Bertuccio Avenue in Salem. I appreciate that you took the time to share your project details
and answer my questions about it.
After reviewing your plans in greater detail, I nevertheless continue to have concerns
about the impact of the project, especially related to blasting and drainage impacts on the
Collins Middle School and Bertram Field.
As the permitting for this proposed project has advanced and the City has
undertaken peer review of your plans, a number of significant issues have been identified.
While I trust our Planning Board to be fair and thoughtful in their proceedings, I wanted to

I am writing in regard to the proposed subdivision off Bertuccio Avenue in Salem to
inform you that I have significant concerns about the impact of the project as proposed,
especially related to blasting and drainage impacts on the Collins Middle School and
Bertram Field, as well as abutting homeowners.
While there is a strong demand for housing in Salem, I am troubled by this specific plan's
potential negative impacts on our City's only middle school and our busiest athletic
facility. I trust that the members of our Planning Board, many of whom are engineering
and design professionals,will give your proposal the careful scrutiny it deserves. As the
Mayor of Salem and the Chair of the School Committee, I wanted to reach out to you
directly to let you know that I am concerned that your project may negatively impact City
and school properties nearby.

BOARDOF HEALTH LIST OF CONDITIONS
1. The individual presenting the plan to the Board of Health must notify
the Health Agent of the name, address, and telephone number of the
project (site) manager who will be on site and directly responsible for
the construction of the project.
2. If a DEP tracking number is issued for this site under the
Massachusetts Contingency Plan, no structure shall be constructed
until the Licensed Site Professional responsible for the site certifies
that soil and ground water on the entire site meets the DEP standards
for the proposed use.
3. The developer shall adhere to a drainage plan as approved by the City
Engineer.
4. The developer shall employ a licensed pesticide applicator to
exterminate the area prior to construction, demolition, and/or blasting
and shall send a copy of the exterminator's invoice to the Health Agent
5. The developer shall maintain the area free from rodents throughout
construction.
6. The developer shall submit to the Health Agent a written plan for dust
control and street sweeping which will occur during construction.
7. The developer shall submit to the Health Agent a written plan for
containment and removal of debris, vegetative waste, and
unacceptable excavation material generated during demolition and/or
construction.
8. The Fire Department must approve the plan regarding access for fire
fighting.
9. Noise levels from the resultant establishment(s) generated by
operations, including but not limited to refrigeration and heating, shall
not increase the broadband sound level by more than 10 dB(A) above
the ambient levels measured at the property line.
10. The developer shall disclose in writing to the Health Agent the origin of
any fill material needed for the project.
11. The resultant establishments) shall dispose of all waste materials
resulting from its operations in an environmentally sound manner as
described to the Board of Health.
12. The developer shall notify the Health Agent when the project is
complete for final inspection and confirmation that above conditions
have been met.
13. The developer shall install grease traps, to contain grease in gray
water, prior to it entering the city sewer system in developments with
10 or more units and in compliance with the requirements of the City
Engineer
14. Salem sits in a Radon Zone 1 and the risk of radon entering buildings
is extremely. Therefore, the installation of radon mitigation systems are
required.
15. The final construction must comply with all requirements of the
Massachusetts State Sanitary code and a potable water supply that
meets the potable water standards of the Massachusetts Department
of Environmental Protection

Thoughts:
Sidewalk should not be bitumen concrete (aka asphalt) but should be a longer lasting cement(typical light tan sidewalk
we have downtown and some neighborhoods), I presume the developer will grant the city the road and utilities after
construction so by switching to the cement it will reduce our long term maintenance costs. They propose the dip down
form of sidewalk(radius type)and again it should be the (wing type)where vehicles bump up into the property. In
addition the sidewalk needs to be rebuilt from the current extent of lot 106 to the extent of lot 110. From lot 111 to the
corner with Calabrese street it looks like it was recently redone. Technically both sides of Bertuccio Ave need to be
redone (the other side to the extent of lot 94 across from lot 111) but if you can only get one side,that's fine. The
intersection of Bertuccio Ave and Francis road could use some work. There are only two curb cuts (technically they
should be 8) and no tactile warning strips. So it would be good to get this upgraded, redo concrete at corners tactile
strips etc. The final note is where the parcel touches Francis road,the current asphalt sidewalk is substandard in width
and quality. Ideally this would be upgraded to a 5' cement sidewalk along the parcel boundary in addition there is a
utility pole which the sidewalk would likely have to bend around and into the parcel to maintain 5' width.
I would love to see a connection to the middle school on a path/easement but I don't think that will work due to the
geography and complicated negotiations that would likely have to happen...

