206 Derby Street Statement of Hardship - Zoning Petition Amendment AMENDMENT TO ZONING PETITIONFOR 206 DERBY STREET
REQUEST FOR PARKING VARIANCE AND STATEMENT OF GROUNDS
The petitioner hereby amends his Petition to add a second request for relief for a parking
variance from the requirements for on-site parking otherwise required by Section
5.1.6 of the Ordinance.
Under Section 5.1.6 of the Zoning Ordinance, this proposed use as an eating and drinking
place requires one (1) space for each two (2) employees plus 15 spaces. There will be 4-6
employees. The applicant will have no on-site parking spaces on the lot because, as
developed over 100 years ago, the building covers almost the entire lot, leaving no room on
the property for any parking spaces for any tenant or user of this building, including the
applicant.
This physical extent that the building covers almost the entire lot, together with the size and
shape of the lot, are circumstances that are unique to the property and not affecting other
Lands in the zoning district. Enforcement of the parking requirements of Section 5.1.6 of
the Ordinance would prevent any commercial use of this 100+year-old mixed-use
structure, would be a severe hardship, financial and otherwise, to the owner, and to the
applicant as tenant. For the reasons specified in the grounds for the Special Permit,
includingthe age and historic uses of the structure, and its proximity to the South Harbor
municipal parking garage and many on-street parking spaces in its area, it is in the City's
financial and cultural interests in fostering its commercial base, including the nearby
Pickering Wharf development, this petition may be granted without harm to the public
interest, and without adversely affecting the nature and intent of the Ordinance.
