Sea Wall Repair
1. Go - Ahead Notification:: Salem Conservation Commission

2. Congtruction Agent Selected: Within 14 Days of Notification
a. Army Corps of Engineers - Construction Division of the
New Hampshire National Guard has expressed interest in
taking part in the Sea Wall repair as part of their
Spring Training Schedule . ,larch lst Decision.
b. Private Contractor: To be released on public bid.
Schedule : Advertisment - one day in two separate
weeks.
Receipt of bids - 14 days after first
day of advertisment.
Selection - Within 30 days of bid
receipt.Contractor then
has ten days to return
signed contract with work
schedule.
Maximum time between Go - Ahead notification
and contract signing - 75 Days. With a March lst
notification, construction would begin in the
vicinity of May 15 . This is on the Sea Wall Repair
only.
Moat Causeway Removal
1. Go - Ahead Notification: Salem Conservation Commission

2 . Testing: a. Intial Digging to determine if Rip Rap and
,bridge embankments are still in place, under
the causeway fill.
b. Soil testing to determine the suitability/
possibility of driving piles for bridge
supports (wooden) .
Testing will commence immediately after notification.
From test results it will be determined whether the
moat can he removPri at tha rranaawav and n hriamo
Any/and/all moat construction work will not commence until after
the completion of the Sea Wall Repair (exclusive of testing) .
Sea 'Wali Repair - Construction Pian_
1. Removal of all stone from the sea ward dimensions of the Sea Wall..
(except where removal of the stone would damage the beach .area) .
All stone of larger than 1 (one) Cubic Yard will be lain as part
of the new Sea Wall dimensuons. All stone smaller than 1 (one)
Cubic Yard will be lain as a base for later earth work.
2. Importation. 'and Installation of Cubic Yard Stone (Granite)
furnished by the Contractor, lain to the dimensions of the
Sea Wall.
3. Importation and Installation of 1 (one) Cubic Foot Stone(Granite)
furnished by the Contractor, lain as a base for later earthwork.
4. Importation and Installation of .1/2 to 1 Inch stone, suitably
compacted.
5 . Importation and Installation of initial gravel layer, suitably
compacted.
6. Importation and Installation of fine grade beach sand for any
disturbed beach areas.
All subsequent earth work is dependent upon the testing results of
the Moat " Causeway Removal. If the Causeway can be removed the fill
taken will be used for the backfill of the Sea Wall. This backfill
will be covered with a loam/dirt layer suitable for planting. If
the Moat Causeway can not be removed ,suitable backfill materials
will be imported and installed.

After viewing the site, it is evident that the seas and intertidal
action have a significant effect on the proposed restoration area.
It is our opinion that the rip-rap wall should, in fact, be made
higher than you propose.
One of the Commission members will periodically visit the site
during construction to assure compliance with the conditions.

Pursuant to the authority of G.L. c. 131 s.40, the calem ('onRPryAt-Jnn
Commission has considered your notice of intent and plans
submitted therewith, and has determined that the area on which the
proposed work is to be done is significant to one or more of the interests
described in the said act. The Salem Conservation commission
hereby orders that the following conditions are necessary and all work
must be performed in strict conformance therewith:
CONDITIONS
1 . Failure to comply with all conditions stated herein, and with all
related statutes and other regulatory measures, shall be deemed cause
to revoke or modify this order.
2. This order does not grant any property rights or any exclusive
privileges; it does not authorize any injury to private property or
invasion of private rights.
3. This order does not relieve the permittee or any other person of the
necessity of complying with all other applicable federal, state, or
local statutes, ordinances, by-laws and/or regulations.
4. The work authorized hereunder shall be completed within one (1) year
from the date of this order. The order may be extended by the
issuing authority for one or more additional one-year periods upon
application to the said issuing authority at least thirty days prior
to the expiration date of the order or its extension.
5. Any fill used in connection with this project shall be clean fill,
containing no trash, refuse, rubbish or debris, including, without
limiting the generality of the foregoing, lumber, bricks, plaster,
wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators,
motor vehicles or .parts of any of the foregoing.
6. No work may be commenced until all appeal periods have elapsed from
the order of the Conservation Commission or from a final order by
the Department of Natural Resources has elapsed.

