Massachusetts 01970
has requested a Corps of Engineers permit under Section 10 of the
Rivers and Harbors Act of 1899 and Section 404 of the Clean Water
Act to construct and maintain a pile supported concrete pier on
municipal property at the former U.S. Coast Guard facility at
Winter Island, on Salem Harbor. The 16' wide by 182 ' long pier
will extend southeast from the southerly corner of the existing
bituminous parking area. The pier will be supported on concrete
filled, steel pipe piles which will be founded in bedrock. The
top of the deck is to be at elevation +15.0 (MLW) . Access to the
water will be via a 4' wide ramp which will extend from the pier
to an 8' wide by 60' long float. The floats are to be anchored
with 21 piles. These piles will anchor additional pierside
floats 4' x 60' and 6 ' x 60' .
A 50' long approach way extending from the existing parking area
is to be constructed an earthfill. The slopes of the fill will
be protected with rip-rap; there will be no fill material placed
below MHW, (elevaton +8.8) , at this location. Approximately 50
c.y of stone rip-rap to protect the approach way will be placed
between MHW and the high tide level (HTL = +11.0 MLW) . The
abutment, placed between MHW and HTL will require 22 c.y. of
cast-in-place concrete.
The configuration of the pier is scheduled to consist of 6-30'
spans supported on an abutment and 6, 4-pile bents, for a total
length of 182 ' ( supported on 24 piles) . Budgetary constraints
may require the deletion of one span, thereby reducing the total
length of the pier to 152' and the number of piles to 20.
The project also includes the rehabilitation of an existing
concrete boat ramp which lies just to the east of the proposed
pier. This will involve the placement of approximately 60 cubic
yards of cast-in-place concrete above MHW and 170 cubic yards of
cast-in-place and precast concrete below elevation +8.8, MHW (MHW
= 0.0) . The boat ramp is 48' wide. Its total length is 130' ,
the length below MHW is 118' . The outer 50' (below elevation
+2+) will be precast planks. Approximately 20 c.y. of bituminous
approach will be placed between MHW and HTL. All new concrete
will be placed within the limits of the existing ramp. The
precast concrete sections will be anchored to 8, concrete filled
steel pipe piles founded in bedrock and installed through the
existing ramp. The tops of two of the anchored piles will extend
to elevation +17 to mark the end of the ramp. The tops of the
remaining piles will be below the top of the boat ramp.
The proposed pier will serve recreational boaters including the
Salem State College Sailing Club and the Salem State College
Handicapped Sailing Program. General public access to Salem
Harbor .will be increased. The pier is part of a comprehensive
plan by the City of Salem to restore the use of Winter Island for
public and marine recreation under the "Winter Island
Improvement" project.
In order to properly evaluate the proposal, we are seeking public

On Thursday, November 3, 1983, the Planning Board of the City of Salem held a
public hearing regarding the application of the City of Salem/Winter Island
Commission/Salem Sound Development Company for Special Permit under, Section P,
Wetlands and Flood Hazard Districts, of the Salem Zoning Ordinance, with respect
to the construction of a marina facility on Winter Island, Salem', MA_
At a regularly scheduled meeting of the Planning Board on November 17, 1983, the =
Board voted, by a vote of seven in favor, none opposed, to approve the application
as complying with the requirements for the issuance of the permit with the
following conditions:
1. Work shall conform to plans entitled,"Plan Accompanying Petition of Salem Sound
Development to construct and maintain a Timber Pier and Marina Facility in Salem,
MA. (three sheets: Sheet 1--Proposed Timeber Bearing Pile Bent Pier, Elevation and
Section; Sheet 2--Plan of Marina and Pier; Sheet 3--Typical Sections—Marina Float
System) , dated September 21, 1983, prepared by Daniel J. Lynch #23331, and USCG '
Sheet #57 "Marblehead North," and letter dated November 4, 1983, signed by,Mr_ Lynch_
2. This order does not grant any property rights or any exclusive privileges;
it does not authorize any injury to private/public property or any, invasion of
. public/private rights.
I hereby certify that a copy of this decision and plans have been filed with the
City Clerk and copies are on-file with the Planning Board.
This Special Permit shall not take effect until a copy of the decision bearing
the certification of the City Clerk that twenty days have elapsed and no appeal
has been filed or that if such appeal has been filed, and it has been dismissed
or denied, is recorded in the Essex County Registry of Deeds and is indexed
in the grantor index under the name of the owner of record or is recorded and
noted on the owner's certificate of title. The fee for recording or registering
shall be paid by the owner or applicant.