A new Form C Subdivision Application for 14 Bertuccio Avenue was submitted to the Planning Board.The application
consists of the construction of a roadway to serve seven (7) residential lots, and a Stormwater Management Permit in to
allow for activity that results in a land disturbance greater than one acre of land (approximately 3.44 acres).
The first hearing for this project will be before the Planning Board on Thursday,April 7th.

As we.discussed on the phone, in reviewing the subject application I have flagged some
issues. As a follow-up to our phone conversation, said issues are identified herein. I
wanted to notify you in advance to enable your client to best prepare for the Planning
Board meeting next week.
A. City Departments
1. Engineering- pending comments.
o The City Engineer has noted that a peer review is required of the
Stormwater Management Permit and utility plans for this project. A task
order that outlines a scope of the peer review services and the fee for
the peer review will be provided to you shortly.
2. Board of Health- pending comments.
3. Fire Department- per the comment sheet dated March 28, 2016, the Fire
Department concurs with the development subject to the following conditions:
o A site specific safety plan shall be submitted to the Fire Chief prior to the
start of work.
o Hydrant locations shall be determined by the Fire Department.
o The turning radius for the cul-de-sac shall be obtained from the Fire
Department.
o The project area shall be secured from nonpublic safety vehicular traffic
at the completion of each work day.
o The developer shall meet with the Fire Prevention upon hiring a blasting
company, should one be needed.
o All necessary permits, plan reviews, and inspections through the Fire
Prevention Division shall be obtained as necessary.

4. Conservation Commission- per the comment sheet dated February 25, 2016,
the project will require a permit from the Conservation Commission if any work
is proposed in an area protected by the Wetlands Protection Act or Salem's
Wetlands Ordinance.
5. Building Commissioner- per the comment sheet dated March 21, 2016, the
Building Commissioner concurs with the proposal.
6. Police Department- pending comments.
7. School Department- pending comments.
B. DPCD Staff Comments
1. Lot Nos. 2, 4, and 5 do not appear to comply with the required 100 foot lot width'.
If the lots do not comply you could 1) reconfigure and/or reduce the number of
lots to comply, or 2) apply for a variance from the Zoning Board of Appeals.
2. The proposed centerline radius curvature appears to be less than the 230-foot
minimum at approximately 125 feet.
3. The Site Details on Sheet CS602 show the details for a stop sign and a dead end
sign. Please identify where these signs will be located on the site plan.
a. Please clarify whether a waiver of this requirement is requested. If a
waiver is not requested, please revise the plans to comply.
4. According to the Project Summary in the Environmental Impact Statement, street
trees will be planted at regular intervals on both sides of the new roadway.
However, said street trees are not shown on the plans.
a. Please delineate the proposed trees on a landscaping plan to demonstrate
compliance with Right of Way Improvements Policy in the Salem
Subdivision Regulations, which require 3.5 inch caliper trees, 30 feet on
center.
i. Also, please identify the species of said trees.
5. Pursuant to the Right of Way Improvements Policy in the City of Salem
Subdivision Regulations, a subdivision with three to six (3-6) lots on both sides of
the street requires a five (5) foot sidewalk on both sides of the street, with a three
to five (3-5) foot grass strip, as determined by the Planning Board. However, per
the Street Layout and Materials Plan a five (5) foot sidewalk on only one side of
the street is proposed, with a two and half (2.5) foot grass strip.
a. Please clarify whether a waiver of this requirement is requested. If a
waiver is not requested, please revise the plans to comply.
b. If a waiver is requested, please identify: 1) how such action is in the public
interest, and 2) how such action is not inconsistent with the intent and
purpose of the Subdivision Control Law.
c. I also note that a larger grass strip is favorable since it is unlikely that a
smaller grass strip will be able to support the street trees required under
the Salem Subdivision Regulations.
Pursuant to Section 10 of the Salem Zoning Ordinance (Definitions), Lot width is: The minimum lot width required
shall be measured at the rear of the required front yard depth and on a line parallel to the right-of-way line where a
plan of the right-of-way is on file with the registry of deeds or, in the absence of such a plan, from a line twenty-five
(25)feet from and parallel with the centertine of the traveled way

