist which affect the subject premises which
do not generally affect the district;
2. The variance requested can be granted without substantial detriment
} to the public good and without substantially derogating from the intent

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
petitioners the Variance requested, subject to the following conditions:
1 . The proposed addition be done in harmony with the existing
building;
2. The proposed addition be no closer than eight (8) feet to
the property line on Lynn St. ;
3. A legal building permit be obtained.