has requested a Corps of Engineers permit under:
( X) Section 10 of the River and Harbor Act of 1899,
( ) Section 404 of the Clean Water Act.
( ) Section 103 of the Marine Protection, Research and Sanctuaries
Act of 1972.
to: Construct and maintain a commercial marina. facility in Salem Harbor at
Salem Sound in the vicinity of the South Channel on municipal property at
Winter Island, formerly the U.S. Coast Guard facility. A. 14' X 260' timber
pier will extend south from an existing concrete apron and riprapped slope.
A 48-foot ramp will provide access to the proposed float system which will
be moored by concrete blocks. These will consist of a. series of 8' X 33'
reinforced concrete breakwater walkway floats with lengths of 300,. 280,
300,. 340 and 400 feet. There will be a: total of 75 3-foot wide finger
floats of lengths from 30-35 feet extending from the walkway providing 150
slips.. Parking will be- provided through comnon-use of the municipal.
facilities on Winter Island.
In order to properly evaluate the proposal, we are seeking public comment.
Anyone wishing to comment is encouraged to do so. Comments should be submitted
in writing by December 12, 1983 If you need additional information, please

The decision whether to issue a permit will be based on an evaluation of the probable impact of the proposed activity on
the public interest. That decision will reflect the national concern for both protection and utilization of important
resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its
reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the
cumulative effects thereof; among those are conservation, economics, aesthetica, general environmental concerns,
wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline
erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety', food production
and, in general, the needs and welfare of the people.
Where the activity involves the discharge of dredged or fill material into waters of the United States or the transpor—
tation of dredged material for the purpose of disposing of it in ocean waters. The evaluation of the impact of the
activity on the public interest will also include application of the guidelines promulgated by the Administrator, U.S.
Environmental Protection Agency, under authority of Section 404(b) of the Clean Water Act, and/or Section 102(a) of the
Marine Protection Research and Sanctuaries Act of 1972 as amended.
Based on his initial review, the Division Engineer has 'determined that little likelihood exists for the=proposed work to
impinge upon properties listed in or eligible for listing in the National Register of Historic Places and no further
consideration of the requirements of the Preservation of Historical and Archaeological Data Act of 1974 is necessary.
This determination is based on one or more of the following:
a. The permit area has been extensively modified by previous work.
b. The permit area las been recently created.
c. The proposed activity is of limited nature and scope.
d. Review of the latest published version of the National Register shows that no presence of registered properties
or properties listed as being eligible for inclusion therein are in the permit area or general vicinity.
Presently unknown archeological, scientific, pre—historic or historical data may be lost or destroyed by work to be
accomplished under the requested permit.
The Division Engineer has also consulted the latest published list of threatened or endangered species and has made a
preliminary determination that the proposed activity will not affect those species listed or their critical habitat.
The initial determinations made herein will be reviewed in light of facts-submitted in response co this notice.
The following authorizations have been applied for or have been or"will be obtained:
(X) Permit, License or Assent from State. Massachusetts
( ) Permit from Local Wetlands Agency or Conservation Commission.
( ) Water Quality Certification in accordance with Section 401 of the Clean Water Act.
The States of Connecticut, Maine, Massachusetts, New Hampshire, and Rhode Island have approved Coastal Zone Management
Programs. Where applicable, the applicant states that the proposed activity complies with and will be conducted in a
manner that is consistent with this approved Coastal Zone Management Program. Issuance of a State permit from the
appropriate State agency will indicate concurrence with this Statement of Consistency. .
All comments will be considered a matter of public record. Copies. of letters of objection will be forwarded to the
applicant who will normally be requested to contact.objectors directly in an effort to reach an understanding. _

part of a comprehensive plan by the City of Salem and the ';,inter
Island Commission to restore the island' s use for park and rec-

Superseding Order of Conditions relative to the above-referenced project.

A Superseding Order of. Conditions will not be issued until the Environmental
Notification Form has been processed. because the proposed marina will occur
in coastal resource areas consisting of land under the ocean, coastal beach,
rocky intertidal shore and land containing shellfish, the potential exists
for adverse impacts on the protected interests of storm damage prevention,
fisheries and land containing shellfish. These interests will be addressee[ by

elevation of flood-proofing measures and as to compliance with the
applicable sections of the Massachusetts State Building Code

on adequately anchored pilings or columns, and securely
anchored to such pilings or columns so that the lowest
portion of the structural members of the lowest floor (ex-
cluding the pilings or columns) is elevated to or above the 100
year flood level. Space below the lowest floor shall be free
of fixed obstruction. (Provide details)