6. The project plans note that bituminous concrete is proposed. It appears that
there are concrete cement sidewalks along Bertuccio Avenue. Please be aware
that the City prefers cement concrete sidewalks.
a. Pursuant to Section V(B) of the City of Salem Subdivision Regulations, the
Planning Board may require cement concrete sidewalks to conform with
the sidewalks of adjacent areas.
7. According the Environmental Impact Statement, street lighting is not proposed for
the subdivision. It is uncommon for residential streets in Salem to not have street
lights2, thus, it is likely the Planning Board will request a street lighting plan. A
preliminary lighting plan should be submitted to the Planning Department for
review, which subsequently will need to be approved by the City Electrician and
National Grid.
a. Pursuant to Section V(G)(1)(a) of the Salem Subdivision Regulations, the
electrical system for the street lights shall be of underground type.
b. I also note that the proposed fixtures should be outfitted with LED bulbs.
8. Pursuant to Section IV(C) of the Salem Subdivision Regulations, the Planning
Board may in proper cases require the plan to show a park or parks suitably
located for playground or recreation purposes or for providing light and air. Have
you considering including a park within the subdivision for a playground or
recreation purposes?
9. Please be advised that staff has received inquiries from the abutting properties
with concerns relating to construction activities, i.e. blasting.

Dear Amanda:
I greatly appreciated the opportunity to meet with you last week to briefly discuss the opportunity to
provide Peer Review Services on behalf of the City of Salem, in support of the proposed"Definitive
Subdivision— 14 Bertuccio Avenue" development on Bertuccio Avenue in Salem, MA. At your
invitation, we have prepared this Task Order—Letter Proposal to provide peer review services of the
proposed development.
Project Understanding:
• Nathan Jacobson is proposing a development/redevelopment project on Bertuccio Avenue. The
project will involve construction of seven (7) building lots, roadway and sidewalks, buildings,
driveways, and related site work and utilities.
• The City of Salem OCD will be reviewing the project for compliance with Salem Zoning
Ordinance and the Salem Subdivision Regulations.
• The City of Salem requests an independent peer review of the proposed development plans and
documentation including stormwater management, drainage, and on-site engineering issues
covered by the Environmental Impact Statement including garbage, snow storage, etc..
• Included in the peer review will be consideration of existing and proposed utilities, sewer
separation and infiltration issues, and adequacy of existing utilities to serve the project.
• Specific documents to be reviewed include an Application for Tentative Approval of Definitive
Plan Form C, an Environmental & Community Impact Statement, a Stormwater Management
Report, and a set of Design Drawings(14 Sheets).
• We are not sure if a notice of intent needs to be filed, but if so, will be reviewed by the
Conservation Commission and are not part of this review.
WATER RESOURCES - BURIED INFRASTRUCTURE-PUBLIC WORKS - CONSTRUCTION ADMINISTRATION - LAND DEVELOPMENT
SCOPE OF WORK:
Task 1) Review existing City of Salem utility plans and information in the vicinity of the proposed
Bertuccio Avenue Subdivision on Bertuccio Avenue and adjacent streets including Francis Road,
Calabrese Street, and Jefferson Avenue.
Task 2)Attend meeting with City Engineer to discuss specific City concerns to be addressed in the peer
review, including concerns and conditions from previous City Engineer review.
Task 3) Complete site visit to observe the number and location of existing sewer and drainage
structures, existing topography and impervious areas, and existing structures as shown on"Existing
Conditions Plan", Sheet 3, by TTI Environmental.
Task 4)Review Project Narrative and Environmental & Community Impact Statement and Stormwater
Management Report prepared by TTI Environmental.
Task 5) Review site development plans prepared by TTI Environmental. Review proposed on-site
stormwater management system, pre and post-development runoff calculations,and stormwater quantity
and quality issues. Review calculations for projected sanitary sewer flows, hydraulic calculations for
proposed sanitary sewer design, and layout of proposed water and sanitary sewer piping.
Task 6)Attend up to one (1) meeting with engineering representatives of TTI Environmental to review
the findings of the site walk and review of the documents summarized in Task 5.
Task 7) Prepare Letter Report summarizing findings of the record search, site walk, document review,
and meeting described in Tasks 1-6 above.
Task 8)Attend up to one (1) meeting with Staff Planner and City Engineer to discuss findings of Letter
Report.
Task 9)Plan for and attend up to one (1) Planning Board public hearings to present findings of peer
review.
Expanded SCOPE OF WORK:
Task 10) If requested by the City of Salem, provide additional engineering services as required to
complete additional site'visits, review additional project plans and documents beyond those described
above, and attend additional meetings or public hearings.
PROJECT BUDGET:
Compensation for the Scope of work described in Task 1 through Task 9 shall be made based on
periodic accrual invoices(time and materials), not to exceed the amount of Three Thousand Seven
Hundred Fifty Dollars($3,750.00) without written authorization from the City of Salem. Task 10 will
be completed on an accrual (time and materials) basis at an hourly rate of$88.00 to $160.00.
Written direction from the City of Salem will be required to expand scope of services.