7. No work shall be undertaken. until the final Order, with respect
to the proposed project, has been recorded in the Registry of
Deeds for the district in which the land is located. Copy to
be furnished to issuer of this Order showing book and page.
8. Upon completion of the work described herein, the applicant -
shall forthwith request, in writing, that a Certificate of
Compliance be issued stating that the work has been satisfactorily'
completed.
9. A sign shall be displayed at the site not less than two square
feet or more than three square feet bearing the words,
"Massachusetts Department of Natural Resources, File
Number 64-9
10. Where the Department of Natural Resources is requested to make a
determination and to issue a superseding order, the Conservation
Commission shall be a party to all agency proceedings and hearings
before the Department of Natural Resources.
11. The work shall conform to the following described plans and
additional conditions : (See Attachment; Schedule A)

ATTACHMENT SCHEDULE A
1. The elevation of the top of the proposed rip-rap wall shall
be at least the same elevation as the existing rip-rap wall.
2. No rocks from the shore, other than remains of the previously
existing rip-rap wall shall be used.
3. Sand from the shore shall be used.
4. Should there be any oil in the tanks , it shall be disposed
of off site.
5. All equipment used at the site shall be removed after
completion of the construction.

The applicant, any person aggrieved by this order, any owner of
land abutting the land upon which the proposed work is to be done, or
any ten residents of the city or town in which such land is located,
are hereby notified of their -right to appeal this order to the
Department of Natural Resources, provided the request is made in writing
and by certified mail to the Department of Natural Resources within
ten (10) days from the issuance of this order.

* This figure corresponds to the existing beach line on site. Our
planning at this point, and most likely for the duration of the
roject, calls for no excavation work at all on the beach area
except for the removal of salvageable stone where no damage will
be inflicted on the beach) .
All work to be done on the Sea Wall and earthen embankment, is
to be carry out from within the Fort itself. Inherent within the
planned removal of the fuel tanks adjacent to the Sea Wall area,
is the cross sectioning of the earthen embankment - Fort Wall.
This will afford neater access to the construction site and pre-
clude the necessity of using heavy equipment on the beach itself.
(This was also suggested by Mr. Jeff Moran, a consulting archaeol-
ogist on the Narbonne House and Central Wharf in Salem. The pur-
pose of the cross-section,beyond access to the site area,is to
study the construction method of the Fort itself. )
I would also like to emphasize, that, prompt go-ahead notification
will allow us to proceed with the appropriate testing required to
determine the advisability and extent to which work can be carried
on in regards to removal of the moat causeway. Again, thank you

Re: The Preservation of Fort Pickering
Fort Pickering is being maintained as a Natural Preserve..
We wish to retain the Fort as it is now and to protect its
architecture. In addition, we wish to remove and/or repair
the foreign, industrial and element produced alterations
which have occurred since the commencement of the U.S.
Coast Guard's occupation of Winter Island in the 1930'x.
The completed Natural Preserve will be available to the
public for a study of its construction, and for its natural
and scenic beauty.
Essentially, the work proposed within the Fort Pickering
project consists of the repair and maintenance of an exist-
ing Rip Rap sea wall. Over the course of time, this section
of sea wall has been systematically eroded by the sea and
weather. With the erosion of the sea wall, one of the large
earth embankments which form the perimeter of the Fort has
collapsed to such an extent, that, at the present time, but
one half of the embankment remains in place. We propose that
the now nonprotective sea wall be restored to its as built
dimensions and that the eroded earth embankment behind the
sea wall be restored and planted.
Further, the U.S. Coast Guard, during its stay at Fort
Pickering,erected an earth causeway across the Fort 's pro-
tecting water moat. The Fort had previously been accessible
only by a wooden bridge. We propose to remove the earth
fill forming the causeway across the moat (now deemed wet-
land) , thus, extending the wetland area. Access to the Fort
would be afforded by the installation of a replica wooden
bridge. The removed causeway fill-, would be used as a sec-
tion of the gravel fill to be placed behind the repaired
sea wall.

Gentlemen:
We refer to your proposed causeway removal, bridge construction
and riprap repair at Fort Pickering, Salem, Massachusetts. Based
on your meeting with Paul Jendzejec of my staff and a subsequent
field visit by one c_ our inspectors, we have determined the
following:
The inner pond is a wetland adjacent to a navigable water of
the United States and as such will require a Department of
the Army permit for any discharge of dredged or fill material
into it. This would include bridge abutment construction and
slope protection if located within the boundaries of the wetland.
Removal of the causeway itself does not require a permit unless,
during the construction operation, material from the causeway
is place&'.into the adjacent wetland and pond areas either
temporarily or permanently. Repair of the existing riprap
will not require a Federal permit provided that such repair
does not lengthen or widen the present base dimensions.
The application must be submitted on ENG Form 4345. The form and
samples of the necessary drawings are inclosed. If you have any