IV. Procedure
The Planning Board shall, within 7 days after the filing of this
application, transmit one copy of said application, plans and all other
submitted information -to the Inspector of Buildings, City Engineer, Board
of Health and Conservation Commission who may, at their discretion,
investigate the application and report in writing their recommendation
to the Planning Board. The Planning Board shall not take final action
on such application until it has received a report thereon from the
Inspector of Buildings, City Engineer, Board of Health and Conservation
Commission or until thirty-five (35) days have elapsed after dis-
tribution of such application without a submission of a report. The
Planning Board Shall hold a Public Hearing on said application as soon
as possible after receiving the above reports, in accordance with
Chapter 40A of the Massachusetts General Laws. The Planning Board
shall notify the applicant in writing of its decision on the special
permit. The decision shall document the proposed development or use
and the grounds for granting or refusing the special permit. The

Planning Board may, as a condition of approval, require that the appli-
cant give effective notice to prospective purchasers, by signs or
by recording the special permit at the Re try of eds, of the wet-

DECISION ON TUE PETITION OF SALEM SOUND DEVELOPMENT CORP.
FOR A SPECIAL PERMIT FOR A PARCEL OF LAND ON WINTER ISLAND
A hearing on this petition was held on April 28, 1982 with the following
Board Members present: Douglas Hopper, Chairman, Messrs. Hacker, LaBrecque
and 'reeherry and Associate Member Luzinskl. Notice of the hearing was sent
to abutters and others and notices of the hearing were properly published in the
Salem Evening News in accordance with Massachusetts Ceneral Laws Chapter 40A.
The Petitioner .has requested a Special Permit to use a portion of Winter
Island as a marina with not more than 208 slips. In addition, Petitioner
proposes to construct a 30' x 40' marina support building at the site in
question. The property in question is in an R-C Zoning District. The Special
Permit which has been requested may therefore be granted upon a finding by the
Board of Appeal that the grant of the Special Permit will promote the health,
safety, convenience .a;:d welfare of the City's inhabitants.
The Board of Appeal, after considering the evidence presented at the
hearing, and after viewing the property, makes the following findings of fact:
1) The proposed use of the property is supported by the Winter
Island Commission.
2) The proposed use of the property will provide additional security
for the area and will result in an improvement in the area.
3) The proposed use of the property will not limit public access to
Winter Island. In fact, revenue from the Petitioner's lease with
the City may generate- income that will promote public use of
Winter Island.
On the basis of the above findings of fact and on the evidence presented
at the public hearing, the Board of Appeal concluded unanimously that the
coposed t:sz will promote the health safetyconvenience and welfare o
the City' s inhabitants and that the proposed use is in harmony with the Zoning
Ordinance. Accordingly, the Board unanimously voted in favor of granting a
Special Permit to the Petitioner,
The Special Permit is therefore granted in accordance with the following
terms and conditions:
1) The Petitioner may use an area on Winter Island, that will be
defined by the terms of a lease between the Petitioner and the
City, for use as a marina with not more than 208 slips. In

addition, Petitioner may construct a 30' x 40' marina support
building at the site in accordance with plans submitted to the
Board.
2) The Petitioner's use of the area in question is conditioned upon
the execution of a lease with the City. In the event that no
such lease is executed, this Special Permit shall be null and
void.

3) Petitioner will comply with all applicable Fire Safety Codes prior
to commencing the operation of hi.s.marina.
4) Petitioner's use of the marina support building shall be limited
to use as an office, shower and laundromat and for the storage
of marina equipment.
5) Petitioner shall sell no food at the site in question nor shall
Petitioner sell gasoline, store gasoline or sell boats at the
facility.
G) Petitioner will, together with the Winter Island Commission, agree
on a plan to give Salem residents priority for the marina slips.
If no such agreement can be reached this Board will order such a
plan for , the marina's use.
7) Petitioner may store no more than four boats at the site and these
boats must be owned or operated by the Petitioner.

to: Install 150 moorings consisting of concrete mooring blocks of 1000 to 5000
pounds, galvanized proof coil chain and a flotation buoy as shown on sheet 2.
These moorings are to be located in the area of Salem Harbor, Salem, Massachusetts
to the north of the Federal channel near Cat Cove as shown on the attached sheet 1.,
These moorings will accommodate private vessels up to 65 feet in length. The
applicant has a previous permit authorizing moorings to the south of the Federal
channel. Both the City of Salem Advisory Board and the Harbormaster have indicated
support for the proposed mooring area. Moorings shall be placed at the direction
of the Salem Harbormaster.
In order to properly evaluate the proposal, we are seeking public comment.