PROJECT SCHEDULE:
New England Civil Engineering Corp. will complete the Scope of Services described in Task 1 through
Task 9 above within 20 working days following receipt of written authorization to proceed and copies of
all documents to be reviewed as described above.
PAYMENT TERMS:
Periodic invoices will be submitted to the Client and will be based on percentage completion of
individual tasks as described above. Invoices are payable within fourteen (14) days of receipt and
approval by Client.
EXPENSES:
The method for charging expenses, sub-contracted or supplemental services is 1.15 x the actual cost of
the direct expense.
ACCEPTANCE:
This Task Ordered letter proposal, in conjunction with the reference Contract RFQ 0-37 issuance of
Notice to Proceed dated June 3, 2013, will serve as an"Agreement to Professional Services". Please
sign this proposal in the space provided and return one executed copy to my attention at your earliest
convenience to initiate the project. We have provided five execution lines for City of Salem
authorization to proceed but will be happy to revise or append the format of this letter with additional
signature lines at your request.

Dear Sir/Madam:
Please be advised that I represent the legal interests of the applicant for the above matter,
Nathan Jacobson.
On behalf of the applicant, please be aware of the following:
�• 1. Curves are safer for vehicular traffic;
2. The Fire Department is able to safely access the property site with their largest
vehicles;
3. To mitigate, the Traffic Peer Reviewer recommended the removal of four(4)trees
to allow for a better line of sight. The subject trees will be removed from the
grass strip where they are currently located and relocated/replaced on private
property, with an easement to be provided to the City;
IV A, 2, (Sidewalk Waiver)
The sidewalk waiver should be granted because:
1. The City's ordinance requires no greater than a ten percent(10%) slope. The
applicant is providing a nine percent(9%) slope;
2. A ramp access has been provided onto the street;
3. Stop signs are to be provided;
• 4. Pursuant to the Board's recommendation,the applicant is providing a four foot
(4') sidewalk and a four foot(4')planting strip, to accommodate the root structure
of desired trees. Additionally, the applicant is amenable to providing a five foot
(5') sidewalk with a four foot(4') strip as a condition of approval;
5. Streetlights will be provided.
IV A,2, a (Right of Way)
1. A ninety foot(90')cul-de-sac is being placed to allow vehicles to safely tum
around. Many vehicles currently approach the dead end believing there is access
to the school, resulting in the vehicles having to complete a 3-point tum;
2. The Fire Department can safely access the road;
3. A one foot(1')waiver merely affects the planting strip and has no impact on
safety or maneuverability of the road entrance;
4. The City's ordinance requires no greater than a ten percent(10%) slope. The
applicant is providing a nine percent(9%) slope;
5. An area off of the cul-de-sac has been designated for stockpiling snow.
C• IV A,4, a (Dead End Roadway Length)
1. This represents the only point of safe,reasonable access to the property site.
Placing the road off Francis would present too steep of an incline;
2. The Fire Department has approved the length of the road, provided the
homes constructed are fitted with low-pressure sprinkler systems.

To whom it may concern,
My name is Ed Akerley, I have been a licensed and certified blaster in Massachusetts for over 40 years.
My company, E.C. Akerley Corp out of Gloucester, has been contacted by Nathan and Eric Jacobson for
concerns of ledge removal and rockfall mitigation.
I surveyed the site of 14 Bertuccio Avenue in Salem, MA, carefully inspecting the ledge to be blasted
and its proximity to neighbors. At the cliff facing Francis Rd, there are some projecting rocks which
protrude from the rock mass.Although they appear to be loose, they are in fact imbedded deeply into the
cliff side.
In my professional opinion, the closest blast site in the cul-de-sac is far enough away so that these rock
protrusions will remain unaffected by the blasting of ledge nearby. Using carefully planned blast design,
we are able to direct the blast energy away from the cliff, thus leaving the cliff formations intact.
Blasting near such rock formations only becomes a concern when blasting within 10 feet, and even in
that situation we are able to successfully control the blast.
