The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted, as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.

Tha applicant, Jon Nguyen, owns and has successfully operated a a successful Vietnamese restaurant in Miami, FL since 2018. He
presently resides in Beverly, MA and applies to operate a similar Vientanese restaurant on the first floor the building at 206 Derby Street,
which until recently was occupied by Tache Realty. This proposed use will be of benefit to the City, and the Pickering Wharf development
area, and will be no more detrimental to the neighborhood that the nonconforming real estate office use because:
a) This property is located immediately adjacent to the B-5 (Central Development) zoning district, and is immediately across Derby Street
from the Pickering Wharf mixed use development, which includes mixed commercial uses including restaurants, shops offices and
upstairs residential condominium units. There is no Vietnamese restaurant in Pickering Wharf, or this area of Salem. This restaurant will
add to the palate and commercial base of the this neighborhood and the City of Salem.
b) This restaurant will be located within easy walking distance (about 100 yards) from the South Harbor municipal parking garage, and
there numerous on-street metered municipal parking places on both sides of Derby Street extending back to nearby Lafayette Street.
The restaurant will be of modest size, serving both take-out orders and indoor seating for about 20 patrons. Alcoholic beverages will not
be served. For these reasons, the restaurant It is unlikely to make any significant increase in traffic congestion or parking in the
neighborhood.
c) this building is already served by sufficient municipal utilities and other public services.
d) all proposed work will be interior remodeling of the existing space into the restaurant space shown of the Floor Plan by Dixon Salo
Architects filed with this petition. There will not be modification of the building's exterior or expansion of its footprint or height. For these
reasons, this proposal will not have any adverse impacts on the natural environment or surface water drainage.
e) this neighborhood, including Derby Street, Pickering Wharf and Hawthorne Boulevard, and this building have included commercial
uses and restaurants for many decades. Therefore, this proposed use will not cause any adverse impact on the character of the
neighborhood.
f) the building improvements and operation of the restaurant will provide additional employment opportunities in the City. The personal
property taxes that will be paid by the applicant, and the interior building improvements that will likely increase the assessed value of the
building, will have the the positive fiscal impact of yielding additional tax revenue to the City into the future.