FACTORS Operations Division
The decision whether to issue a permit will be based on an evaluation of the probable impact of the proposed activity on
the public interest. That decision will reflect the national concern for both protection and utilization of important
resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its
reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the
cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline -
erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food production
and, in general, the needs and welfare of the people.
Where the activity involves the discharge of dredged or fill material into waters of the United States or the transpor-
tation of dredged material for the purpose of disposing of it in ocean waters. The evaluation of the impact of the
activity on the public interest will also include application of the guidelines promulgated by the Administrator, U.S.
Environmental Protection Agency, under authority of Section 404(b) of the Clean Water Act, and/or Section 102(a) of the
[iarine Protection Research and Sanctuaries Act of 1972 as amended.
Based on his initial review, the Division Engineer_.has determined that little likelihood exists for the proposed work to
impinge upon properties listed in or eligible forlistingin the National Register of Historic Places and no further
consideration of the requirements of the Preservation of Historical and Archaeological Data Act of 1974 is necessary.
This determination is based on one or more of the following:
a. The permit area has been extensively modified by previous work.
b. The permit area has been recently created.
c. The proposed activity is of limited nature and scope.
d. Review of the latest published version of the National Register shows that no presence of registered properties
or properties listed as being eligible for inclusion therein are in the permit area or general vicinity.
Presently unknown archeological, scientific, pre-historic or historical data may be lost or destroyed by work to be
accomplished under the requested permit.
The Division Engineer has also consulted the latest published list of-threatened or endangered species and has made a
preliminary determination that the proposed activity will not affect those species listed or their critical habitat.
The initial determinations made herein will be reviewed in light of facts submitted in response to this notice.
The following authorizations have been applied for or have been or will be.obtained:
(X) Permit, License or Assent from state. Massachusetts
( ) Permit from Local Wetlands Agency or Conservation Commission.
( ) Water Quality Certification in accordance with Section 401 of the Clean Water Act.
The States of Connecticut, Maine, Massachusetts, New Hampshire, and Rhode Island have approved Coastal Zone Management

At the regular meeting of the Waterways Advisory
Board held on 14 September 1983, a complete study was
made of the request of Salem Sound Development to con-
struct and maintain a timber pier and marina at- winter
Island in Salem Harbor. The _oazd has followed the
design of this development- for nearly taro years.

Subj: Proposed Marina at Winter Island
There are many reasons why this marina should not be allowed to
proceed, some of which I will include in this correspondence:
1. The City of Salem has very little in the way of free and complete
public waterfront access. This marina will restrict approximately
50% of what is remaining.
2. The area is now open land with a large quantity of wild life, which
will be either killed or dispossessed.
3. The access road to Winter Island will not support the traffic which
will be generated by the marina and associated businesses. This
will adversely affect neighborhood property values.
4. The proposed breakwaters will cause additional and accelerated
silting-in of Cat Cove. The result of which will be dredging by
New England Power to keep their in-take pipes clear, and by the
Department of Natural Resources for water flow. This cost will have
to be borne by the consumer and general public. Evidence of what
happens when breakwaters are indiscriminately built can be observed
at White St. Marina, Juniper Cove, and on a larger scale at Plum
Island. All of these areas have silted-in rapidly after breakwaters
were constructed. Before any permits for breakwater construction
are granted, I request that extensive tidal flow and wave action
studies be done and that New England Power and the Cat Cove Marine
Laboratory be advised as to the results.
5. The oil and gasoline spills along with the normal discharges associ-
ated with a marina may also have a detrimental affect upon the Cat Cove
Marine Laboratory, as there is now only one tidal entrance to the pool.
6. This property was deeded back to the City of Salem by the United States
Government for perpetual use as a public park. In view of the past
decision of the U. S. Courts regarding the construction of a public
school on park land, this project is completely illegal and beyond
the authority of the City of Salem to authorize.
7. At this stage in the city's development, I believe we should take a
long look at what legacy of free space we will leave for our children
to enjoy. We should not be coerced by promises of small sums of
money or political pressure for private gain.
These are but a few of the factors to be considered before granting
any further permits for this undertaking.

Will give a public hearing under the Wetlands Protection Act, Mass. G. L.
Chap. 131, Section 40,at the request of Salem Sound Development Corp.,
23 Congress Street, Salem. The purpose of the hearing is to explore the
effects of the construction of a commercial marina facility including timber
pile bent pier with wood deck; main line and finger wood floats and
perimeter reinforced concrete breakwater floats at Winter Island, Salem,
MA. The hearing will be held on Thursday, October 13, 1983, at 8:00 p.m. ,
One Salem Green, second floor conference room.
